RIGHTS OF WAY SUB-COMMITTEE ITEM 6 14TH NOVEMBER 1991 PARLIAMENT PLACE, BADGER FARM REPORT OF THE COUNTY SECRETARY A claim for 2 footpaths from Downland Road and Austen Avenue to Badger Farm Road, Olivers Battery was rejected by the Rights of Way Sub-Committee on 2nd May 1991, but the County Secretary was requested to explore the possibility of the Committee making a public path creation order along the claimed routes. In the course of these explorations a number of issues have arisen including the possibility of an alternative footpath from Austen Avenue along the side of Parliament Place (on County Council land) and crossing only a small portion of land owned by the residents of Parliament Place, the level of compensation payable by the County Council under a Creation Order and patterns of public use. Enquiries are underway to establish its viability, cost and attitudes of all concerned. In terms of total public need, a path from Austen Avenue to Badger Farm Road would seem to meet a greater need than one from Downlands Road. If a dedicated route linking with Austen Avenue were acceptable it should be possible to arrange for the other path from Downlands Road to be kept open perhaps on a permissive basis for a trial period in order that any problems can be assessed. RECOMMENDATION: That the County Secretary report to the next Rights of Way Sub-Committee meeting on the lines of this report in the light of further consultations with the Residents and the Parish Councils. 4dR55101
