1 REINSTATEMENT OF DISUSED GRAVEL WORKINGS WITH INERT WASTE, NORTH COMMON LANE, SWAY (72033) : VARIATION OF CONDITION (1) OF PLANNING PERMISSION 00057104N FOR AN EXTENSION OF TIME FOR A WASTE TRANSFER STATION, NORTH COMMON LANE, SWAY (71244)
Mr. Collier and Mr. Lowbridge, on behalf of applicant Mr. Farwell, made deputations on the Sway applications. The Sub-Committee then considered the report (Item 1 in the Minute Book) on the matter. Councillor Stocks declared a non pecuniary interest in the application. The County Planning Officer advised that a revised landfall plan had been submitted which amounted to an improvement on the earlier proposal, but still did not address the issue of appropriateness. He had been advised that the District Council Environmental Health Officer still felt that the noise generated by the filling operations would not meet current noise restrictions. Three earlier complaints concerning the waste transfer station had been found to be unfounded and the matters of complaint had, in any case, been covered in objections to the planning application. All letters of objection had been copied to the District Council Environmental Health Officer and two letters of support had been received. Local Member Councillor Thornber had expressed support for the recommendations of the County Planning Officer.
RESOLVED:
(i) That planning permission in respect of the variation of condition (1) of planning permission 00057104N for an extension of time for the waste transfer station at land off North Common Lane, Sway (71244) be granted subject to the condition specified in the report.
(ii) That the County Planning Officer, in consultation with the Chairman, be authorised to amend the hours of working in respect of the waste transfer station if necessary.
(iii) That planning permission in respect of the reinstatement of disused gravel workings with inert waste at North Common Lane, Sway (72033) be refused for the reason specified in the report.
2 PROPOSED RETENTION OF MATERIALS RECOVERY FACILITY, POLES LANE, OTTERBOURNE (W00965/07)
Messrs Garrett, Bowlie and Collis made deputations on the Poles Lane application. The Committee then considered the report (Item 5 in the Minute Book) on the matter. The County Planning Officer advised that four further letters of objection had been received and the issues contained in them were addressed in the report. Councillor Mrs. Bailey, the Local Member, expressed opposition to the retention of the facility and advised of the adverse impact of lorry traffic on the village of Otterbourne. Members of the Committee expressed strong support for the removal of the materials recovery facility from the site within the next two years.
RESOLVED:
(i) That planning permission in respect of the retention of the materials recovery facility, Poles Lane, Otterbourne (W00965/07) be granted subject to the conditions specified in the report and subject to the addition of an advice note stating that the Committee would not be minded to grant a further extension of time for the facility after 31st December 2003 should such an application be made.
(ii) That a report on traffic problems in Otterbourne and the operations of the Poles Lane site be considered by the Executive Member for the Environment.
3 CLAIM FOR THE ADDITION TO THE DEFINITIVE MAP OF A BRIDLEWAY BETWEEN PYLANDS LANE AND TANHOUSE LANE IN THE PARISHES OF BURSLEDON AND BOTLEY
Mr. Tilbury made a deputation in respect of the bridleway between Pylands Lane and Tanhouse Lane. The Committee then considered the report on the matter (Item 12 in the Minute Book).
RESOLVED:
That the application from the Solent Bridleways Action Group for a map modification Order be refused.
4 APPLICATION FOR THE UPGRADING OF UPTON GREY FOOTPATH 21 AND WESTON CORBETT FOOTPATH 1 TO BYWAY OPEN TO ALL TRAFFIC
Messrs. Croll and Tilbury made deputations in respect of the proposed upgrading of Upton Grey Footpath 21 and Weston Corbett Footpath 1. The Committee then considered the report on the matter (Item 13 in the Minute Book). The Director of Arts, Countryside and Community advised that the current Local Member, Councillor Mrs. McNair-Scott and the former Local Member, Councillor Capt. Boyle, were both opposed to the application.
RESOLVED:
That an Order be made under Section 53(2) of the Wildlife and Countryside Act 1981 and submitted to the Secretary of State for the Environment, Food and Rural Affairs for confirmation or confirmed by the County Council, as appropriate, to upgrade Upton Grey Footpath No. 21 and Weston Corbett Footpath No. 1 to a Byway Open to All Traffic on the Definitive Map, as shown on the plan attached to the report of the Director of Arts, Countryside and Community.
5 DEVELOPMENT CONTROL DELEGATION ARRANGEMENTS
The Committee considered the report of the Chief Executive (Item 2 in the Minute Book) on development control delegation arrangements.
RESOLVED:
That the scheme of delegation, as set out in paragraph 2 of the report, be noted.
6 APPEAL PROCESSES
The Committee considered the report of the Chief Executive (Item 3 in the Minute Book) on appeal processes.
RESOLVED:
That the Panel of 15 Members as set out in Appendix 1 to these Minutes be appointed to deal with pension appeals, school transport appeals, staff appeals and such other appeals of a personal nature as may be required, with the Chief Executive (after consultation with the political groups) establishing panels of not less than three members when required including, where possible, at least one representative of each political group.
