1. Summary
This report sets out the background to and reasons for a proposal to reduce the number of representatives of both the County Council and Fareham Borough Council on the Joint Management Committee for Westbury Manor Museum, Fareham, from three to two.
2. Objective
The aim of this report is to provide the information required to enable the Executive Member for Recreation and Heritage to make a decision on the proposal.
3. Contextual Information
3.1 Joint Arrangements between the County Council and Fareham Borough Council are covered by a legal agreement between the two authorities dated 5th November 1987. That Agreement provides for the establishment of a Joint Management Committee comprising three representatives elected by each authority.
3.2 Following the introduction of Executive Arrangements under the Local Government Act 2000, the appointment of representatives to Joint Committees discharging Executive functions became subject to certain legislative restrictions. As a consequence, Fareham Borough Council's representatives were required to be members of their Executive. Due to demands on Executive Councillors, the Borough Council chose to appoint only two representatives.
3.3 The County Council has greater flexibility in respect of its appointments, as representatives may include members of the County Council who have been elected for electoral divisions wholly or partly within Fareham borough. However, in the interests of maintain equality of representation, the Executive Member for Recreation and Heritage has chosen to appoint only two representatives. These are Councillor J. V. Bryant and Councillor R. J. Ellis.
4. Issues and Options
4.1 It is now proposed to formally amend the Agreement to bring this into line with present needs and circumstances.
4.2 If the Agreement is not amended, both authorities would remain subject to a requirement to appoint three representatives. However, since the introduction of Executive Arrangements under the Local Government Act 2000, each authority has chosen to appoint only two. The option of not amending the Agreement has been rejected, therefore, as it no longer reflects modern circumstances.
5. Recommendation
That the Agreement between the County Council and Fareham Borough Council dated 5th November 1987, constituting a Joint Management Committee for Westbury Manor Museum, Fareham, be amended to reduce the number of representatives of each authority on the Committee from three to two.
