1. On 13 November 2001 the Executive Member for Environment considered the attached report and approved the following decisions, subject to no objection being made by this Committee:
"1. That, under Section 10 of the Southampton Harbour Act 1924 and Section 48 of the Southampton Harbour Act 1949, consent be granted to Hamble Yacht Services to replace an existing jetty, as indicated on the attached site plan, subject to the following conditions as specified by the Harbour Master, that:
(i) the pontoon and other materials used are similar to and in keeping with those forming other such facilities in the adjacent area of the river;
(ii) all costs associated with completing the work covered by this consent are borne by Hamble Yacht Services;
(iii) Hamble Yacht Services obtains consent from the Crown Estate and meets the costs of any additional rent;
(iv) subsequent to the work, the pontoon and access ramps be kept in good repair, to the satisfaction of the Harbour Master; and
(v) this consent shall be considered null and void if the work involved is not implemented in full within two years.
2. That Eastleigh Borough Council, the Department for Transport, Local Government and the Regions (Ports Division), the Environment Agency, Trinity House and the Crown Estate be informed."
2. These decisions require ratification by this Committee and Members are therefore asked for approval.
Recommendation
That the above decisions by the Executive Member for Environment be approved.

1. Summary
1.1 The following decisions are sought, subject to there being no objection made by the River Hamble Harbour Management Committee:
1. 2. Reasons
2.1 Many of the smaller boat yards and marinas on the river have an aura of neglect and now require investment in infrastructure to meet the new standards for sustainable management and viability.
2.2 These proposals are the first phase of a programme of investment at Hamble Yacht Services.
2.3 The proposals have been previously submitted and then withdrawn pending a definitive policy for the future development of the river moorings. The structure of the existing jetty is now unsound with considerable corrosion noted in supporting piles.
2.4 The replacement of an existing jetty is now considered urgent for reasons of health and safety.
2.5 The proposed decision is subject to no objection being made by the River Hamble Harbour Management Committee in order to ensure that the views of the Committee are taken into account.
3. Other Options Considered and Rejected
3.1 These proposals have been developed in full consultation with the relevant consenting agencies. Copies of their approvals, received to date, are attached to this report.
4. Conflicts of Interest Declared by the Decision Maker or a Member or Officer consulted
4.1 Councillor K B Estlin has disclosed a personal non-pecuniary interest as a mooring holder. This is not considered to be a clear and substantial interest, in which case he is able to make the decision in this matter.
5. Dispensation granted by the Standards Committee - Not applicable.

7. Proposals
7.1 There are two proposals submitted for consent.
Jetty
7.2 The application is to remove 30 metres of the existing 45 metre jetty and extract 10 steel piles. The remaining 15 metres of the jetty will then join to a new access bridge. The existing pontoons will be relocated to join at the lower edge of the new access bridge and be located by four steel piles.
7.3 It is proposed to reuse as many of the existing piles as possible. Although the existing piles are showing considerable corrosion above the river bed, the portion of the piles hidden by the river bed is likely to be in good condition and able to be reused for this purpose. If this is not possible, new steel piles will be used. Drawings are attached.
Slipway
7.4 The redundant slipway has not been used for many years. It is proposed to close off the front (24 metres in width) with sheet piling, concrete cap and tie bar, to match the existing dock edge detail. The enclosed area is then to be backfilled with inert material and covered with a concrete deck. This new area would primarily be used for boat storage.
7.5 The sheet piling would be timber faced, together with additional matching timber facing, to be extended along the length of the existing sheet pile wall within the curtilage of Hamble Yacht Services.
8. Environmental Impact
8.1 A site meeting was held on 16 August 2001 with representatives of English Nature and the Environment Agency to discuss the proposals. Various options were discussed and this reflects the conclusions and recommendations of that meeting.
8.2 As it is unlikely that the proposals will have an adverse effect on the adjacent Special Protection Area, Ramsar site, candidate Special Area of Conservation or Site of Special Scientific Interest, an appropriate assessment is therefore not required.
8.3 The replacement of the existing jetty and filling in of the redundant slipway will not create additional berths and therefore this application does not require the allocation of additional berths. No piles will be driven, all new piles will be vibrated into the river bed.
8.4 All of the above works will be undertaken by Solent Marine Limited. Work will only take place between the period end of November to end of March to coincide with the quietest time on the river in respect of traffic movements, thus making the mobilisation of a piling barge easier.
8.5 It will be necessary to issue a temporary local Notice to Mariners for the duration of the works. The cost of this Notice to Mariners will be passed on to the applicant.
9. Conclusion
9.1 The proposals have been developed to the satisfaction of all the relevant agencies and the new jetty will create a sole access to the berths for the workforce and crews. The infilling of the slipway will remove a dangerous eyesore, creating an additional sole working area adjacent to the boat hoist.
9.2 This is the first phase of a programme of improvements and investment to this yard which should be encouraged, together with a commitment to initiate environmentally sustainable policies.
