DISPOSAL OF MATERIAL FROM THE CONSTRUCTION OF THE A34 WHITWAY
DIVERSION BY REGRADING EXISTING CONTOURS AND RESTORING TO ORIGINAL
USE (APPLICATION NO. BDB 23548)
 
REPORT OF THE COUNTY PLANNING OFFICER
 
 
1.    Permission is being sought to dispose of surplus materials
arising from the construction of the A34 Whitway Diversion, on land
at Whitehill Embankment near Burghclere.
 
2.    The site is located approximately two kilometres south of the
village of Burghclere, directly adjacent to the route of the A34
Whitway Diversion which is currently being constructed.  The site,
illustrated on the attached plan, a small valley, is approximately
1.42 hectares in area.
 
3.    The proposal involves the partial filling of the valley with
waste material from the road construction works.  It is estimated
that approximately 120,000 tonnes of surplus material will need to be
disposed of from the contract and the site has sufficient capacity.
Because the site is directly adjacent to the route of the A34
diversion there will be no requirement for vehicles transporting the
surplus material to the disposal site to travel on the existing
highway.
 
4.    The valley, which runs westwards from the line of the A34
diversion, will be partially filled creating a false embankment at
the eastern end adjacent to the route of the A34.  The valley feature
will be retained at a higher level with gentler gradients to the
valley sides.
 
5.    The County Surveyor, Environmental Health Officer, Ministry of
Agriculture, Fisheries and Food, Thames Water Authority have no
objection to the proposal.
 
6.    The Department of Transport has directed that permission be
refused on the grounds that the proposal would be detrimental to the
trunk road drainage system.
 
7.    I have received one letter of objection from the owner of land
at Woodham House, Whitway who recently obtained planning consent to
fill clay pits adjacent to his property with waste material arising
from the construction of the Whitway diversion.  The objection is on
the grounds that this proposal would remove the opportunity to fill
the clay pits.

8.    Basingstoke and Deane Borough Council's views are awaited.
County Planning Officer's Comments
 
9.    Although the Department of Transport has directed that the
application be refused, discussions are taking place between the
applicants and Department of Transport to resolve the issue.
 
10.   I note that another facility, for the disposal of waste arising
from the construction of the A34 Whitway diversion already exists.
However, the availability of an alternative facility is insufficient
grounds for a refusal of an application.
 
11.   I have no objection to the principle of the proposal, subject
to suitable conditions regarding the restoration and the Department
of Transport withdrawing its direction.
 
RECOMMENDATION
 
12.   I recommend that, subject to the Department of Transport
withdrawing its direction, the submission of amended plans to satisfy
their requirement, and no substantial objection from Basingstoke and
Deane Borough Council, planning application No. BDB 23548 be
approved, subject to the following conditions:
 
      (1)     Approved Plans and Details (2.1.1).
 
      (2)     Time limit for completion (8.3.2).
 
      (3)     (Special).  No materials other than those arising from
      the construction of the A34 (Whitway Diversion) shall be
      deposited at the site unless otherwise agreed in writing by the
      County Planning Authority.
 
      (4)     (Special).  Access to the site shall be from the line
      of the A34 only.  At the completion of the tip prior to the
      opening of the A34 Whitway diversion the access shall be
      stopped and then restored to the satisfaction of the County
      Planning Authority.
 
      (5)     Operating times (4.3.1(4))  [insert: 7.30 and 18.30]
      [insert: 7.30 and 13.00].
 
      (6)     Retention of soil on site for restoration.(8.3.15)
      [delete: mineral extraction] [insert: Tipping].
 
      (7)     (Special).  As part of the restoration of the land to a
      state suitable for agriculture, the site shall be drained in
      accordance with details to be subsequently agreed in writing by
      the County Planning Authority.
 
      (8)     Implementation of restoration  scheme.(8.3.16(1))

      (9)     (Special).  The temporary topsoil storage area
      indicated on drawing numbers CAB/C224/TIP1/1 shall not exceed 3
      metres in height.
