35. MINUTES
The Minutes of the meeting of the Committee held on 28 November 2001 were confirmed by the Committee and signed by the Chairman.
36. CLAIM FOR THE ADDITION TO THE DEFINITIVE MAP OF PUBLIC FOOTPATHS ACROSS COLDEAST HOSPITAL GROUNDS AT SARISBURY GREEN IN FAREHAM BOROUGH
The Committee considered the report of the Director of Arts, Countryside and Community (Item 2 in the Minute Book) on the claim for the addition to the Definitive Map of public footpaths across Coldeast Hospital grounds. The Committee was advised that Councillor Estlin, the local Member, had expressed support for the claim and in response the Director of Arts, Countryside and Community advised that, whilst much use had been made of the paths by the public, notices had been displayed on site stating "no public access" and "private: keep out". The application, therefore, had to be refused, but it would still be possible for Fareham Borough Council to enter into an agreement with the developer of part of the site concerning the provision of paths.
RESOLVED:
(i) That the application for the addition to the Definitive Map of footpaths across Coldeast Hospital grounds be refused.
(ii) That a request be made to Fareham Borough Council that they should consider entering into an agreement with the developer to provide adequate footpaths across the site before granting full permission for the housing development.
37. RESCISSION OF THREE ORDERS MADE UNDER SECTION 54 OF THE WILDLIFE AND COUNTRYSIDE ACT 1981
The Committee considered the report of the Director of Arts, Countryside and Community (Item 3 in the Minute Book) on the rescission of three Orders made
under the Wildlife and Countryside Act 1981.
RESOLVED:
That the rescission of The Hampshire (New Forest District No. 5) (Parish of Bramshaw) Public Path Reclassification Order 1987, The Hampshire (Test Valley Borough No. 8) (Parish of Upper Clatford) Public Path Reclassification Order 1988 and The Hampshire (Basingstoke and Deane Borough No. 32) (Parish of Newtown) Public Path Reclassification Order 1992 be approved.
38. THE INFILLING OF A DISUSED CHALK PIT ON LAND TO THE REAR OF 85, CATHERINGTON LANE, HORNDEAN (F25122/11)
The Committee considered the report of the County Planning Officer (Item 4 in the Minute Book) on a disused chalk pit at Horndean. Councillor Mrs Byrom, the local Member, advised that the Parish Council were not opposed to the proposal provided that nearby trees are not adversely affected; concerns had been raised locally about possible flooding on Catherington Lane as a result of the infilling, extra traffic and tipping of spoil onto fly tipped rubbish. In response the County Planning Officer confirmed that one of the proposed conditions covered the protection of trees and that no extra traffic would be generated as spoil would be taken directly from the housing development to the pit. The Environment Agency had not raised an objection on the grounds of possible flooding and the County Planning Officer was in any case requesting authorisation to amend the relevant condition to secure a drainage requirement as part of the restoration scheme. A further condition could cover the removal of fly tipped rubbish from the pit if this was not covered by an Environment Agency site licence.
RESOLVED:
That planning permission in respect of infilling of a disused chalk pit on land to the rear of 85, Catherington Lane, Horndean (F25122/11) be granted subject to the conditions specified in the report subject to the County Planning Officer being authorised to amend the relevant conditions to secure a drainage requirement as part of the restoration scheme and to add an extra condition requiring the removal of fly tipped rubbish from the pit, if necessary, following consultation with the Chairman.
39. DEVELOPMENT CONTROL SCHEDULE
The Committee received the report of the County Planning Officer (Item 5 in the Minute Book) on development control decisions taken by the County Planning Officer.

That the report be noted.
