190. DECLARATIONS OF INTEREST
Members were mindful that, where they believed they had a personal or personal prejudicial interest in any matter to be considered at the meeting, they should normally at the time of the debate, declare their interest and, having regard to the circumstances described in paragraphs 9, 10, 11 and 12 of the County Council's Code of Conduct, consider whether to leave the meeting whilst the matter was discussed.
191. MINUTES
The Minutes of the meeting of the Committee held on 28 May 2003 were confirmed by the Committee and signed by the Chairman.
Matter arising:
Saxon Wood School, Basingstoke
Further to Minute 182 the Chief Planning Adviser reported that the Basingstoke Highway Management Advisory Panel rather than the Basingstoke Environmental Strategy Transport Panel will be requested to look into the traffic impact of Saxon Wood School.
192. CHAIRMAN'S COMMUNICATIONS
(i) The Chairman reported that an excellent tour had been undertaken by Members of the Committee on the 8 July.
(ii) Members were reminded that the rights of way tour will be on Friday 5 September and the minerals sites tour on Monday 15 September instead of 19 September; three site visits were to be undertaken on Thursday 28 August.
(iii) Under revised Cabinet arrangements Councillor Glen would be taking an interest in minerals and waste planning.
(iv) The appeals in respect of Ambervale Farm, Sway and North Common Lane, Sway would be heard on 5th, 6th and 7th November 2003.
193. DEPUTATION IN RESPECT OF APPLICATIONS AT VENTHAMS FARM, FROXFIELD GREEN
Mr Toomer made a deputation on the three Venthams Farm applications. The Committee then considered the report of the Chief Executive and the Chief Planning Adviser (Item 5A in the Minute Book) on the matter. The Chief Planning Adviser confirmed the poor junction of Bordean Lane with the A272 and drew attention to the need to use the material currently lying on an unauthorised basis on the land the subject of the recycling application. The Highways Adviser confirmed that there is a County Council chippings store on Staple Ash Lane which has been there for some 25 years and which is used on a very infrequent basis.
RESOLVED:
(i) That planning permission in respect of the recycling of construction and demolition waste for agricultural improvement work on the farm at Venthams Farm, Froxfield Green (F20619/013/CMA) be refused for the reasons specified in the report.
(ii) That appropriate enforcement action be taken to restore the site the subject of application F20619/013/CMA to its former condition.
(iii) That planning permission in respect of the upgrading of farm tracks to attain a suitable surface for farm vehicles at Venthams Farm, Froxfield Green (F20619/011/CMA) be granted subject to the conditions specified in the report subject to the amendment of condition 6 to reflect the need for material to be transported across the highway.
(iv) That planning permission in respect of the infilling of old pits for restoration and replanting for habitat at Venthams Farm, Froxfield Green (F20619/012/CMA) be granted subject to the conditions specified in the report subject to the amendment of condition 9 to reflect the need for material to be transported across the highway.
Councillor Bright voted against all three applications on policy grounds.
194. DEPUTATIONS IN RESPECT OF APPLICATIONS RELATING TO UNITS D AND E AT PEGHAM INDUSTRIAL PARK, TITCHFIELD
Mr Scott of the Robert Long Consultancy, Mrs Munday of Neighbourhood Watch and Mrs Clarke of the British Horse Society made deputations in respect of the Pegham Industrial Park applications. The Committee then considered the report of the Chief Executive and the Chief Planning Adviser (Item 5B in the Minute Book) on the matter.
Councillors Price and Mrs Harrison stated that they had declared an interest in the applications when they were debated by the Fareham Borough Council Planning Committee and accordingly would be able to speak on the matter at the Regulatory Committee meeting. The Chief Planning Adviser reported that local member, Councillor Mrs Hindson, had raised serious concerns about adverse impact on Fontley Road and that 52 objections had been received; police records indicated one fatality along Titchfield Lane which is the northern continuation of Fontley Road. He stressed that these were difficult applications to determine in the light of the unsuitable highway but he expressed his doubts that a highway reason for refusal could be sustained at an appeal as the development would be located within an area which already has planning permission for industrial uses and an operator's licence for 70 vehicles exists for the site.
RESOLVED:
(i) That planning permission in respect of the construction of an industrial building, a weighbridge and office/mess facilities, waste recycling, storage and treatment at Units D and E, Pegham Industrial Park, Laveys Lane, Titchfield, Fareham (W00480/33 03/01240/HCM) be refused for the following reason:
The proposal is contrary to Policy 46(ii) of the Hampshire, Portsmouth and Southampton Minerals and Waste Local Plan in that the additional lorry traffic generated by the development would cause an unacceptable conflict with other highway users, and an unacceptable environmental impact for residents and businesses along Fontley Road, Segensworth Road and Mill Lane.
