APPLICATION TO DIVERT MELCHET PARK AND PLAITFORD FOOTPATH 6 BY THE
CLIFTON CATHOLIC DIOCESAN TRUSTEES AND PARKWATER INVESTMENTS

  _  Diversions of footpaths and bridleways may be made under      _
  _  Section 119 of the Highways Act 1980 as amended by the        _
  _  Wildlife and Countryside Act 1981 as being either:-           _
  _  "Expedient in the interests of the owner, occupier or         _
  _  lessee of land crossed by the right of way" or "Expedient     _
  _  in the interests of the public".  Members must be satisfied   _
  _  that the diverted route will not be substantially less        _
  _  convenient to the public, and must have regard to the effect  _
  _  which a diversion will have on the enjoyment of the path as   _
  _  a whole.                                                      _

1    Hampshire County Council have received a joint application, from
     the owners of St Edward's School, Melchet Court and Melchet
     Court Farm, to divert part of Melchet Park and Plaitford
     footpath 6.  It is made under section 119 of the Highways Act
     l980, being expedient in the interests of the land owners and
     the public.
 
2    Currently the definitive route of the path runs northward along
     a tarmac surfaced track before turning westward, passing the
     tennis courts, and then along the gravel terrace at the rear of
     Melchet Court.  It continues around the high walled cottage
     gardens before heading northward towards Woodfalls Farm.
 
3    It is proposed to divert the path so that it continues northward
     along the tarmac track and then westward, passing the front of
     Melchet Court, and overlooking the Temple Park before turning
     north towards Woodfalls Farm.
 
4    The applicants contend that this route affords greater privacy
     and security for the occupants of the school, whilst at the same
     time allowing the public to use an all-weather track with good
     views to the north.
 
5    There are no objections from the consultees.

Recommendation
 
That an Order be made, under section 119 of the Highways Act l980, in
the interests of the land owners and the public, to divert part of
Melchet Park and Plaitford footpath No 6.
