21. MINUTES
The Minutes of the Meeting of the County Council held on 18 June, 2001 were confirmed and signed by the Chairman.
22. CHAIRMAN'S COMMUNICATIONS
On behalf of the County Council the Chairman had written to Her Majesty Queen Elizabeth The Queen Mother on the occasion of her 101st birthday. He also congratulated Councillor M.L. Sheehan and his wife on the birth of their daughter, Elizabeth Louise, on 10 August, 2001. The Chairman also congratulated Honorary Alderman Mrs. Sue Bartlet, DL., on recently being awarded a Master of Arts degree from Southampton University for her studies in Medieval Culture.
The Chairman reported the impending retirements of Rosemary Dunhill, County Archivist, Paul Turner, County Librarian, and John Fulstow, Head of Regulatory Services, all after many years of dedicated service to the County Council. On behalf of the County Council, the Chairman wished them all long and happy retirements.
It was with deep regret that the Chairman reported the sudden passing of Sir John Hoddinott, C.B.E., Q.P.M., M.A. (Cantab), F.R.S.A., D.L., former Chief Constable of Hampshire on 13 August, 2001. The Chairman also reported with great sadness the recent loss of two past County Councillors, Honorary Alderman Mrs. Joan Chrismas, CBE., who represented the Aldershot East County Electoral Division from 1961 to 1974 and had contributed so much to the care of children, older people, and the disadvantaged both in Social Services and Health, and Mrs. Irene Candy, CBE., who following her election in 1981 represented the Sholing County Electoral Division for eight years and was Leader of the Labour Group on the County Council. He also reported the recent passing of former Clerk to the County Council, Major Arthur Smythe, DL., and, only the day before the meeting of the Council, had received the very sad news of the sudden passing of Lord Carnarvon who had been a tremendous friend of the County Council over many years. He had been Chairman of the County Council from 1973 to 1977 and became an Honorary Alderman in 1997.
As a mark of respect, the Council stood in silence and was led in prayer by the Reverend Dr. Derek Overfield, Chaplain to the Hampshire Fire and Rescue Authority.
23. LEADER'S REPORT
The Leader of the Council advised the Council that, in the light of the recent tragic events in the United States of America the County Council's Service of Dedication on 30 September was being combined with a Service of Remembrance, and that he had written a letter of condolence to the Government of New Hampshire with whom the County Council had an accord.
The Leader of the Council was pleased to report that the County Personnel and Training Department had been independently assessed as meeting Investors in People standards in all respects. They were the fifth department of the County Council to achieve the award. The Council was now well on the way to achieving its target of having all departments gain the award by the end of the year. The County Personnel and Training Officer's staff had put in a lot of time and effort to achieve the award whilst under pressure on a number of fronts. They had responded well. They were a credit to the County Council and the people of Hampshire and, on behalf of the County Council, the Leader had extended his sincere thanks and congratulations to them.
The Leader was also pleased to report that the County Council's Social Services Department had received first prize in the 2001 Health and Social Care Awards in the category of "Improving the Lives of People through Innovative Direct Payment Schemes". The County Council had pioneered direct payments reflecting Hampshire's commitment to empowering people to take control of their own lives. The Social Services Department had remained the front runners nationally across all user groups with over 450 people making use of direct payments in the County. The award was a fitting tribute to all those staff involved in the direct payment scheme and, on the County Council's behalf, the Leader thanked them for the excellent job they were doing.
24. QUESTIONS UNDER STANDING ORDER 20(b)(i)
Councillor Felicity Hindson, MBE., Executive Member for Social Care, answered a question from Councillor A.G. Dowden concerning the Audleys Resource Service Centre;
The Leader of the Council declared an interest in the company and answered a question from Councillor M.J. Roberts in relation to the position of County Council staff who had Additional Voluntary Contributions with Equitable Life;
Councillor K.B. Estlin, Executive Member for the Environment, answered a question from Councillor M.J. Roberts in relation to landfill sites;
Councillor Felicity Hindson, MBE., Executive Member for Social Care, answered a question from Councillor Mrs. P.G. Peskett in relation to the needs of children whose parents were addicted to drugs;
The Leader of the Council answered a question from Councillor W.J. Filer concerning Foot and Mouth Disease;
Councillor Felicity Hindson, MBE., Executive Member for Social Care, answered a question from Councillor Mrs. P.G.E. Holden-Brown in relation to residential home beds.
25. CONSTITUTIONAL ARRANGEMENTS - AMENDMENT
The Council considered the report of the Head of Corporate and Legal Services and Monitoring Officer (Item 5 in the Minute Book) recommending changes to the County Council's Constitution in response to the requirements of the Local Authorities (Functions and Responsibilities) (England) (Amendment) Regulations 2001, the main effect of which was to specify a further, more extensive list of functions which may not be the sole responsibility of the Executive. The report also proposed the establishment of a Committee to determine the terms and conditions of service for staff employed by the County Council including procedures for their dismissal;
paragraph 37 of the Regulations excluded this responsibility from Executive functions.
ORDERED :
(i) That those functions identified by an asterisk in Appendix 1 to the report of the Head of Corporate and Legal Services and Monitoring Officer, Functions 1-48, be discharged by Regulatory Committee A and that the functions not so identified be delegated to the appropriate Chief Officer or Officers with responsibility for that remit as determined by the Chief Executive, and that the Constitution be amended accordingly;
(ii) That the Council exercise those functions identified against "Council" in Appendix 1 and that the Constitution be amended accordingly;
(iii) That the power to appoint staff and to determine the terms and conditions on which they hold office, including procedures for their dismissal, be allocated to a Committee of seven senior members from all parties (4:1:1), to be known as the Employment in Hampshire County Council Committee, with the following terms of reference:
"To determine the terms and conditions of service for staff employed by Hampshire County Council, including procedures for their dismissal."
26. APPOINTMENT OF COMMITTEES
The Council considered the report of the Chief Executive (Item 6 in the Minute Book) concerning the proportionality of Committees. The report was endorsed with changes as follows which did not affect the overall position: Youth Service Panel 5 Con: 2 LD: 1 Lab, and Pension Fund Panel 6 Con: 2 LD: 1 Lab.

27. APPOINTMENTS TO OUTSIDE BODIES
ORDERED:
(i) That Councillor D.A. Kirk be appointed the County Council's Standing Deputy in the event that any of the County Council's representatives on the Local Government Association's General Assembly are unable to attend;
(ii) That Councillor M.J. Woodhall be appointed the County Council's Standing Deputy in the event that any of the County Council's representatives on the County Councils Network Council are unable to attend;
28. POLICY AND RESOURCES COMMITTEE - PART I - FINAL ACCOUNTS 2000/01
Part I of the Report of the Policy and Resources Committee, comprising a recommendation to approve the draft 2000/01 Statement of Accounts was presented by the Leader of the Council.
ORDERED:
That the Statement of Accounts 2000/01 as set out in the Appendix to the report of the Policy and Resources Committee be approved.
29. HAMPSHIRE POLICE AUTHORITY
Councillor S.A. Hayes, the nominated spokesman for the Hampshire Police Authority, introduced the report of the Authority. He made particular mention of the tragic and unexpected death on 13 August, 2001 of Sir John Hoddinott, the Chief Constable of Hampshire for 11 years until his retirement in September, 1999. Sir John had been an outstanding Police Officer who had worked tirelessly for the communities of Hampshire and the Isle of Wight and for policing generally.
Pursuant to Standing Order 20(d) Councillor Hayes answered a question from Councillor M.J. Woodhall concerning IT equipment in Police houses.
30. HAMPSHIRE FIRE AND RESCUE AUTHORITY
Councillor M.F. Cartwright, Chairman of the Hampshire Fire and Rescue Authority presented the report of the Authority. No questions had been submitted under Standing Order 20(e) concerning the discharge of its functions.
