    AT A MEETING of the REGULATORY COMMITTEE of HAMPSHIRE COUNTY COUNCIL held at The Castle, Winchester on Wednesday 9 April 2003.

    160. DECLARATIONS OF INTEREST

    Members were mindful that, where they believed they had a personal or personal prejudicial interest in any matter to be considered at the meeting, they should normally at the time of the debate, declare their interest and, having regard to the circumstances described in paragraphs 9, 10, 11 and 12 of the County Council's Code of Conduct, consider whether to leave the meeting whilst the matter was discussed.

    161. MINUTES

    The Minutes of the meeting of the Committee held on 26 February 2003 and of the Special Meeting of the Committee held on the same day were confirmed by the Committee and signed by the Chairman.

    Matters arising:

      (i) Development Control Schedule

      Further to Minute 159 the Chairman advised that he had agreed with the Chief Executive that a two month target be aimed at between details being received in the Chief Executive's Department from the Environment Department in respect of planning agreements and their despatch in draft form. He agreed to look into the timescale for the details being submitted to the Chief Executive following or in advance of a Committee decision.

      (ii) Winchester Bar End Park and Ride - Phase 2 - Mitigation Land

      Further to Minute 2 of the Special Meeting, it was reported that a "floating" hearing date of 12th/13th May 2003 had been arranged.

    162. CHAIRMAN'S COMMUNICATIONS

      (i) The Chairman welcomed new members, Councillors Bright and McIntosh, to the Committee.

      (ii) The Secretary of State had dismissed the appeal by Viridor against the refusal of permission for the Triangle, near Romsey, application.

      (iii) The Planning Delivery Grant which provides additional resources as an incentive and reward for performance may cover County Councils during 2004/05.

    163. DEPUTATIONS IN RESPECT OF THE PROPOSED EXTINGUISHMENT OF PART OF THE WIDTH OF FOOTPATH 4, EVERSLEY

    Messrs. Woolfson, Webb and Todd made deputations on the Eversley Footpath proposal. The Committee then considered the report of the Director of Recreation and Heritage (Item 5 in the Minute Book) on the matter. The Director of Recreation and Heritage advised that the Committee has to be satisfied that the width of footpath is not needed for public use before making such an order.

    RESOLVED:

      (i) That an order for the extinguishment of part of the width of footpath 4, Eversley not be made.

      (ii) That the obstruction be removed at the earliest possible opportunity and the footpath sign restored.

    164. DEPUTATIONS IN RESPECT OF THE CONTINUED PROCESSING OF SAND AND GRAVEL, MANOR FARM, TIMSBURY (TVSM00008/2)

    Mrs French and Mr Dean made deputations on the Manor Farm, Timsbury application. The Committee then considered the report of the Chief Planning Adviser to the Committee (Item 7 in the Minute Book) on the matter. The Chief Planning Adviser drew attention to the problems faced in trying to balance demand for aggregate with adverse impact of operations. He felt that the issues raised by the deputees were addressed in the report. He had been in discussions about noise on the access road and the discharge of water into the River Test and reported that the former point was still being looked into whilst the Environment Agency and English Nature did not feel that the discharge of water caused a problem for the adjacent SSSI. It was proposed that the bund on site should be extended to prevent water discharge to the west. He would examine how communication with adjacent landowners to the site might be improved and he was proposing additional conditions to deal with the extension of the bund and a monitoring regime for water.

    RESOLVED:

      (i) That planning permission in respect of the continued processing of sand and gravel and continued extraction of sand and gravel at Manor Farm, Timsbury (TVSM00008/2) be granted subject to the conditions specified in the report and to additional conditions covering the extension of the bund to prevent water discharge to the west and the imposition of a monitoring regime for the water emanating from the site

      (ii) That further consultations be undertaken with Mrs French about traffic calming on the access road.