(ii) That planning permission in respect of the temporary change of use to allow storage of waste in skips/containers and the parking of vehicles loaded with waste in containers at Unit D, Pegham Industrial Park, Laveys Lane, Fareham (W00480/34 03/01336/HCM) be refused for the following reason:-
The proposal is contrary to Policy 46(ii) of the Hampshire, Portsmouth and Southampton Minerals and Waste Local Plan in that the additional lorry traffic generated by the development would cause an unacceptable conflict with other highway users, and an unacceptable environmental impact for residents and businesses along Fontley Road, Segensworth Road and Mill Lane.
Councillors Dowden, Luffman, Stocks and Wall and others voted against the refusal of planning permission.
195. DEPUTATION IN RESPECT OF THE RELOCATION OF THE EXISTING CONCRETE BATCHING PLANT AT RINGWOOD QUARRY
Mr Roberts read out the deputation of Mr Hall who had unfortunately been taken ill the previous night. The Committee then considered the report (Item 9 in the Minute Book) on the matter. The Chief Planning Adviser felt that the point made concerning the noise of reversing alarm systems was well made. The applicants had indicated that they were ready to accept an environmental management scheme and the approval of a reversing alarm system. The Chief Planning Adviser reported that New Forest District Council had not raised objection.
RESOLVED:
That, subject to the entering into of a legal agreement restricting the source of the imported material to the Avon Valley, planning permission in respect of the relocation of the concrete batching plant at Ringwood Quarry (77332) be
granted subject to the conditions specified in the report subject to additional conditions requiring approval for an environmental management system and reversing alarm systems.
196. DEPUTATIONS IN RESPECT OF THE PROPOSED VARIATION OF APPROVED RESTORATION CONTOURS AT FAIR OAK SANDPIT AND LANDFILL SITE
Mrs Phipp and Mrs Newton made deputations in respect of the proposed variation of approved restoration contours at Fair Oak sandpit and landfill site. The Committee then considered the report (Item 11 in the Minute Book) on the matter.
The Chief Planning Adviser reported that permission for the site was originally granted in 1989 and that new standards for such sites had been brought in since then. He agreed that the emissions from the site were an issue but the Environment Agency were the responsible authority and were addressing the problem. Members expressed strong opposition to any extension in the time permitted for tipping operations at the site.
RESOLVED:
That planning permission in respect of the proposed variation of approved restoration contours at Fair Oak sandpit and landfill site, Fair Oak (17314/007) be granted subject to the conditions specified in the report subject to the amendment of condition (1) to read "the tipping operations hereby permitted shall cease on or before 31 December 2006 .......", and to the addition of a note to the permission stating that the Committee would be unlikely to look favourably on any time extension after 31 December 2006.
197. REPLACEMENT OF LANDFILL GAS FLARE AT FAIR OAK SANDPIT AND LANDFILL SITE, FAIR OAK (17314/008)
The Committee considered the report of the Chief Planning Adviser (Item 12 in the Minute Book) on the replacement of the landfill gas flare at Fair Oak landfill site.
RESOLVED:
That planning permission in respect of the replacement of the landfill gas flare at Fair Oak sandpit and landfill site, Fair Oak (17314/008) be granted subject to the conditions specified in the report.
198. DEPUTATION IN RESPECT OF PROPOSED VARIATION OF CONDITION TO EXTEND TIME FOR CONTINUING OPERATIONS AT BORDON SANDPIT (F20310/019/CMA)
Mrs Lake made a deputation in respect of the Bordon Sandpit application. The Committee then considered the report (Item 13 in the Minute Book) on the matter. The Chief Planning Adviser reported that East Hampshire District Council and Kingsley Parish Council had raised objection to the proposal and he was requested to write to the Environment Agency and South East Water expressing concern that no comments had been received from them in respect of the application.
Councillor Filer, the local Member, expressed support for the recommendation of refusal.
RESOLVED:
That planning permission in respect of a variation of condition (4) of planning permission F20310/7 to extend the time at Bordon sandpit, Sleaford, Bordon (F20310/019/CMA) be refused for the reasons specified in the report.
199. DEPUTATION IN RESPECT OF THE CONSTRUCTION OF AN AGRICULTURAL IRRIGATION RESERVOIR ON LAND NORTH OF RIPLEY, RINGWOOD (75228)
Mr Manners made a deputation in respect of the Ripley, Ringwood application. The Committee then considered the report of the Chief Planning Adviser (Item 17 in the Minute Book) on the matter. The Chief Planning Adviser advised that the Environment Agency had been supplied with confirmation of the points raised in a letter as mentioned in paragraph 4.6 of the report.
