61. COUNCILLOR J.K. WEST
Councillor West introduced himself to the Committee as the new Chairman; he is a chartered engineer who first joined the County Council in 1962 and has been a County Councillor for 5 years.
62. MINUTES
The Minutes of the meeting of the main Committee held on 10 April 2002 and of the B Committee held on 11 April and 9 May 2002 were confirmed by the Committee and signed by the Chairman.
63. RIGHTS OF WAY TRAINING FOR MEMBERS OF THE REGULATORY COMMITTEE
The Committee considered the report of the Director of Recreation and Heritage (Item 13 in the Minute Book) on rights of way training for Members of the Regulatory Committee.
RESOLVED:
That a training event consisting of a half-day briefing on rights of way matters and a whole day tour of sites be held in July.
64. SITE VISIT IN RESPECT OF PROPOSALS AT NETLEY LANDFILL SITE (15164/022 AND 15164/023)
Mr Parker and Mrs Cam made deputations on the Netley proposals. The Committee then considered the report (Item 2 in the Minute Book) on the applications. The County Planning Officer, in responding to the deputations, acknowledged the useful points which had been made and recognised that activities had been ongoing on the site for 25 years but felt that other issues should be taken into account. Sustainable development policies require waste to be treated in a proper manner hence the application. As regards traffic concerns the A3025 is a lorry route and a study of possible works at the Hamble Lane/ Portsmouth Road junction was ongoing with funding being available. He felt that
noise problems could be addressed and was recommending that the Landfill Site Liaison Panel meet shortly to discuss concerns. Members of the Committee felt that efforts should be made to obtain further contributions towards road improvements from the applicants as this amounted to a new application although in response officers felt that this might prove difficult as a reduction in traffic levels would result from the application before the Committee although acknowledging the extension of time associated with the new development.
RESOLVED:
That, subject to the Chairman being authorised to take a decision on the outcome of discussions concerning further contributions by the applicants towards highway improvements, planning permission in respect of the proposed retention of site control facilities and the construction and use of a temporary waste transfer station (15164/022) and the installation of additional power generating equipment for the recovery of energy from landfill gas together with associated plant (15164/023) at Netley Landfill site, Grange Road, Netley be granted subject to the conditions specified in the report subject to the amendment of condition 6 in respect of 15164/022 to read "........ being carried onto the public highway by lorries leaving the site".
65. DEPUTATIONS IN RESPECT OF WINCHESTER BAR END PARK AND RIDE PHASE II
Mr Cole and Mr Weeks made deputations in respect of land at Magdalen Hill Down, Winchester which is mitigation land for that which would be lost by the construction of the Bar End Park and Ride Phase II. The Committee then considered the report (Item 9 in the Minute Book) on the matter. Councillors Price and Roberts declared a personal interest on account of knowing one of the deputees. The County Planning Officer stressed that the matter before the Committee solely related to the management of alternative grassland to compensate for Phase II of the Park and Ride scheme. He recognised the reasonable concerns that had been raised by objectors but felt that the land being proposed would be suitable for the creation of valuable chalk grassland as a result of the very detailed management plan which had been drawn up. As regards access, it was proposed to include a footpath across the site joining into the adjacent footpath network whilst provision would be made for disabled car parking and the site was accessible to public transport. He recognised that the site was not as close to residential areas of Winchester as is the proposed Park and Ride site but stressed the dramatic long range views from Magdalen Hill Down. The application had been properly advertised and all those who had originally objected to the details of the proposal had been re-consulted.
Five late letters of objection had been received which raised no new issues. In addition a solicitor's letter had been received which raised various points. In response to these points Counsel had advised that it was legitimate for the Committee to take a decision on the proposed amendments and that the condition was not out of time. The County Council had made a commitment to assess the presence of endangered species on the Bar End site before commencement of construction and more mitigation land was being put forward than was required. The High Court had already determined that the proposed details did not need to be the subject of an Environmental Impact Assessment.
RESOLVED:
(i) That the amended details pursuant to Condition 5 for the provision of alternative chalk grassland at Magdalen Hill Down in mitigation for the loss of land in connection with the Winchester Bar End Park and Ride Phase II (W03011/04 and W03011/05) be approved, subject to the substitution of a kissing gate for a stile at the eastern entrance to the mitigation land and the omission of the proposed bank on the southern edge of the site.
(ii) That minor amendments and corrections to the Management Plan to address concerns raised by interested bodies be subsequently made by the County Planning Officer.
66. DEPUTATION IN RESPECT OF THE APPLICATION TO REGISTER LAND AT CHIVERS FIELD, ROMSEY AS VILLAGE GREEN
Mr Barker made a deputation on the Chivers Field, Romsey application. The Committee then considered the report (Item 11 in the Minute Book) on the matter. Councillor Dowden declared a personal interest, being a Member of Test Valley Borough Council.
RESOLVED:
That a non-statutory public enquiry be called to consider all of the evidence available to determine the application.
67. DEPUTATION IN RESPECT OF THE APPLICATION TO REGISTER VILLAGE GREEN AT MENGHAM PARK, HAYLING ISLAND
Councillor Gale declared a prejudicial interest in the matter and withdrew from the meeting during discussion of the matter. Dr. Wright made a deputation on the Mengham Park application. The Committee then considered the report (Item 12 in the Minute Book) on the matter.