    165. DEPUTATIONS IN RESPECT OF THE PROPOSED VARIATION OF APPROVED RESTORATION CONTOURS, FAIR OAK SANDPIT AND LANDFILL SITE, FAIR OAK (17314/007)

    Mr Phipp, on behalf of his mother Mrs Phipp, and Mr Phillips of SITA, the applicants, made deputations on the Fair Oak application. The Committee then considered the report of the Chief Planning Adviser to the Committee (Item 9 in the Minute Book) on the matter. The Chief Planning Adviser stated that knowledge about settlement of waste has increased over the years and that the application was in accordance with best practice to achieve a proper run-off from the site; a proper drainage system should prevent any problems of flooding on nearby roads.

    RESOLVED:

    That a decision on the Fair Oak Sandpit application be deferred to enable more information to be obtained about rates of settlement having sought the views of outside consultants, as necessary.

    166. DEPUTATION IN RESPECT OF THE PROVISIONS OF A HEAVY GOODS VEHICLE WORKSHOP AT WALLINGTON WASTE RECYCLING CENTRE (P/03/0173/CC)

    Mr Phillips of applicants SITA made a deputation on the Wallington application.
    The Committee then considered the report of the Chief Planning Adviser to the Committee (Item 10 in the Minute Book) on the matter. The Chief Planning Adviser stated that it was a small scale facility at a suitable location and that Fareham Borough Council were not raising objection subject to conditions; the Liaison Panel for the site was in general agreement subject to conditions.

    RESOLVED:

    That planning permission in respect of an extension to the southern elevation of the existing recycling centre to house a heavy goods vehicle workshop at Wallington Waste Recycling Centre, Military Road, Wallington (P/03/0173/CC) be granted subject to the conditions specified in the report.

167. DEPUTATION IN RESPECT OF THE RETENTION OF THE HAUL ROAD, SITING OF THE LEACHATE TANK AND REVISION OF RESTORATION TIMESCALES AT MANOR FARM, NORTH BADDESLEY (TVS05865/4)

Mr Halliwell made a deputation on the Manor Farm application. The Committee then considered the report of the Chief Planning Adviser to the Committee (Item 11 in the Minute Book) on the matter.

RESOLVED:

      (i) That planning permission in respect of the retention of the haul road, the siting of the leachate tank and revision of restoration timescales at Manor Farm, North Baddesley (TVS05865/4) be granted subject to the conditions specified in the report subject to the amendment of condition 2 by removing the words "and leachate tank" from the second line of the condition.

      (ii) That the Chief Planning Adviser look into the possibility of lowering the leachate tank into the ground and be authorised to determine this particular matter having discussed the results of his analysis with the Chairman and local Member, Councillor Dowden.

    168. CLAIM FOR THE ADDITION TO THE DEFINITIVE MAP OF FOOTPATHS AT POULNER LAKES, RINGWOOD

    The Committee considered the report of the Director of Recreation and Heritage (Item 6 in the Minute Book) on Poulner Lakes.

    RESOLVED:

      (i) That the application for a Map Modification Order be refused.

      (ii) That officers be authorised to enter into negotiations with the current landowners to secure the dedication of a public footpath between North Poulner Road and Snails Lane, on a route to be agreed, pursuant to the agreement dated 1st November 1976 between Hampshire County Council and Messrs. Phillips and Sons Limited.

    169. REINSTATEMENT OF FORMER BRICK PIT AND BRICKYARD TO AGRICULTURE USING CLEAN IMPORTED SOIL, WOODLEIGH FARM, FUNTLEY ROAD, FUNTLEY (P/03/0253/MW)

    The Committee considered the report of the Chief Planning Adviser to the Committee (Item 8 in the Minute Book) on Woodleigh Farm, Funtley. Councillor Price said he had declared a personal interest in the matter when it was being considered by Fareham Borough Council and took no part in the discussion there.

    RESOLVED:

    That planning permission in respect of the reinstatement of the former brick pit and brickyard to agriculture using clean imported soil at Woodleigh Farm, Funtley Road, Funtley (P/03/0253/MW) be granted subject to the conditions specified in the report.

    170. CHANGE OF USE FROM B1 TO COMPOSTING OF NON-TOXIC WASTE AT BROUGHTON DOWN FARM, BROUGHTON (TVS07423/2)

    The Committee considered the report of the Chief Planning Adviser to the Committee (Item 12 in the Minute Book) on Broughton Down Farm.