7 REPLACEMENT OF EXISTING LIBRARY WITH A NEW LIBRARY - VICARAGE HILL, ALTON (F30653/003/REG3)
Consideration of this matter was deferred to enable a site visit to be undertaken.
8 APPOINTMENT OF CHAIRMEN TO MINERALS AND WASTE SITE LIAISON PANELS
The Committee considered the report of the Chief Executive (Item 6 in the Minute Book) on the appointment of Chairmen to Minerals and Waste Site Liaison Panels.
RESOLVED:
That the Chairmen of the various Minerals and Waste Site Liaison Panels be as per Appendix II to these Minutes.
9 DEVELOPMENT CONTROL SCHEDULE
The Committee received the report of the County Planning Officer (Item 7 in the Minute Book) on development control decisions taken by the County Planning Officer.
RESOLVED:
That the report be noted.
10 PROPOSAL TO DIVERT FOOTPATH 20 IN THE PARISH OF BOARHUNT
The Committee considered the report of the Director of Arts, Countryside and Community (Item 8 in the Minute Book) on the proposed diversion of footpath 20.
RESOLVED:
That, in the interests of the landowners, an Order be made under Section 119 of the Highways Act 1980 and submitted to the Secretary of State for the Environment, Food and Rural Affairs for confirmation or confirmed by the County Council, as appropriate, to divert footpath 20 in the Parish of Boarhunt.
11 PROPOSAL TO DIVERT FOOTPATH 10 IN THE PARISH OF CRONDALL
The Committee considered the report of the Director of Arts, Countryside and Community (Item 9 in the Minute Book) on diversion of footpath 10.
RESOLVED:
That, in the interests of the landowners and the public, an Order be made under Section 119 of the Highways Act 1980 and submitted to the Secretary of State for the Environment, Food and Rural Affairs for confirmation or confirmed by the County Council, as appropriate, to divert footpath 10 in the Parish of Crondall.
12 PROPOSAL TO DIVERT FOOTPATHS 10 AND 11 AND TO DEDICATE A NEW FOOTPATH IN THE PARISH OF NURSLING AND ROWNHAMS
The Committee considered the report of the Director of Arts, Countryside and Community (Item 10 in the Minute Book) on the diversion of footpaths 10 and 11.
RESOLVED:
(i) That, subject to the landowners entering into an agreement under the provisions of the Local Government (Miscellaneous) Provisions Act 1982 for the future maintenance of the new diverted paths, in the interests of the landowner an Order be made under Section 119 of the Highways Act 1980 and submitted to the Secretary of State for the Environment, Food and Rural Affairs for confirmation or confirmed by the County Council, as appropriate, to divert footpaths 10 and 11 in the Parish of Nursling and Rownhams.
(ii) That the offer of a dedicated footpath by the Barker Mill Family Trust be accepted with thanks.
13 PROPOSAL TO IMPROVE THE SAFETY OF USERS OF THE TEST WAY BY THE DIVERSION OF FOOTPATH 25 AND THE DEDICATION OF A PUBLIC FOOTPATH IN THE PARISH OF LONGPARISH
The Committee considered the report of the Director of Arts, Countryside and Community (Item 11 in the Minute Book) on the Test Way.
RESOLVED:
(i) That, in the interests of public safety, an Order be made under Section 119 of the Highways Act 1980 and submitted to the Secretary of State for the Environment, Food and Rural Affairs for confirmation or confirmed by the County Council, as appropriate, to divert footpath 25 in the Parish of Longparish subject to the dedication of a public footpath from the flyover on the north side of the A303 to link in with footpath 21.
(ii) That the dedication of a footpath on the north side of the A303 be accepted with thanks.
(iii) That all costs in relation to the application and dedication be waived.
14 APPLICATION FOR A FOOTPATH IN THE PARISH OF BRAMLEY
The Committee considered the report of the Director of Arts, Countryside and Community (Item 14 in the Minute Book) on an application for a footpath in the Parish of Bramley.
RESOLVED:
That an Order be made under Section 53(2)(a) of the Wildlife and Countryside Act 1981 and submitted to the Secretary of State for the Environment, Food and Rural Affairs for confirmation or confirmed by the County Council, as appropriate, to add a footpath from the road C32 to the road U264 in the parish of Bramley on the Definitive Map and Statement, as shown on the plan attached to the report of the Director of Arts, Countryside and Community.
15 DEDICATION OF A BRIDLEWAY AND FOOTPATH ALONG THE COURSE OF THE DISMANTLED WINCHESTER TO NEWBURY RAILWAY LINE IN THE PARISH OF KINGS WORTHY
The Committee considered the report of the Director of Arts, Countryside and Community (Item 15 in the Minute Book) on the dedication of a bridleway and footpath in Kings Worthy.
RESOLVED:
That the dedication of a bridleway and footpath in the Parish of Kings Worthy by the County Council's Asset Management Committee be accepted with thanks.
