75. MINUTES

The Minutes of the meeting held on 29 May 2002 were confirmed by the Committee and signed by the Chairman.

Further to Minute 65 the County Planning Officer advised that a hearing in the High Court at the end of June had not been completed and hence it had been adjourned until 28 August 2002.

76. DEDICATION OF BRIDLEWAY RIGHTS BETWEEN OAKLANDS WAY AND NORTH ROAD IN THE PARISH OF HYTHE AND DIBDEN

The Committee considered the report of the Director of Recreation and Heritage (Item 3 in the Minute Book) on the dedication of bridleway rights between Oaklands Way and North Road in Hythe and Dibden.

RESOLVED:

That the offer from Persimmon Homes of the dedication of bridleway rights over the strips of land shown A-B and C-D on the map attached to the report be accepted with thanks.

77. DEPUTATIONS IN RESPECT OF THE PROPOSED REDEVELOPMENT OF THE FORMER GIBBS-PALMER PREMISES AT UPPER FROYLE, ALTON

Mr Marshall and Janet Weston (residents) and Mr Collis (for the applicants) made deputations in respect of the proposed recycling facility at the former Gibbs-Palmer premises in Upper Froyle. The Committee then considered the report (Item 2 in the Minute Book) on the matter with the Vice-Chairman, Councillor Mrs Devereux, in the chair, Councillor West having declared a prejudicial interest in the light of his former involvement with Project Integra. The County Planning Officer reported the recent receipt of four more letters of objection setting out views which were either addressed in the report or had been voiced by deputees. East Hampshire District Council would be considering the application on 18 July with an officer recommendation of no objection subject to conditions. He confirmed that no restriction in working hours was being proposed to allow for emergencies and that extra traffic generated on the A31 would be acceptable. Ten movements per day of bulk loaders would be generated past the Butts on the A339 at Alton which he felt was acceptable and could not reasonably generate a request to the applicants for funding to undertake improvements to the Butts situation. Noise and light pollution would be addressed by conditions whilst planting on the other side of the railway would be difficult to achieve as it would lie outside the site on land not in the control of the applicants.

RESOLVED:

    (i) That, subject to a legal agreement to provide a financial contribution to highway safety works and lorry routeing on the A31, and to no further significant issues being raised by East Hampshire District Council, planning permission in respect of the proposed materials recycling facility and waste transfer station at the former Gibbs-Palmer premises, Farnham Road, Upper Froyle, Alton (F33619/004) be granted subject to the conditions specified in the report.

    (ii) That the applicants be requested to pursue as a priority opportunities for connecting the site to the rail network and thus transferring freight away from the road network.

78. DEPUTATIONS IN RESPECT OF OWLS LODGE FARM, LONGPARISH

Mr Faulds and Mr Rowland made deputations in respect of the construction of two landforms at Owls Lodge Farm, Longparish. The Committee then considered the report (Item 5 in the Minute Book) on the matter. The County Planning Officer drew attention to an error on the plan attached to the report which showed a direct access to the site from the A303 Trunk Road. Test Valley Borough and Longparish Parish Councils had expressed support for the application. He drew attention to the strong policy presumption against such an operation.

RESOLVED:

    (i) That planning permission in respect of the construction of two landforms at Owls Lodge Farm, Longparish (TVN06331/8) be refused on the grounds that it would be contrary to Policy 39 of the Hampshire, Portsmouth and Southampton Minerals and Waste Local Plan in that there is no need in the area for landfill capacity that cannot be met by infilling of mineral workings and there are other practicable means of disposal available.

    (ii) That the applicant be invited to submit within three months a planning application to regularise landform A at Owls Lodge Farm, Longparish.

79. DEPUTATION IN RESPECT OF WORKS AT FRITH LANE LANDFILL SITE NEAR WICKHAM

Mr Arturi made a deputation on the application relating to Frith Lane landfill site near Wickham. The Committee then considered the report (Item 9 in the Minute Book) on the matter. The County Planning Officer confirmed that this was a badly performing site, but said that a refusal of the application for a further two years would result in difficulties in restoring an incomplete site; relocation of the soil storage area away from Frith Farmhouse could be considered.

RESOLVED:

That a decision on the applications in respect of Frith Lane landfill site (0201590HCM W11890/08 and 0201587HCM W11890/09) be deferred until the October meeting of the Committee to enable a site visit involving the whole Committee to be held.

80. DEPUTATIONS IN RESPECT OF THE PROVISION OF TEMPORARY ACCOMMODATION FOR THE SCHOOL LIBRARY SERVICE AT SUN HILL JUNIOR SCHOOL, ALRESFORD

Mrs Kelly-Miller and Mr and Mrs Swan made deputations on the Sun Hill Junior School proposals. The Committee then considered the report (Item 13 in the Minute Book) on the matter. It was reported that local Member, Councillor Mrs Glasspool, had advised of a failure of communication concerning the application. The County Planning Officer stated that a letter had been received from New Alresford Town Council in which the need for satisfactory landscaping had been stressed and the opinion voiced that local traffic concerns had not been properly addressed. He advised that the school was the only one who had offered a site for the Library Service following its move from its current location and that it would be a traditional sort of use for a school site.

RESOLVED:

That planning permission be granted for development by the County Council comprising the provision of temporary accommodation for the School Library Service at Sun Hill Junior School, Sun Lane, Alresford (W01218/070201355HCS) subject to the conditions specified in the report.

