1. Summary

1.1 Planning permission is sought to extend the hours allowed for delivery to the site by lorry. The site services the vessels using the port of Southampton, and the waste is transported by barge and lorry. Due to the tight turn-round schedules of the vessels, including cruise ships, this service sometimes needs to be carried out outside normal hours, and consent is sought to allow use of lorries. As exceptions there have been temporary agreements on numerous occasions in the past, which have not given rise to complaint. The recommendation is to grant consent, subject to conditions.

2. Site and Proposals

2.1 The site is located on the riverside within the Marchwood industrial estate. It is next to an aggregates wharf on one side and the site being developed for the Marchwood Energy Recovery Incinerator on the other.

2.2 Planning permission was granted for the Marine Pollution Reception and Treatment Plant in 1996, with subsequent small extensions and amendments. The planning permissions do not restrict the operating hours of the plant, nor deliveries by barge. However, conditions restrict the lorry traffic to between 0800 and 1800 hours Monday to Friday and 0800 and 1400 hours on Saturday, unless otherwise agreed by the Waste Planning Authority. Due to the timetable requirements of merchant ships and liners in the port, a number of requests have been agreed for out of hours deliveries. No complaints have been received on these occasions. The proposal is to amend the conditions of the two relevant planning permissions to allow deliveries by road tanker between 0600 and 2200 hours, and up to six deliveries per day outside these hours.

3. Development Plan

3.1 Hampshire, Portsmouth and Southampton Minerals and Waste Local Plan (Adopted December 1998) Policy 6 concerns waste proposals (see attached appendix).

4. Consultations

4.1 The County Surveyor (Development Control) raises no objection.

4.2 The Environment Agency, Southern Region, raises no objection.

4.3 Comments are awaited from the Environmental Health Officer, New Forest District Council.

4.4 Marchwood Parish Council raises objection to the extension of opening hours and impact on local traffic.

4.5 The local Member, Councillor Kendal, has been informed.

5. District Council's Comments

5.1 The comments of New Forest District Council are awaited.

6. County Planning Officer's Comments

6.1 The Marine Pollution Reception and Treatment Plant provides a necessary service for vessels using the port of Southampton. It is accepted that the facility is required outside normal working hours to meet vessels' needs concerning turn round and tides. The issue is not the operation of the facility itself, which is not subject to hours of working, but the impacts of the lorry traffic travelling to and from the facility. In the past temporary agreement has been given on numerous occasions to individual circumstances requiring extended hours, none of which have given rise to complaint.

6.2 Marchwood Parish Council's objection relates to the potential disturbance from lorry traffic. However, the route from the port to the industrial estate passes few houses and, bearing in mind the lack of complaint in the past, it is considered that there would not be unacceptable disturbance.

6.3 It is considered that the proposal is reasonable to meet operational requirements and would not give rise to unacceptable impacts. Therefore it is recommended to grant permission for extended hours.

Recommendation

That planning permission for the variation of Condition (7) of planning permission 00058884M and Condition (9) of planning permission 67922 to extend hours for delivery by lorry at Marine Pollution Reception and Treatment Plant, Marchwood Industrial Estate, Normandy Way, Marchwood (Application Nos. 75990 and 75991) be granted, subject to the following condition:

      (1) Unless otherwise agreed in writing by the Waste Planning Authority, a maximum of six deliveries by lorry shall be permitted outside the hours of 0600 and 2200 Monday to Sunday. Records of lorries entering or leaving the site between 2200 and 0600 hours shall be kept on-site for inspection by the Waste Planning Authority.

        Reason: In the interests of local amenity.

Note: All other conditions to remain in force.

APPENDIX

HAMPSHIRE, PORTSMOUTH AND SOUTHAMPTON MINERALS AND WASTE LOCAL PLAN (ADOPTED 17 DECEMBER 1998)

Policy 6

Permission will be granted for minerals and waste development provided the Mineral/Waste Planning Authority is satisfied that:

      (i) there is a clearly established need for the development (as assessed in relation to the other relevant policies of the Plan) which outweighs any adverse environmental or other impact that the development would be likely to cause; and

    (ii) the development would not be likely to give rise to an unacceptable level of adverse environmental, traffic or other impact, pollution risk or danger to public health, particularly in respect of any of the factors specified in Policy 7 and measures would be taken to ensure that any such impacts would, as far as is practicable, be minimised; and

    (iii) the proposals provide for the satisfactory working or operation and landscaping of the site and for its satisfactory restoration and landscaping at the cessation of the operations or use or at the end of the life of the facility to a condition suitable for an agreed beneficial after-use which is compatible with adjoining land uses and the planning policies for the area.

Notwithstanding any need there may be for waste disposal, permission will not normally be granted for mineral extraction with restoration by infilling with waste materials unless there is a need for the mineral to be extracted.
