22. MINUTES

The Minutes of the meeting of the main Committee held on 17 October 2001 and of the B Committee held on 26 October 2001 were confirmed by the Committee and signed by the Chairman.

23. DEPUTATIONS IN RESPECT OF A PROPOSED WASTE TRANSFER STATION FOR SKIP WASTE AT FARLINGTON REDOUBT, PORTSDOWN HILL, PORTSMOUTH

Mrs Woodhams, Mr Webb of West Bedhampton Residents' Association, Mr Balch of Lift and Shift Skip Hire Limited and Mr Prior made deputations on the Farlington Redoubt application. The Committee then considered the report (Item 2A in the Minute Book) on the application. Councillors Gale, Price and Miss Wride declared non-pecuniary interests in the matter.

The County Planning Officer confirmed that the application complied with approved guidelines and with the Government's policy thrust to increase greatly the amount of recycling over the next 20 years. He recognised the traffic problems which are caused by such facilities but advised that County and District Councils address traffic matters through their transportation strategies. Whilst the site was located in the strategic gap it was a brownfield site and Havant Borough Council had already granted planning permission for activities there. The site licence issued by the Environment Agency would cover waste water aspects of the application. Priority would be given to enforcement of the planning conditions should the application be approved.

The County Surveyor advised that the accident records of the police had indicated one injury accident over a five year period up to the date of the site visit; he felt that, notwithstanding a significant increase in lorry movements which the application would generate, he could not raise objection subject to the proposed lorry routeing agreement being entered into.

Councillor Miss Wride, the local Member, raised objection on such grounds as no established need, noise, dust, drainage and loss of amenity for local residents. Members suggested that measures such as a reduction in the speed limit along Portsdown Hill Road, warning signs and improved lighting at the site entrance should be undertaken and in response the County Surveyor expressed support for the latter two measures, but stressed that there was no guarantee that a reduced speed limit could be achieved. Such a reduction could however be considered by the relevant Area Transportation Strategy Panel in conjunction with the Site Liaison Panel. In response to a point made concerning shorter hours of operation the County Planning Officer advised that he could negotiate with the applicants on this point.

RESOLVED:

    (i) That, subject to the applicants entering into a Section 106 Agreement with the County Council in respect of lorry routeing to ensure that lorries enter and leave the site via Purbrook Way, College Road and Portsdown Hill Road and to secure warning signing and improved lighting at the site access on Portsdown Hill Road, planning permission in respect of a waste transfer station for skip waste at Farlington Redoubt, Portsdown Hill, Portsmouth (01/54301/007) be granted subject to the conditions specified in the report and subject to the County Planning Officer being authorised to discuss hours of operation with the site operators and make any resultant amendment to condition 7 following consultation with the Chairman.

    (ii) That a Farlington Redoubt Liaison Panel be established, with Councillor Gale as Chairman, to guide the operations at the site.

24. DEPUTATION IN RESPECT OF CONTINUED EXTRACTION AT KIMBRIDGE FARM, MOTTISFONT LANE, ROMSEY

Mr Ritchie made a deputation on the Kimbridge Farm application. The Committee then considered the report (Item 4 in the Minute Book) on the matter. Councillor Scott declared a non-pecuniary interest in the application.

Councillor Woodhall, the local Member, praised the operations undertaken at the Kimbridge Farm site. The County Planning Officer advised that he had discussed the noise made by reversing bleepers with the operators and it was planned to raise the height of the bunds along the Dunbridge Lane boundary of the extraction site to help attenuate the noise. He was opposed to working on Saturday mornings other than for maintenance purposes.

RESOLVED:

That, subject to the applicants entering into a Section 106 Agreement with the County Council in respect of a financial contribution towards works on the A3057, planning permission in respect of the continued extraction of hoggin and sand, retention of conveyor and storage at Kimbridge Farm, Mottisfont Lane, Romsey until 31 December 2008 (TVS 05386/5) be granted subject to the conditions specified in the report.

25. WOODINGTON FARM, EAST WELLOW, NEAR ROMSEY:
(i) VARIATION OF CONDITION TO EXTEND TIME FOR TIPPING AND RESTORATION (TVS 07366/3); (ii) VARIATION OF CONDITION TO REVISE APPROVED RESTORATION SCHEME (TVS 07366/2);
(iii) CONSTRUCTION OF A SCREENING BUND AROUND POULTRY SHEDS (TVS 07437/13)


The Committee considered the report of the Chief Executive (Item 2(B) in the Minute Book) on the Woodington Farm applications. Councillor Woodhall, the Local Member, expressed support for the recommendations.

RESOLVED:

      (i) That planning permission in respect of a variation of condition to extend time for tipping and restoration (TVS 07366/3) and variation of condition to revise the approved restoration scheme (TVS 07366/2) at Woodington Farm, East Wellow, near Romsey be refused for the reasons specified in the report.

      (ii) That planning permission in respect of the construction of a screening bund around poultry sheds (TVS 07437/13) at Woodington Farm, East Wellow, near Romsey be refused for the reason specified in the report.

      (iii) That the taking of enforcement action, including the serving of enforcement notices to require the regrading and restoration of the landfill site in accordance with approved plans and the removal of the bund and the reinstatement of the site, be endorsed.

26. PROPOSED VARIATION TO CONDITION TO EXTEND THE OPERATION OF THE CONCRETE BLOCK PLANT AND RETENTION OF VEHICULAR ACCESS AND FORMATION OF A LANDSCAPE SCREEN BUND, ELLINGHAM DROVE, IBSLEY, RINGWOOD (72196 AND 73193)

The Committee considered the report of the County Planning Officer (Item 3 in the Minute Book) on Ellingham Drove.

