HIGHWAYS ACT 1980, SECTION 256
NOTICE OF PROPOSED AGREEMENT BY COUNTY COUNCIL WITH OWNER OF LAND FOR THE ADJUSTMENT OF THE BOUNDARIES OF THE HIGHWAY AT IPLEY CROSSROADS, HAMPSHIRE IN THE NEW FOREST
Notice is given in accordance with the provisions of the Highways Act 1980, section 256 that, for the purpose of adjusting the boundaries of the highway maintainable at public expense at the junction of the C63 Beaulieu Road (running North/South) and the C97 (running East/West) ('Ipley Crossroads'), the County Council, as the local highway authority, proposes to enter into an agreement with the Secretary of State for Environment, Food and Rural Affairs ('the Owner') as the owner of land adjoining or lying near to the highway, which is managed by Forestry England, for the exchange of land. The proposed adjustment to the highway boundary would create a staggered junction. The need for the staggered junction arises because of the increasing frequency of collisions at the junction causing fatalities and serious personal injury.
PARTICULARS OF THE PROPOSED AGREEMENT:
1. There shall be transferred by the Owner to the County Council the following Forestry England land being in total approximately 663 square metres (shown shaded grey on the Land Transfer Plan): an area of land approximately 102 metres in length and 6 metres wide starting approximately 112 metres west of Ipley Crossroads and running in a south easterly direction to a point approximately 50 metres south of the crossroads when measured at the centre line.
2. There shall be conveyed by the County Council to the Owner an area of land of approximately 591 square metres within the boundaries of the current highway immediately west of Ipley Crossroads (shown hatched black on the Land Transfer Plan).
3. The County Council proposes to also transfer to the Owner a further area of land of not less than 72 square metres at another site (not shown on the Land Transfer Plan), which transfer is not subject to this s256 procedure as the land is not situated in the vicinity of Ipley Crossroads and is not required for the adjustment of the highway boundary, which land is to be offered as compensation to the Owner for the proposed increase in land used as highway at Ipley Crossroads.
Any person who objects to the proposed agreement may appeal to the magistrates' court sitting at Southampton and New Forest Magistrates, 100 The Avenue, Southampton, SO17 1EY, before the expiration of 2 months from the date of first publication of this notice (Highways Act 1980 s256(3)).
Any person claiming an estate or interest in or right over or charge on the land to be transferred by the County Council to the Owner may claim compensation (Highways Act 1980 s256(5)).
A copy of this notice and a plan of the proposed adjustment of boundaries of the highway showing the land to be transferred (titled Ipley Cross Beaulieu Safety Improvements – Land Transfer Plan) is available for inspection, free of charge, at:
