1. Summary
1.1 The following decision is sought:
That approval be given to the continuation of arrangements for the joint exercise of functions through the Project Integra Management Board together with its Policy Review and Scrutiny Committee, further to Section 20 Local Government Act 2000.
2 Reason
2.1 On 17th July 2001, the Policy and Resources Committee gave approval to the establishment of the Project Integra Management Board, together with the Policy Review and Scrutiny Committee, on the terms and with the functions set out in the draft Constitution for the Board. The Board is a partnership between the County Council, Hampshire's district councils, the two unitary authorities, and Hampshire Waste Services Limited. The objectives of the Board include developing a long term vision for waste as a resource in Hampshire, and to increase awareness of waste as a resource and promote waste minimisation.
2.2 The legal status of the Board, and of the Policy Review and Scrutiny Committee, is as a joint committee established to further Section 101 (5) Local Government Act 1972. These arrangements are therefore affected by the Local Authorities (Executive Arrangements) (Modification of Enactments and Further Provisions) (England) Order 2001, which provides that such arrangements cease to have effect when the functions the subject of the arrangements become the responsibility of an Executive of any of the authorities. However, it is provided that this does not affect arrangements made by virtue of Section 20 of the Local Government Act 2000.
2.3 Approval is therefore sought to the continuation of the existing arrangements by virtue of Section 20 of the Local Government Act 2000.
3. Other Options considered and rejected:
The alternative course of action is not to continue with membership of the Board. However, that is not considered to be consistent with the policy objectives of the County Council.