RESOLVED:
That, subject to a legal agreement securing a financial contribution of £20,000 for transport improvements in Ringwood and to no objection being raised by the Civil Aviation Authority, planning permission in respect of the construction of an agricultural irrigation reservoir with the removal of surplus materials (minerals and soils) arising in the course of construction at land north of Ripley, Ringwood (75228) be granted subject to the conditions specified in the report.
200. DEPUTATIONS IN RESPECT OF THE APPLICATION TO REGISTER LAND AT CHIVERS FIELD, ROMSEY AS VILLAGE GREEN
Mrs Atkinson and Mr Barker made deputations in respect of the Chivers Field application. The Committee then considered the report of the Chief Executive (Item 21 in the Minute Book) on the matter. Councillor Mrs Barron declared a personal interest in the matter and left the room. The Chief Executive stressed the view of the County Council that the report of the inspector, Mr Morgan, following the four day non-statutory public local inquiry should be accepted.
RESOLVED:
That the application for registration in respect of land at Chivers Field, Romsey as village green made on 15 March 2001 by Mrs Atkinson, be refused for the reasons given in Mr Morgan's report dated 16 May 2003 as the land has not been used for lawful sport and pastimes for at least 20 years in accordance with the provisions of the 1965 Act.
201. CHANGE OF USE FROM AGRICULTURAL LAND TO OPEN STORAGE FOR SKIPS AT SOLE HILL FARM, SALISBURY ROAD, SHERFIELD ENGLISH (TVS 00121/4)
The Committee considered the report of the Chief Planning Adviser (Item 6 in the Minute Book) on Sole Hill Farm, Sherfield English. The Chief Planning Adviser reported that Councillor Woodhall had stated that he concurs with the view of Sherfield English Parish Council that, whilst raising no objections to the proposal, there should be no further growth of the site.
RESOLVED:
That planning permission in respect of the change of use from agricultural land to open storage for skips at land at Sole Hill Farm, Salisbury Road, Sherfield English (TVS 00121/4) be granted subject to the conditions specified in the report.
202. PUMPING STATION REDEVELOPMENT SCHEME, TO INCLUDE MOTOR CONTROL CENTRE KIOSK, BALANCING STORAGE TANK, VALVE CHAMBER, UNDERGROUND COMBINED SEWER OVERFLOW CHAMBER, NEW TELEMETRY, TURNING AREA/ACCESS ROAD AND ANCILLARY WORKS AT SPRING GARDENS PUMPING STATION, SPRING GARDENS, ALRESFORD (03/01082/HCS W05836/02)
The Committee considered the report of the Chief Planning Adviser (Item 7 in the Minute Book) on Spring Gardens Pumping Station, Alresford. The Chief Planning Adviser felt that the revised and more detailed scheme in respect of landscape impact mitigation was acceptable.
RESOLVED:
That planning permission in respect of the pumping station redevelopment scheme to include a motor control centre kiosk, a balancing storage tank, a valve chamber, an underground combined sewer overflow chamber, new telemetry, a turning area/access roads and ancillary works at Spring Gardens Pumping Station, Spring Gardens, Alresford (03/01082/HCS W05836/02) be granted subject to the conditions specified in the report.
203. CHANGE OF USE TO RECYCLING CENTRE FOR GREEN WASTE AT THE PEBBLES, SOUTHWICK ROAD, BOARHUNT (03/01094/HCM W06265/10)
The Committee considered the report of the Chief Planning Adviser (Item 8 in the Minute Book) on the Pebbles, Boarhunt. Members felt that permission should be granted subject to a condition requiring the achievement of acceptable sight lines. In response the Chief Planning Adviser was concerned about the adverse impact of acceptable sight lines on the immediate environment and also stressed that any condition imposed on a planning permission which involves land outside the ownership of the applicant must be reasonably likely to be secured.
RESOLVED:
That a decision on the application to change the use to a recycling centre for green waste at the Pebbles, Boarhunt be deferred to enable the applicant to resolve the inadequate sight line.
