AT A MEETING of the REGULATORY COMMITTEE of HAMPSHIRE COUNTY COUNCIL held at The Castle, Winchester on Wednesday 8 January 2003.

134. DECLARATIONS OF INTEREST
Members were mindful that, where they believed they had a personal or personal prejudicial interest in any matter to be considered at the meeting, they should normally at the time of the debate, declare their interest and, having regard to the circumstances described in paragraphs 9, 10, 11 and 12 of the County Council's Code of Conduct, consider whether to leave the meeting whilst the matter was discussed.
135. MINUTES
The Minutes of the meeting held on 27 November 2002 were confirmed by the Committee and signed by the Chairman subject to the following amendments:-
(i) Amendment of Minute 121 to read "Mr Watters and Mrs Kilner made deputations on the Chapel Farm application and Colonel de Benham-Crosswell made a deputation on the matter at a later stage in the meeting immediately prior to consideration of the report. The Committee then considered the report .........."
(ii) Amendment of the resolution in respect of Minute 124 to read "...... and to the addition of an extra condition requiring the removal of the existing temporary classroom (required during the building work)".

Winchester Bar End Park and Ride Phase 2
Further to Minute 117 it was reported that the relevant documents had been lodged with the Court of Appeal and a decision was not expected for at least 3/4 weeks.
136. CHAIRMAN'S COMMUNICATIONS
The Chairman reported on the following :
(i) Chairman's briefings in future would commence at 8.45 a.m. rather than 9.00 a.m. as previous with the aim of starting any site visits subsequent to the Chairman's briefing at a definite time.
(ii) The Committee was reminded that a tour of "mitigation" sites for the Winchester Park and Ride proposal was to be held that afternoon with a departure time of 2.00 p.m.
(iii) The special meeting of the Committee mooted for the first week in February would not now be held and any business which would have been considered at that meeting would now be on the agenda for the meeting to be held on 26 February.
137. CLAIM TO UPGRADE AND INCREASE THE RECORDED WIDTH OF FOOTPATH 11 IN THE TOWN OF TOTTON AND ELING
Mr Southgate of the Totton and Eling Historical Society, Mr Shepherd and Mr Burton, on behalf of Linden Homes (Southern) Ltd., made deputations on the Footpath 11 proposal.
The Committee then considered the report of the Director of Recreation and Heritage (Item 5 in the Minute Book) on the matter. The Director stressed that any upgrading has to be justified on highway grounds and it was the opinion of the officers that use of Footpath 11 by cyclists is sufficient to justify its designation as a Byway Open to All Traffic.
RESOLVED:
(i) That an Order be made under Section 53(2)(a) of the Wildlife and Countryside Act 1981 and submitted to the Secretary of State for the Environment, Food and Rural Affairs for confirmation or confirmed by the County Council as appropriate to upgrade Footpath 11 in Totton to a Byway Open to All Traffic between points A-B-C-D as shown on the plan attached to the report of the Director of Recreation and Heritage.
(ii) That the highway be recorded as having a width of 3.07 metres (10 feet).
(iii) That the Executive Member for Recreation and Heritage be recommended to approve the giving of notice of the County Council's intention to make and Order under Sections 1, 2 and 3 of the Road Traffic Regulation Act 1984, the effect of which will be to prohibit all motor vehicles from proceeding in that length of the route shown between points A-B-C-D, as shown on the plan attached to the report, in the event that the status of the route be confirmed as a Byway Open to All Traffic.
138. STORAGE OF WASTE MATERIAL AT BARTON FARM, ANDOVER ROAD, WINCHESTER (0202450HCM W00942/10)
The Committee considered the report of the Chief Planning Adviser to the Committee (Item 6 in the Minute Book) on the Barton Farm, Winchester proposal. The Chief Planning Adviser reported that Councillor Mrs Dickens, an adjacent local member, had not raised any objection to the proposal.
RESOLVED:
That planning permission in respect of the storage of waste material at Barton Farm, Andover Road, Winchester (0202450HCM W00942/10) be granted subject to the conditions specified in the report.
139. PROPOSED VARIATION OF CONDITIONS TO PERMIT EXTENDED WORKING HOURS AT STAR HILL WASTE TRANSFER AND RECYCLING FACILITY, HARTLEY WINTNEY (02/01456/CMA)
The Committee considered the report of the Chief Planning Adviser to the Committee (Item 7 in the Minute Book) on Star Hill Waste Transfer and Recycling Facility.
RESOLVED:
That planning permission in respect of a variation of conditions to permit extended working hours at Star Hill Waste Transfer and Recycling Facility, Hartley Wintney (02/01456/CMA) be granted subject to the conditions specified in the report.
140. PROPOSED OIL EXPLORATION BOREHOLE AT LAND OFF A272, MATTERLY FARM, ITCHEN VALLEY, NEAR WINCHESTER (0202134HCS W17981)
The Committee considered the report of the Chief Planning Adviser to the Committee (Item 8 in the Minute Book) on the Matterly Farm, Itchen Valley application. Councillor Scott declared a personal interest in the matter and left the meeting during the discussion on the application. The Chief Planning Adviser reported that the Open Spaces Society had raised objection on the grounds of it being an inappropriate development whilst the Ramblers' Association objected to the section of the haul road running adjacent to the South Downs Way.
RESOLVED:
That planning permission in respect of an oil exploration borehole at Matterly Farm, Itchen Valley (0202134HCS W17981) be granted subject to the conditions specified in the report.
141. SUBMISSION OF AN ENVIRONMENTAL MONITORING SCHEME AS REQUIRED BY CONDITION (26) OF PLANNING PERMISSION BDB44300, CHINEHAM ENERGY RECOVERY INCINERATOR, READING ROAD, CHINEHAM
The Committee considered the report of the Chief Planning Adviser to the Committee (Item 9 in the Minute Book) on the Chineham Energy Recovery Incinerator. The Chief Planning Adviser reported that Sherfield on Loddon Parish Council had made no comments on the matter. He further reported that the website which is a requirement of the pollution control consent would be in place within three months of the commissioning of the incinerator.
RESOLVED:
That, subject to further background noise monitoring and the creation and maintenance of a website for environmental information to be publicly available, the environmental monitoring scheme submitted in accordance with condition (26) of planning permission BDB44300 be approved.
142. DEVELOPMENT CONTROL SCHEDULE
The Committee considered the report of the Chief Planning Adviser to the Committee (Item 10 in the Minute Book) on details of planning applications determined either by the County Planning Officer under delegated powers or by the Regulatory Committee, outstanding applications, enforcement action and other related development control matters.
RESOLVED:
That the report be noted.
