The Hampshire (VARIOUS ROADS, WINCHESTER) (Parking Places and RESTRICTION OF Waiting) (NO. 2) Order 2002 (Variation No. 41) Order 2024

NOTICE IS HEREBY GIVEN that Hampshire County Council made the above-mentioned Order on Tuesday 11^th June 2024, in exercise of its powers and duties under Sections 1, 2, 4, 32, 35, 45, 46, 49, 51, 53 and 122 (1) and (2) of the Road Traffic Regulation Act 1984 (“the Act”), Part IV of Schedule 9 of the Act and of all other enabling powers, after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 of the Act, and having discharged its duty under section 122 of the Act.

General nature and effectS of the Order: Will be to:

(i)        insert a new Article 17 (iii) into the Principal Order:

“(iii) between the hours of 8am to 10pm Monday to Saturday (inclusive) on any of the side of the road specified in Schedule XIV of this Order.”;

(ii)       insert the items specified in Schedule I to this order as a new Schedule XIV to the Principal Order – 8am to 10pm Monday to Saturday (inclusive);

(iii)      remove the items specified in Schedule II to this order were deleted Schedule II of the Principal Order; and

(iv)      insert the items specified in Schedule III to this order into Schedule II of the Principal Order.

In this order, the Principal Order means The Hampshire (Various Roads, Winchester) (Parking Places and Restriction of Waiting) (No. 2) Order 2002

Schedule I

Items to be inserted into the Principal Order

New Schedule XIV – No Waiting 8am to 10pm Monday to Saturday (inclusive)

Schedule II

Items to be removed from the Principal Order

To be removed from Schedule II – No waiting at any time

Schedule III

Items to be inserted into the Principal Order

To be inserted into Schedule II – No waiting at any time

DATE OF OPERATION: The order will come into force on Friday 28^th June 2024.

APPLICATION TO THE HIGH COURT: Any person desiring to question the validity of the Order or of any of its provisions on the grounds that it is not within the relevant powers of the Act, or that any of the relevant requirements of the Act or of any relevant instrument made thereunder has not been complied with in relation to the Order may, by Tuesday 23^rd July 2024 make application for the purpose to the High Court.