204. APPLICATION FOR DETERMINATION OF CONDITIONS UNDER THE ENVIRONMENT ACT 1995 (REVIEW OF MINERAL PLANNING PERMISSIONS) ON LAND AT BLEAK HILL QUARRY, HARBRIDGE DROVE, NEAR SOMERLEY (78402)
The Committee considered the report of the Chief Planning Adviser (Item 10 in the Minute Book) on Bleak Hill Quarry. The Chief Planning Adviser advised that New Forest District Council had raised no objection whilst no comments had been received from the Environment Agency. He tabled a consolidated set of proposed conditions, a copy of which is set out in the Minute Book.
RESOLVED:
That the planning application for the review of mineral planning permissions at Bleak Hill Quarry, Harbridge Drove, near Somerley (78402) be approved subject to the conditions set out in the tabled schedule, a copy of which is set out in the Minute Book.
205. PROPOSED VARIATION OF CONDITION TO EXTEND THE TIME PERIOD, MARCHWOOD TRANSFER STATION, BURY ROAD, MARCHWOOD (78369)
The Committee considered the report of the Chief Planning Adviser (Item 14 in the Minute Book) on Marchwood Transfer Station.
RESOLVED:
That planning permission in respect of a variation of condition of planning permission 68501 for an extension of time at Marchwood Transfer Station, Bury Road, Marchwood (78369) be granted subject to the conditions specified in the report subject to the amendment of condition 2 to clarify the timescale for the submission of the scheme for the restoration of the site.
206. PROPOSAL TO IMPORT, STOCKPILE AND SCREEN TOPSOIL AND PROVIDE SINGLE STOREY SITE OFFICE AND ANCILLARY STORAGE CONTAINERS AT THE FORMER MINISTRY OF DEFENCE OIL STORAGE DEPOT, FAWLEY POWER STATION ACCESS ROAD, FAWLEY (78225)
The Committee considered the report of the Chief Planning Adviser (Item 15 in the Minute Book) on the former Ministry of Defence Oil Storage Depot, Fawley.
RESOLVED:
That planning permission in respect of the importation, stockpiling and screening of topsoil and the provision of a single storey site office and ancillary storage containers at the former Ministry of Defence Oil Storage Depot, Fawley Power Station Access Road, Fawley (78225) be granted subject to the conditions specified in the report.
207. THE DEVELOPMENT OF LAND WITHOUT COMPLYING WITH CONDITION 4 OF PLANNING PERMISSION 75970 AND THE AMENDMENT OF THIS CONDITION TO VARY HOURS OF OPERATION FOR THE PURPOSES OF ACHIEVING RESTORATION AT MOUNT PLEASANT SAND AND GRAVEL QUARRY, NORTH COMMON LANE, SWAY (78331).
The Committee considered the report of the Chief Planning Adviser (Item 16 in the Minute Book) on Mount Pleasant Sand and Gravel Quarry, Sway. The Chief Planning Adviser reported that New Forest District Council were not raising any objection to the proposal.

208. VARIATION OF CONDITION 1 OF PLANNING PERMISSION T/APP/Q1770/A/1023184/P5 TO EXTEND THE PERIOD OF RESTORATION AT RAGLINGTON FARM LANDFILL SITE, BOTLEY ROAD, SHEDFIELD (03/01226/HCS)
The Committee considered the report of the Chief Planning Adviser (Item 18 in the Minute Book) on Raglington Farm Landfill Site, Shedfield. The Chief Planning Adviser reported the request of local Member, Councillor Mrs Hindson, that a meeting of the Liaison Panel be held in the autumn to monitor progress.
RESOLVED:
(i) That planning permission in respect of the variation of condition 1 of planning permission T/APP/Q1770/A/1023184/P5 to extend the period of restoration at Raglington Farm Landfill Site, Shedfield until 31 May 2004 (03/01226/HCS/W11763/06) be granted subject to the conditions specified in the report.
(ii) That a meeting of the Raglington Farm Landfill Site Liaison Panel be held during the autumn 2003 to monitor progress at the site.
209. EXTRACTION OF SAND AND GRAVEL WITH RESTORATION TO LOWER LAND FORM FOR PLANTATION AT LAND ABOVE WELSH DRIVE, BRAMSHILL (03/00503/CMA)

210. DEVELOPMENT CONTROL SCHEDULE

211. COMMONS REGISTRATION ACT 1965 - APPLICATION TO REGISTER LAND AT WEST DEAN, SALISBURY, WILTSHIRE AS VILLAGE GREEN
The Committee considered the report of the Chief Executive (Item 22 in the Minute Book) on land at West Dean, Salisbury.
RESOLVED:
That the application for registration of land at West Dean, Salisbury be deferred until after the judgement in the Trap Grounds case and thereafter invite further submissions from the parties for the reasons given in Mr Chapman's report dated 1 July 2003.
