Hampshire County Council collects information about you in order to process your request for compensation.

We will use the information for processing your claim against Hampshire County Council.

The legal basis for our use of this information is where it is necessary for compliance of a legal obligation to which the County Council is subject. Special category data will be held where necessary for the establishment, exercise or defence of legal claims or where courts are acting in their judicial capacity.

It is necessary to record National Insurance numbers and date of birth as the Highway Authority is obliged to register all personal injury claims within the Department for Works and Pensions.

We may share your personal information with the Department for Works and Pensions.

When investigating your claim, where our legal team determines that responsibility lies with our contractor, your personal information (contained in the claim form and supporting documents) will be shared with them so that they can investigate.

Your records will be held by us for a specified length of time, depending on the type of record and type of service we provide to you. Some of these time periods are specified by law. However, were there is no relevant legislation, the times given are agreed by the County Council’s Records Management Service.
