100. MINUTES

The Minutes of the meeting held on 11th September 2002 were confirmed by the Committee and signed by the Chairman.

Matters arising:

    (i) Winchester Bar End Park and Ride Phase 2

      Further to Minute 91 the County Planning Officer advised that the hearing had reconvened on 27 September 2002 and that it was hoped that a judgement would be received within the next two weeks.

    (ii) Result of the Public Inquiry into the status of Sandy Lane, Bramshill

    Further to Minute 93, the Committee was advised that consideration of the objection to the modification of the Order for Sandy Lane, Bramshill was still the subject of correspondence.

    (iii) Bund at Ringwood and Ellingham Quarry

      Further to Minute 94, it was reported that English Nature had requested that the bund be removed as the resultant land form would be more beneficial for wild fowl. As a result, the County Planning Officer had suggested to the applicants that the southern 215 metres, as illustrated on drawing no. 1009m57, be removed and in the light of this major amendment, it was felt that the Committee should be requested to approve the amended scheme.

      RESOLVED:

      That the amended plans concerning application 00065190M for the retention of the bund at Ringwood and Ellingham Quarry entailing removal of the southern 215 metres of the bund, as illustrated on the original drawing no. 1009m57, be approved.

101. CHAIRMAN'S COMMUNICATIONS

The Chairman reported on the following :

A successful tour of aggregate and waste disposal sites in the Marchwood area had been undertaken on 20 September 2002.

The Standards Committee had confirmed that County Councillors may be members of both the Regulatory Committee and the Environment Policy Review Committee but the latter should avoid scrutinising specific planning applications which would be considered by the Regulatory Committee.

102. CLAIM FOR THE RECORDING OF A RIGHT OF WAY BETWEEN HUNGERFORD HILL AND SCHOOL HILL IN THE PARISH OF HYDE

The Committee considered the report of the Director of Recreation and Heritage (Item 6 in the Minute Book) on the claim for the recording of a right of way in Hyde.

RESOLVED:

That a definitive map modification order be made to record the track between Hungerford Hill and School Hill in the Parish of Hyde as a by-way open to all traffic having a minimum width of 3.0m.

103. DEPUTATIONS IN RESPECT OF THE IMPORTATION OF CONSTRUCTION AND DEMOLITION WASTES AT PILGRIMS FARM, STEPLAKE LANE, WELLOW WOOD ROAD, SHERFIELD ENGLISH (TVS09717)

Mrs Robson, Mr Andreae, Mr Scott (on behalf of the applicants), Mrs Gill and Caroline Noakes made deputations on the Pilgrims Farm application. The Committee then considered the report (Item 5B in the Minute Book) on the matter. The Chairman agreed that the item could be considered by the Committee as an urgent item in the light of the time which had been needed by officers to discuss the advice of Counsel. The County Planning Officer reported that the Test Valley Borough Council Planning Officer had advised that following the receipt of legal advice and advice from agricultural consultants, the opinion of the Borough Council now was that the works, the subject of the original application to the Borough Council, would not have been permitted by the General Permitted Development Order. That development was therefore now unauthorised and enforcement action could be taken if necessary by the Borough Council. In the light of the invalidity of any permission under the General Permitted Development Order the application before the County Council was for waste disposal. Councillor Woodhall, the local member, expressed support for the recommendation of refusal.

RESOLVED:

      (i) That planning permission in respect of the importation of construction and
      demolition waste for an agricultural improvement at Pilgrims Farm, Steplake Lane, Wellow Wood Road, Sherfield English (TVS09717) be refused for the reason specified in the report.

      (ii) That the County Planning Officer be authorised to take enforcement action with the aim of achieving restoration of the site to its original form.

104. DEPUTATION IN RESPECT OF SOIL RECYCLING AND GREEN COMPOSTING AND RECYCLING OF COMBINED SOIL AND GREEN WASTE, BLACKMOOR ESTATE, BLACKMOOR (F35283/001/CMA)

Mr Trodden made a deputation in respect of the Blackmoor Estate application. The Committee then considered the report (Item 5D in the Minute Book) on the matter. The County Planning Officer stressed the importance to the County Council of recycling and said that it is difficult to find a perfect site. He would be able to take on board a number of the points made by Mr Trodden by adjusting the proposed conditions. His research had indicated that the AONB boundary follows the boundary of the site, but even if part of the site lay within the AONB he did not feel that such a development would affect the principles of the AONB. The County Archaeologist had not raised any objection to the proposal but would aim to take a watching brief if major engineering works were carried out; a note concerning the archaeological state of the site could be attached to the planning permission. The suggestion was made that a liaison panel be established for the site and any permission granted be subject to a routeing agreement/condition.