The County Planning Officer reported the receipt of a communication from the applicants in which they requested that a condition be imposed on the permission requiring the concrete block works, hardstandings, stockpiles and materials to be removed by 31 December 2010 or the date on which local sources of aggregate cease to be available, whichever is the later, but in any case no later than 2014, with the site to be restored within a further period of a year. Councillor Mrs Banks expressed support for this proposed condition and members suggested that a condition be imposed which would ensure that only local supplies are processed at the site.

RESOLVED:

That, subject to a legal agreement to provide a community fund for the benefit of the community and environment within the Blashford Lakes area and the restriction of aggregates to those from the Avon Valley, and the procedures under the Town and Country Planning (Development Plan and Consultations) (Departures) Directions 1999 being discharged, planning permission in respect of the variation of condition to retain the concrete block plant, and retention of vehicular access and formation of a landscape screen bund at Ellingham Drove, Ibsley, Ringwood (72196 and 73193) be granted, subject to the conditions specified in the report subject to amendment of condition (1) to read:

"The concrete block works shall be removed with all ancillary hardstandings, stockpiles and materials by 31 December 2010 or the date on which local sources of aggregate - as defined on the attached plan - cease to be available, whichever is the later, but in any event no later than 31 December 2014 and the site restored in accordance with condition (4) below within one year of the date of removal."

27. CHANGE OF USE OF FORMER TIMBER YARD AND ARABLE LAND TO TOPSOIL AND CONCRETE RECYCLING SITE WITH ASSOCIATED PLANT, FACILITIES, BUND AND LANDSCAPING AT THE FORMER TIMBER YARD, BLACKMOOR FARM SITE, BLACKMOOR (F36756/CMA)

The County Planning Officer reported that this application had been withdrawn.

28. DEVELOPMENT CONTROL SCHEDULE

The Committee received the report of the County Planning Officer (Item 6 in the Minute Book) on development control decisions taken by the County Planning Officer.

RESOLVED:

That the report be noted.

29. PROPOSAL TO DIVERT FOOTPATH 5 IN THE PARISH OF OLD ALRESFORD

The Committee considered the report of the Director of Arts, Countryside and Community (Item 7 in the Minute Book) on Footpath 5 in Old Alresford. Attention was drawn to the suggestion of the Ramblers' Association that the proposed new route should be extended in an easterly direction along what they believed was the original line of the path.

RESOLVED:

That, in the interest of the landowner, an Order be made under Section 119 of the Highways Act 1980 and submitted to the Secretary of State for the Environment, Food and Rural Affairs for confirmation or confirmed by the County Council, as appropriate, to divert Footpath 5 in the Parish of Old Alresford.

30. PROPOSAL TO DIVERT FOOTPATHS 8 AND 15 IN THE PARISH OF ST MARY BOURNE

The Committee considered the report of the Director of Arts, Countryside and Community (Item 8 in the Minute Book) on footpaths in St Mary Bourne.

RESOLVED:

That, in the interest of the landowner, an Order be made under Section 119 of the Highways Act 1980 and submitted to the Secretary of State for the Environment, Food and Rural Affairs for confirmation or confirmed by the County Council, as appropriate, to divert Footpaths 8 and 15 in the Parish of St Mary Bourne.

31. PROPOSAL TO DIVERT FOOTPATH 8 IN THE PARISH OF STEVENTON AND FOOTPATH 5 IN THE PARISH OF NORTH WALTHAM

The Committee considered the report of the Director of Arts, Countryside and Community (Item 9 in the Minute Book) on footpaths in Steventon and North Waltham.

RESOLVED:

That, in the interest of the landowner, an Order be made under Section 119 of the Highways Act 1980 and submitted to the Secretary of State for the Environment, Food and Rural Affairs for confirmation or confirmed by the County Council, as appropriate, to divert Footpath 8 in the Parish of Steventon and Footpath 5 in the Parish of North Waltham to the line E-D-C on the plan attached to the report.

32. CLAIM FOR THE ADDITION TO THE DEFINITIVE MAP OF A PUBLIC FOOTPATH FROM POUND LANE TO FOOTPATH 13, AT OLD NETLEY IN THE PARISH OF HOUND

The Committee considered the report of the Director of Arts, Countryside and Community (Item 10 in the Minute Book) on the claim for an addition to the Definitive Map of a public footpath in the Parish of Hound.

RESOLVED:

That the application by Mr. Dilworth to record a public footpath from Pound Lane to Footpath 13 at Old Netley in the Parish of Hound be refused.

33. CLAIM FOR THE ADDITION TO THE DEFINITIVE MAP OF A FOOTPATH IN THE PARISH OF KINGS WORTHY

The Committee considered the report of the Director of Arts, Countryside and Community (Item 11 in the Minute Book) on an addition to the Definitive Map of a footpath in Kings Worthy.


RESOLVED:

That an Order be made under Section 53(3)(c)(i) of the Wildlife and Countryside Act 1981 and submitted to the Secretary of State for the Environment, Food and Rural Affairs for confirmation or confirmed by the County Council, as appropriate, to add a footpath to the Definitive Map in the Parish of Kings Worthy as shown by pecked lines on the plan attached to the report.

34. APPOINTMENT OF EXPLOSIVES PANEL

RESOLVED:

That the Chairman and Councillors Davidovitz, Geddes, Price and Roberts (with Councillor Coles to be a deputy for Councillor Price) be appointed to consider an application by GMK Limited for the establishment of a magazine for explosives at Concorde Way Segensworth Industrial Estate, Fareham with power to determine the matter.
