Hampshire County Council (“the County Council”) collects and is responsible for processing personal information in order to deliver the Travel Safe Partnership (TSP). This processing is carried out by the County Council and its appointed agents on its behalf.

This Privacy Notice explains how your personal information is used, how it is protected, and what rights you have.

About the Travel Safe Partnership

The Travel Safe Partnership is a public safety scheme commissioned by Hampshire County Council (HCC) to improve safety and public confidence at bus stops, on board buses and along public transport corridors.

The scheme is delivered on HCC’s behalf by Portsmouth City Council (PCC) under contract. PCC acts as a data processor for HCC.

The scheme includes:

CCTV at selected bus stops and transport locations
Travel Safe Officers carrying out patrols and public engagement
Enforcement and prosecution activity undertaken under the Community Safety Accreditation Scheme (CSAS), and through any other lawful powers granted to the Council, its staff or appointed agents

The County Council’s use of camera systems

The Travel Safe Partnership scheme uses camera systems in a variety of forms, including:

Closed Circuit Television (CCTV)
vehicle-mounted cameras
body‑worn cameras

Not all camera systems listed above are used in every location; the specific systems in operation will depend on the site and operational requirements.

These systems may be used to:

enhance public safety, reduce crime and vandalism, manage traffic, and support enforcement, including anti-social behaviour (ASB), offences against the person and environmental offences
provide evidence which may be used by the Police and any other legally recognised authority to prosecute offenders
provide evidence to officers of Hampshire County Council and any other local authority to assist in the execution of their lawful duties
monitoring road traffic and improving road safety, including the capture of driving offences

What personal information we collect

We may collect the following types of personal information:

identity and contact details, such as name, address, telephone number and email address
images and video recordings, including CCTV and Body Worn Camera footage
date of birth (where required to confirm identity)
household and family information, where relevant to an ASB investigation
health information, including mental or physical health details, where relevant and lawful
housing, safeguarding or support needs
communications with us and our agents - such as letters, emails, and call records
information from third parties - for example, police, health professionals, other councils or partner agencies
emergency or next‑of‑kin contact details, where you have provided them, or where the data subject is under the age of 18 years
vehicle registration marks and Vehicle Identification Numbers

Some of this information may be special category data or criminal offence data, which we process only where the law allows and with appropriate safeguards in place.

Other ways we receive personal information

We may also receive personal information from:

members of the public making reports
transport operators and their staff making reports
police forces
other local authorities
schools and academies
professionals at other public organisations, such as the NHS and community payback schemes
businesses
housing providers including shelter and hostel accommodation

Any information submitted will only be recorded when we are investigating incidents, complaints or allegations and that information is relevant.

Why we collect and use your information

We collect and use personal information for the following purposes:

improving safety at bus stops, on board buses and along public transport routes
improving the safety of walking routes to and from bus stops
preventing and detecting crime, antisocial behaviour, fare evasion, and vandalism
protecting the safety of passengers, transport staff and the wider public
supporting enforcement activity
investigating incidents, complaints or allegations
supporting legal proceedings where necessary

Lawful basis for processing

We will rely on the following lawful bases when processing your personal data, depending on the circumstances:

That the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the County Council
Law enforcement purposes
That the processing is necessary to protect someone’s vital interests
That the processing is in the substantial public interest, such as safeguarding individuals at risk and preventing crime.

Is providing this information mandatory?

The County Council, and its appointed agents, undertake statutory functions relating to community safety and passenger transport.

You are not generally required to provide personal information. However, where information is lawfully requested as part of an investigation or enforcement activity, failure to provide it may limit our ability to take action and, in certain circumstances, may constitute an offence where this is provided for in law.

Automated decision‑making and profiling

We do not use personal information collected through the Travel Safe Partnership for automated decision‑making or profiling.

Portsmouth City Council processes personal data on behalf of, and strictly in accordance with the instructions of, Hampshire County Council.

Who we share your information with

The County Council and its appointed agents may share relevant personal information where necessary and lawful with:

The police and other law enforcement bodies
Health and social care providers
Safeguarding partners
Other local authorities
Legal advisers and courts
Schools and educational establishments
Bus operators, when attempting to identify somebody as part of an investigation
Contractors or service providers acting on our behalf

We only share the minimum information necessary for the specific purpose.

We may share information with family members or carers only where appropriate, usually with your consent, unless doing so would place someone at risk or where legally required.

Third‑party processors

Portsmouth City Council processes personal data on behalf of Hampshire County Council for the purposes set out in this Privacy Notice.

International transfers

Your personal information is not transferred outside the UK or the European Economic Area (EEA).

How long we keep your information

Personal information is retained only for as long as necessary and in accordance with Hampshire County Council’s retention schedules.

This includes:

CCTV and body‑worn camera footage: typically up to 31 days, unless required for investigation or legal proceedings
incident and enforcement records: retained in line with statutory and operational requirements

Your data protection rights

You have rights in respect of your personal information, including the right to access, rectify, restrict or erase data in certain circumstances, and to object to processing where applicable.

Where footage includes other identifiable individuals, access may be restricted if disclosure would breach the rights of others or prejudice an ongoing investigation.

Subject Access Requests and data rights requests

Although Hampshire County Council is the Data Controller, all Subject Access Requests (SARs) and other data rights requests relating to the Travel Safe Partnership should be directed to Portsmouth City Council in the first instance, as the organisation processing the data operationally on the County Council’s behalf.