RESOLVED:

      (i) That, subject to a legal agreement/condition covering lorry routeing, planning
      permission in respect of the proposed soil recycling and green waste composting, recycling of combined soil and green waste, associated screening equipment, facilities and landscaping at Blackmoor Estate, Blackmoor (F35283/001/CMA) be granted subject to the conditions specified in the report amended to take account of some of the points made by the deputee (these amendments to be made after consultation with the Chairman) and subject to the addition to the permission of a note requiring the County Archaeologist to be advised in advance of any major engineering works.

      (ii) That a liaison panel be established for the site with Councillor Scott as Chairman, the aim being for meetings to be held immediately following meetings of the Selborne Brickworks Liaison Panel.

105. DEPUTATION IN RESPECT OF THE VARIATION OF CONDITION (1) OF PLANNING PERMISSION BDB 51875 TO EXTEND THE TIME PERIOD FOR THE REMOVAL OF TOPSOIL AT KENNEL FARM, BEGGARWOOD LANE, BASINGSTOKE (BDB53915)

Mr Jones made a deputation on the Kennel Farm Application. The Committee then considered the report (Item 8 in the Minute Book) on the matter. The County Planning Officer recognised that the plan accompanying the report had been unhelpful in that it did not show major development which had taken place recently but he stressed that if the application was not approved, the excavated subsoil material would have to be taken to another site with greater adverse impact on the environment.

RESOLVED:

That planning permission in respect of the variation of condition (1) of planning permission BDB51875 to extend the time period for the removal of topsoil and the replacement with a layer of suitable fill and replacement of topsoil at Kennel Farm, Beggarwood Lane, Basingstoke (BDB53915) be granted subject to the conditions specified in the report.

106. DEPUTATION IN RESPECT OF ODOUR COMPLAINTS AT DOWN END GREEN WASTE COMPOSTING FACILITY, DOWN END ROAD, FAREHAM

Mr Collis made a deputation in respect of the Down End facility. The Committee then considered the report (Item 9 in the Minute Book) on the matter. The County Planning Officer advised that discussions were ongoing between the responsible bodies which deal with complaints and the Environment Agency could be asked to consider modifying the site licence to reduce the inputs into the site.

RESOLVED:

(i) That the report be noted and a further report be presented to the Committee in
March 2003 when the effectiveness of the revised working practice has been
assessed.

      (ii) That Hampshire Waste Services Limited be invited to discuss with the County
      Council the possible relocation of the green waste composting facility and alternative uses for the site.

107. DEPUTATION IN RESPECT OF THE PROPOSED USE OF LAND FOR RECYCLING OF INERT MATERIAL TO PRODUCE SOILS AND SECONDARY AGGREGATES, UNIT 4, EVERSLEY HAULAGE PARK, FLEET ROAD, EVERSLEY (02/00677/CMA)

Messrs. Todd and Eastwood made deputations in respect of the Eversley Haulage Park application. The Committee then considered the report (Item 12 in the Minute Book) on the matter.

The County Planning Officer reported that the Environment Agency and the Hart District Council Environmental Health Officer had no objection in principle. Hart District Council were to consider matter in the middle of November; the officer recommendation being for objection on the grounds of visual appearance and dust. English Nature were satisfied with the mitigation measures. He did not feel that granting of permission would prejudice an appeal against a refusal of planning permission and enforcement action taken by Hart District Council in respect of the haulage park which includes the application site.

RESOLVED:

That planning permission in respect of the proposed use of land for the recycling of inert material to produce soils and secondary aggregate, including the installation and use of crushing and screening equipment, at Unit 4, Eversley Haulage Park, Fleet Road, Eversley (02/00677/CMA) be granted subject to the conditions specified in the report.

108. PROPOSED INERT WASTE MATERIAL TRANSFER STATION, RECYCLING FACILITY AND CONSTRUCTION OF NEW VEHICULAR ACCESS, AMBERVALE FARM, PITMORE LANE, SWAY (75507)

This item (Item 5A in the Minute Book) was withdrawn from the agenda to allow further consideration to be given to the highway implications of the proposal.

109. SITE VISIT IN RESPECT OF PROPOSALS RELATING TO FRITH LANE LANDFILL SITE, NEAR WICKHAM

The Committee considered the report of the Chief Executive (Item 5C in the Minute Book) on the site visit undertaken to consider the Frith Lane landfill site applications.

