AT A MEETING of the REGULATORY COMMITTEE B held at The Castle, Winchester on Thursday 6 November 2003.

1. APPOINTMENT OF CHAIRMAN

RESOLVED:

That Councillor M.S. Geddes be appointed Chairman for this meeting only.

2. DECLARATIONS OF INTEREST

Members were mindful that, where they believed they had a personal or personal prejudicial interest in any matter to be considered at the meeting, they should normally at the time of the debate, declare their interest and, having regard to the circumstances described in paragraphs 9, 10, 11 and 12 of the County Council's Code of Conduct, consider whether to leave the meeting whilst the matter was discussed.

3. DEPUTATIONS

The Committee received a deputation from Miss T. Dade, a parent of two children attending John Keble C.E. Primary School at Hursley expressing concerns about the walking route between Oliver's Battery and John Keble Primary School at Hursley (Minute No. 4 refers).

4. SCHOOL TRANSPORT APPEAL - OLIVER'S BATTERY TO JOHN KEBLE C.E. PRIMARY SCHOOL, HURSLEY

The Committee considered the report of the Director of Environment (Item 4 in the Minute Book) concerning the walking route between Oliver's Battery and John Keble C.E. Primary School at Hursley.

The Committee also received supporting representations from Councillor Mrs A.E. Bailey as local Ward Member.

The Committee paid particular attention to safety factors along the route inspected and expressed concerns about the narrow carriageway, high embankments, lack of space for pedestrians to step off the carriageway and poor sight lines.

Therefore, having carefully examined the route and weighed the arguments, the Committee concluded that the walking route was unavailable for children attending John Keble C.E. Primary School both accompanied and unaccompanied. It was considered that the route was unavailable between a point on Port Lane 800 metres south west of the junction with the track to Down Farm and the start of the 30 mile per hour speed limit in Hursley about 50 metres before the first house in Keble Close. The Committee considered that the route was available from Oliver's Battery to Down Farm.

RESOLVED:

That the appeal be allowed.
