ROLE OF THE REGULATORY COMMITTEE

1. The Regulatory Committee is responsible for various functions relating to town and country planning and development control, licensing and registration, rights of way and appeals. These are functions which may not be exercised by the Cabinet.

2. As regards development control the Committee determines planning applications in cases, inter alia, where the decision would be contrary to the Development Plan, where the Chairman or Vice-Chairman or the local Member has asked that the decision be made by the Committee and where the County Planning Officer considers it appropriate that the Committee determine the matter. In all cases the local County Councillor is consulted. Major applications determined so far have included reinstatement of disused gravel workings with inert waste at North Common Lane, Sway, extraction of sand and gravel with restoration back to agricultural land at the Triangle site near Romsey and a waste recycling station at Yokesford Hill industrial estate at Romsey.

3. As regards rights of way, the Committee has assumed the role of the former Rights of Way Panel in that it determines proposals to divert footpaths, claims for additions to the Definitive Map, and claims for the upgrading of footpaths to byways open to all traffic. The Committee is also responsible for licensing under the Safety of Sports Grounds legislation.

4. The Committee deals with several appeal processes of a personal nature, mainly those relating to pensions, school transport entitlement, staff and various social services matters. Members of the Hampshire Pension Fund may appeal who are aggrieved by their settlement and parents may appeal where school transport for their children has been refused. Staff may appeal against dismissal and in the case of Social Service appeals individuals may make representations concerning such matters as the registration or deregistration of registered homes and child-minders. 15 members have been appointed as Regulatory Committee B from which smaller panels will be chosen to determine appeals.