RESOLVED:

That planning permission in respect of the variation of conditions (1) and (6) of planning permission W11890/07 to extend the time for waste disposal and restoration at Frith Lane landfill site, Frith Lane, near Wickham (0201590HCM W11890/08) and temporary storage of soils and restoration materials on land adjoining Frith Lane landfill site, Frith Lane, near Wickham (0201587HCM W11890/09) be granted subject to the conditions specified in the report.

110. VARIATION OF CONDITION (21) OF PLANNING PERMISSION 00052925M (IDO) TO AMEND THE SCHEME OF RESTORATION TO AGRICULTURE, INCLUDING THE IMPORTATION OF INERT WASTE AT MOUNT PLEASANT, SWAY (75970)

The Committee considered the report of The County Planning Officer (Item 7 in the Minute Book) on the Mount Pleasant application.

RESOLVED:

That, subject to a lorry agreement ensuring that all lorries are routed southwards along Pitmore Lane, planning permission in respect of the variation of planning permission 00052925M (IDO) through infilling with imported inert waste at Mount Pleasant Quarry, North Common Lane, Sway (75970) be granted subject to the conditions specified in the report.

111. CONSTRUCTION OF A NEW AGRICULTURAL LIVESTOCK COVERED YARD BUILDING (LINKED TO EXISTING BUILDINGS), CONSTRUCTION OF A NEW DETACHED AGRICULTURAL YOUNG STOCK/WORKSHOP BUILDING AT UPPER CUFAUDE FARM, BRAMLEY, BASINGSTOKE (BDB/53189)

The Committee considered the report of the County Planning Officer (Item 10 in the Minute Book) on Upper Cufaude Farm, Bramley. It was confirmed that the County Estate's Department was working with the tenant and the local member to tidy the site up.

RESOLVED:

That planning permission in respect of the construction of a new agricultural livestock covered yard building (linked to existing buildings) and construction of a new detached agricultural young stock/workshop building at Upper Cufaude Farm, Bramley, Basingstoke (BDB/53189) be granted subject to the conditions specified in the report and to an extra condition which was tabled at the meeting.

112. PROPOSED VARIATION OF CONDITION TO EXTEND HOURS FOR DELIVERY BY LORRY AT THE MARINE POLLUTION RECEPTION AND TREATMENT PLANT, MARCHWOOD INDUSTRIAL ESTATE, NORMANDY WAY, MARCHWOOD (75990 AND 75991)

The Committee considered the report of the County Planning Officer (Item 11 in the Minute Book) on the Marine Pollution Reception And Treatment Plant, at Marchwood. The County Planning Officer reported that Marchwood Parish Council were not now objecting and New Forest District Council were being recommended not to object. An objection had been received from Mr & Mrs Amy who were concerned about the impact of traffic from the site on Hythe Road; in response he advised that such traffic should not be using Hythe Road.

RESOLVED:

That planning permission in respect of the variation of condition (7) of planning permission 00058884M and condition (9) of planning permission 67922 to extend hours for delivery by lorry at the Marine Pollution Reception and Treatment Plant, Marchwood Industrial Estate, Normandy Way, Marchwood (75990 and 75991) be granted subject to the condition specified in the report and to the addition of a note requesting that increased use of barges be considered.

113. CONTINUED USE OF A TEMPORARY CLASSROOM UNIT FOR ADULT EDUCATION CLASSES, BROOKFIELD COMMUNITY SCHOOL, BROOK LANE, SARISBURY GREEN, NEAR FAREHAM (P/02/0907/CC)

Consideration of this item was deferred to enable a site visit to be undertaken by the Committee.

114. DEVELOPMENT CONTROL SCHEDULE

The Committee considered the report of the County Planning Officer (Item 14 in the Minute Book) on details of planning applications determined either by the County Planning Officer under delegated powers or by the Regulatory Committee, outstanding applications, enforcement action and other related development control matters.

RESOLVED:

      (i) That the report be noted.

      (ii) That representations be made to the Government concerning the late
      submission of applications for renewal of planning permission.

115. MINERAL SITES LIAISON PANELS

RESOLVED:

      (i) That Councillor Chapman replace Councillor Mrs Devereux as Chairman of the Chineham Energy from Waste Plant Liaison Panel.

      (ii) That Councillor Filer be appointed to represent the County Council on the Kingsley Sand Quarry Liaison Panel.