    RESOLVED:

    That planning permission in respect of the change of use from B1 to composting of non-toxic waste at Broughton Down Farm, Broughton (TVS07423/2) be granted subject to lorry routeing arrangements, a Section 278 agreement to secure highway improvements and the conditions specified in the report subject to an additional condition which would restrict the sale of the compost so that it is not available direct to the general public.

    171. PROPOSED WASTE TRANSFER STATION, HOME FARM, PETERSFIELD ROAD, ROPLEY (F24003/022/CMA)

    The Committee considered the report of the Chief Planning Adviser to the Committee (Item 13 in the Minute Book) on Home Farm, Ropley.

    RESOLVED:

    That planning permission in respect of a waste transfer station at Home Farm, Petersfield Road, Ropley (F24003/022/CMA) be granted subject to the conditions specified in the report.

    172. PROPOSED RELOCATION OF IVY LAKE WATER SKI CLUB FROM IVY LAKE TO ELLINGHAM LAKE, BLASHFORD (77588)

    The Committee considered the report of the Chief Planning Adviser to the Committee (Item 14 in the Minute Book) on Ivy Lake Water Ski Club. The Chief Planning Adviser stressed the need to find a balance between recreational and environmental uses of lakes created by mineral extraction. A late letter of objection about noise had been received from the resident at Ellingham Farm House a few hundred yards from the site but the Chief Planning Adviser did not feel that noise generated by the activity would be at a level significant to warrant refusal.

    RESOLVED:

    That, subject to a Section 106 agreement, entered into following discussions with the agents for the applicants and English Nature, ensuring the satisfactory restoration of the Ivy Lake site, planning permission in respect of the relocation of the Ivy Lake Water Ski Club from Ivy Lake to Ellingham Lake, Blashford (77588), be granted subject to the conditions specified in the report.

    173. ODOUR COMPLAINTS AT DOWN END GREEN WASTE COMPOSTING FACILITY, DOWN END ROAD, FAREHAM

    The Committee considered the report of the Chief Planning Adviser to the Committee (Item 15 in the Minute Book) on Down End green waste composting facility. Local Member Councillor Ellis advised that he had received complaints from Thickett residents in March which pointed out that the level of odour is related to the level of the ambient temperature; he advocated the active pursuit of alternative uses for the site.

    RESOLVED:

    That the report be noted and a further report be presented to the Committee when the effectiveness of the revised working practice trials has been assessed.

    174. NEW VEHICLE ENTRANCE AND PARKING ARRANGEMENTS AT KNIGHTWOOD PRIMARY SCHOOL, BELLFLOWER WAY, CHANDLERS FORD (TVS08347/5)

    The Committee considered the report of the Chief Planning Adviser to the Committee (Item 16 in the Minute Book) on Knightwood Primary School. Councillor Dowden declared a prejudicial interest in the matter and left the meeting before the discussion. The Chief Planning Adviser felt that the proposal did not offer a complete solution to the problems as it only covered the dropping off of pupils in the morning whilst the situation in the afternoon would remain the same. It was suggested that a ban on right turns out of Bellflower Way into Knightwood Road should be enacted and the Highways Officer agreed to monitor the situation whilst pointing out the problem of enforcement of such an order.

    RESOLVED:

    That planning permission be granted for development by the County Council comprising a new vehicle entrance and parking arrangements at Knightwood Primary School, Bellflower Way, Chandlers Ford (TVS08347/5) subject to the conditions specified in the report.

    175. DEVELOPMENT CONTROL SCHEDULE

    The Committee considered the report of the Chief Planning Adviser to the Committee (Item 17 in the Minute Book) on details of planning applications determined either by the Chief Planning Adviser under delegated powers or by the Regulatory Committee, outstanding applications, enforcement action and other related development control matters. The Chief Planning Adviser apologised for the lack of details as to the dates when draft agreements were submitted to applicants this being due to staffing issues over the last month; it was pointed out that the agreement in respect of the former Gibbs-Palmer premises at Upper Froyle had been completed.

    RESOLVED:

    That the report be noted.