81. THE ENVIRONMENT ACT 1995: REVIEW OF MINERAL PLANNING PERMISSIONS - APPLICATION FOR DETERMINATION OF CONDITIONS AT RINGWOOD AND ELLINGHAM QUARRY, ELLINGHAM DROVE, BLASHFORD (00065190M)

The Committee considered the report of the County Planning Officer (Item 4 in the Minute Book) on Ringwood and Ellingham Quarry.

RESOLVED:

That, subject to legal agreements for the long term nature conservation management, including ecological/hydrological monitoring of the site, and to secure the principle of a north-south public footpath across the site, the review of mineral planning permissions at Ringwood and Ellingham Quarry, Ellingham Drove, Blashford, near Ringwood (00065190M) be approved subject to the conditions specified in the report.

82. WASTE TRANSFER FACILITY AT THE EXISTING ZEBRA WASTE SKIP DEPOT AT BROADCUT, WALLINGTON, FAREHAM (P/02/0614/CC)

The Committee considered the report of the County Planning Officer (Item 6 in the Minute Book) on the Broadcut waste skip depot. The County Planning Officer drew attention to a letter received from the agent for the applicants in which she expressed strong support for the proposed working hours in order to allow for flexibility. He also drew attention to an incorrect statement in paragraph 3.8 of the report and accordingly deleted the last two sentences of this paragraph. The applicants had made offers of £1,000 to fund bridleway improvements and an extra £1,000 towards unspecified highway works.

RESOLVED:

That, subject to a legal agreement relating to the implementation of the bridge and provision and maintenance of visibility splays, planning permission in respect of the development of a waste transfer facility at the existing Zebra Waste Skip Depot at Broadcut, Wallington, Fareham (P/02/0614/CC) be granted subject to the conditions specified in the report.

83. PROPOSED REVISED LOCATION OF ENVIRONMENTAL CONTROL COMPOUNDS, SITE MANAGEMENT FACILITIES AND INSTALLATION OF ASSOCIATED PLANT AND EQUIPMENT, SOUTHLEIGH LANDFILL SITE, EMSWORTH COMMON ROAD, HAVANT (02/67492/000)

The Committee considered the report of the County Planning Officer (Item 7 in the Minute Book) on Southleigh landfill site. The County Planning Officer advised that the Havant Borough Council Officer recommendation to the appropriate committee was that no objection be raised; it was also reported that Rowlands Castle Parish Council were not objecting.

RESOLVED:

That planning permission in respect of the revised location of environmental control compounds, site management facilities and installation of associated plant and equipment at Southleigh landfill site, Emsworth Common Road, Havant (02/67492/000) be granted subject to the conditions specified in the report.

84. ODOUR COMPLAINT AT DOWN END GREEN WASTE COMPOSTING FACILITY, DOWN END ROAD, FAREHAM

The Committee considered the report of the County Planning Officer (Item 8 in the Minute Book) on Down End Green waste composting facility.

RESOLVED:

That the report be noted and a further report be presented to the Committee in July 2003 or earlier, if considered appropriate.

85. ENFORCEMENT: GEORGE FARWELL LIMITED, WASTE TRANSFER STATION, LAND AT NORTH COMMON LANE, SWAY, NEAR LYMINGTON

The Committee considered the report of the County Planning Officer (Item 10 in the Minute Book) on North Common Lane, Sway. The County Planning Officer confirmed that a hearing was to be held in October into the appeal against non-determination of the application for operation of the waste transfer station for the 12 months until 31 December 2002. In the circumstances he felt that enforcement action should be authorised but deferred to take account of the result of the hearing before taking the action. He confirmed that the enforcement action could include the issue of a stop notice if necessary.

RESOLVED:

    (i) That enforcement action, including the use of `stop' notice(s), be authorised to cease the use of land at North Common Lane, Sway as a waste transfer station and restore the site.

    (ii) That the enforcement action be deferred until 31 December 2002 or the decision on the appeal (No. APP/Q1770/A/02/1093774) against non determinations of the application to continue the use of the waste transfer station has been issued, whichever is the later.

86. APPEAL DECISION CONCERNING PROPOSED CONSTRUCTION WASTE RECYCLING, NORTH CAMP, HOLLYBUSH LANE, ALDERSHOT (00/00692/CMA)

The Committee considered the report of the County Planning Officer (Item 11 in the Minute Book) on North Camp, Aldershot and welcomed the successful outcome of the appeal.

RESOLVED:

That the report be noted.

87. MINERALS AND WASTE SITE LIAISON PANELS - TERMS OF REFERENCE

The Committee considered the report of the County Planning Officer and Chief Executive (Item 12 in the Minute Book) on Minerals and Waste Site Liaison Panels.


RESOLVED:

That the Minerals and Waste Site Liaison Panels "Terms of Reference, Constitution and Administrative Arrangements" be adopted.

88. MEMBER TRAINING - PLANNING

The Committee considered the report of the County Planning Officer (Item 14 in the Minute Book) on Member training for planning.

RESOLVED:

That the proposed training programme be agreed.

89. DEVELOPMENT CONTROL SCHEDULE

The Committee considered the report of the County Planning Officer (Item 15 in the Minute Book) on details of planning applications determined either by the County Planning Officer under delegated powers or by the Regulatory Committee. It also included a schedule of expiry dates for minerals and waste planning decisions and outstanding applications.