RESOLVED:
That the holding of a non-statutory public inquiry into the application to register Mengham Park as a village green be deferred pending the final determination of the Beresford case.
68. THE ENVIRONMENT ACT 1995: REVIEW OF MINERAL PLANNING PERMISSIONS, APPLICATION FOR DETERMINATION OF CONDITIONS, RABBITFIELD HILL SAND QUARRY, FRITH END, NEAR BORDON (F20310/018/CMA)
The Committee considered the report of the County Planning Officer (Item 3 in the Minute Book) on the Rabbitfield Hill Sand Quarry application.
RESOLVED:
That the conditions specified in the report shall apply to Rabbitfield Hill Sand Quarry, Frith End, Near Bordon (F20310/018/CMA).
69. CONTINUED WORK TO STABILISE CHALK PIT FACES AND CHANGE OF USE OF LAND ADJOINING COOMBE WILLOW, BRAISHFIELD HOUSE, BRAISHFIELD, NEAR ROMSEY (TVS07205/5/)
The Committee considered the report of the County Planning Officer (Item 4 in the Minute Book) on Coombe Willow, Braishfield. The County Planning Officer advised of the receipt of a late objection made on drainage grounds and in response advised that proposed condition 5 covered a drainage scheme. He further drew attention to the applicant's agreement to re-seed the highway verge opposite the site, following completion of the operation, the recommendation to the Test Valley Borough Council Planning Committee that no objection be raised and the views of the Borough Council Environmental Health Officer that no objection should be raised subject to conditions.
RESOLVED:
That planning permission in respect of continued work to stabilise chalk faces and the change of use at land adjoining Coombe Willow, Braishfield House, Braishfield, near Romsey (TVS07205/5) be granted subject to the conditions specified in the report.
70. RINGWOOD QUARRY, SNAILS LANE, BLASHFORD - (A) THE ENVIRONMENT ACT 1995: REVIEW OF MINERAL PLANNING PERMISSIONS - APPLICATION FOR DETERMINATION OF CONDITIONS (68940) (B) EXTENSION OF TIME FOR PLANT SITE (69031)
The Committee considered the report of the County Planning Officer (Item 5 in the Minute Book) on Ringwood Quarry.
RESOLVED:
(i) That, the conditions specified in the report shall apply to Ringwood Quarry, Snails Lane, Blashford, near Ringwood (68940).
(ii) That, subject to the completion of Section 106 Agreements for the provision of public footpaths, long term nature conservation management of land within the area subject to the mineral review (68940), and maintenance of Snails Lane with the exact wording being determined by the County Planning Officer in consultation with the Chairman, planning permission in respect of an extension of time for the plant site at Ringwood Quarry, Snails Lane, Blashford (69031) be granted subject to the conditions specified in the report.
71. CONSTRUCTION OF A GAS UTILISATION PLANT, COMPRISING A GAS FLARE, GAS ENGINES, ANCILLARY EQUIPMENT AND AN ACCESS/PARKING AREA AT SQUABB WOOD LANDFILL SITE, NEAR ROMSEY (TVS05746/3)
The Committee considered the report of the County Planning Officer (Item 6 in the Minute Book) on the Squabb Wood Landfill Site. The County Planning Officer reported the receipt of a letter from a lawyer representing local resident Mr McGrattan which raised inaccuracies in the details of the application, advised of the lack of confidence in the site operator and stressed that the application was contrary to local plans. In response the County Planning Officer advised that the distances in respect of proximity of houses to the application site were correct in the report; he acknowledged that the operators had been prosecuted for various breaches of condition at the site but felt that the operation of the gas turbine could be suitably controlled and pointed out that the Borough Council Environmental Health Officer had requested three additional technical conditions. The Minerals and Waste Local Plan is the appropriate policy document for consideration of the application which meets the relevant criteria.
RESOLVED:
That planning permission in respect of the construction of a gas utilisation plant, comprising a gas flare, gas engines, ancillary equipment and an access/parking area at Squabb Wood Landfill Site, near Romsey (TVS05746/3) be granted subject to the conditions specified in the report.
72. TEMPORARY OFFICE ACCOMMODATION FOR ADDITIONAL STAFF AND OFFICE EQUIPMENT, BRAMSHILL QUARRY, WELSH DRIVE, EVERSLEY (02/00410/CMA)
The Committee considered the report of the County Planning Officer (Item 7 in the Minute Book) on Bramshill Quarry.
RESOLVED:
That planning permission in respect of temporary office accommodation for additional staff and office equipment at Bramshill Quarry, Welsh Drive, Eversley (02/00410/CMA) be granted subject to the conditions specified in the report.
73. AGRICULTURAL IMPROVEMENT BY INFILLING WITH INERT WASTE AT MANOR FARM, MANOR FARM LANE, MICHELMERSH (TVS09614)
The County Planning Officer reported the application had been withdrawn and it was not required to be determined.
74. DEVELOPMENT CONTROL SCHEDULE
The Committee received the report of the County Planning Officer (Item 10 in the Minute Book) on development control decisions taken by the County Planning Officer.
