267 DECLARATIONS OF INTEREST

Members were mindful that, where they believed they had a personal or personal prejudicial interest in any matter to be considered at the meeting, they should normally at the time of the debate, declare their interest and, having regard to the circumstances described in paragraphs 9, 10, 11 and 12 of the County Council's Code of Conduct, consider whether to leave the meeting whilst the matter was discussed.

268 MINUTES

The Minutes of the meeting of the Committee held on 7 January 2004 were confirmed by the Committee and signed by the Chairman.

269 CHAIRMAN'S COMMUNICATIONS

    (i) Dalee Kaur, Solicitor to the Committee, was recovering at home following a serious traffic accident; Members concurred with the Chairman's suggestion that he convey to her their best wishes for a speedy recovery.

    (ii) Site visits prior to the March meeting of the Committee were to be undertaken as follows:-

      (i) Friday 12 March, 9.30 a.m., Testwood School, Totton; 11.00 a.m., Sole Hill Farm, Sherfield English waste transfer and recycling facility;

      (ii) Monday 15 March 10.30 a.m. Eggars School, Alton; mid-day Whitewater C. of E. Primary School, Rotherwick, Hook.

      The visits were being held on two separate days as four visits on one day would be too unpredictable.

270 PROPOSAL TO DIVERT FOOTPATH 46 IN THE PARISH OF ODIHAM

The Committee considered the report of the Director of Recreation and Heritage (Item 5 in the Minute Book) on the proposed diversion of Footpath 46 in the parish of Odiham. The Director confirmed that the Open Spaces Society had originally raised an objection but following negotiations their concerns had been met.

RESOLVED:

That an Order be made under Section 119 of the Highways Act 1980 as amended by the Wildlife and Countryside Act 1981 and submitted to the Secretary of State for the Environment, Food and Rural Affairs for confirmation or confirmed by the County Council, as appropriate, to divert Footpath 46 in the parish of Odiham in the interest of the landowner as shown on the plan attached to the report of the Director of Recreation and Heritage.

271 PROPOSAL FOR A RESOLUTION NOT TO PROCEED WITH THE HAMPSHIRE (FAREHAM BOROUGH NO. 9) (BOROUGH OF FAREHAM - PART OF THE WIDTH OF FOOTPATH NO. 84) PUBLIC PATH EXTINGUISHMENT ORDER 2003

The Committee considered the report of the Director of Recreation and Heritage (Item 6 in the Minute Book) on Footpath 84 in Fareham.

RESOLVED:

That the Hampshire (Fareham Borough No. 9) (Borough of Fareham - Part of the Width of Footpath No. 84) Public Path Extinguishment Order 2003 be not proceeded with as it is no longer expedient so to do.

272 CONSTRUCTION OF A FLOODLIT SYNTHETIC TURF PITCH (STP) AND MULTI-USE GAMES AREA (MUGA) AT COWPLAIN COMMUNITY SCHOOL, HART PLAIN AVENUE, COWPLAIN, WATERLOOVILLE (03/62148/000)

Mr Lawton, Chairman of the School Governors, Mr Simcox and Mr and Mrs Lewis made deputations in respect of the Cowplain Community School proposal. The Committee then considered the report of the Chief Planning Adviser (Item 7 in the Minute Book) on the proposal. The Chairman and Councillor Beagley declared a personal interest in the matter as they were acquainted with one of the deputees. Councillor Davidovitz declared a prejudicial interest being Chairman of the Hampshire and Isle of Wight Area Sports Board and left the room during the discussion on the item. The Chief Planning Adviser reported that an amended plan had been provided subsequent to the initial consultation exercise and all objectors had been consulted on it. The amendments covered the area between the houses on Queens Road and the pitches and also the distance between the two facilities which meant that the site was now nearer to Firs Avenue. Five extra objections had been received following the re-consultation. He confirmed that landscaping would not reduce light and noise impact and that Havant Borough Council had reiterated their objection. The impact of the lighting was shown on a plan which was displayed at the meeting and he advised that the lights would only be lowered for maintenance reasons. He drew attention to a mistake in proposed condition 3 which stated that the use should cease on Saturdays, Sundays and public holidays at 15.30 rather than the correct time of 17.30. He felt that an advice note should be included with the permission, if granted, requesting that the school management monitor anti-social behaviour and take appropriate action; he also felt a condition should be imposed requiring that a school transport plan be prepared.

The Chief Planning Adviser stressed that the crux of the issue was the balance to be achieved between community use and impact on local people; he acknowledged that the view from Queens Road properties would be altered but the landscape plan should result in a break up of the view of the new facilities; modern lights should lessen the impact of lighting on adjacent properties.

In the ensuing discussion it was suggested that the lighting columns be painted in a suitable colour to reduce their impact and in response to the suggestion that the facilities should be provided on another area of the school field, it was stressed that the Committee had to determine the application before it.

RESOLVED:

That planning permission be granted for development by the County Council comprising a floodlit synthetic turf pitch (STP) and multi-use games area (MUGA) at Cowplain Community School, Hart Plain Avenue, Cowplain, Waterlooville (03/62148/000) for the reason specified in the report and subject to the conditions specified in the report subject to the following amendments:-

    (i) Amendment of condition 3 to read "...... and 10.00 and 1730 on Saturdays, Sundays and Public Holidays ........"

    (ii) An additional condition requiring the school to prepare a school transport plan.

    (iii) Amendment of condition 12 to read "Precise details of the proposed floodlighting, including the colour of the columns, shall be submitted to and approved in writing by the Local Planning Authority before work commences on site".

    (iv) The addition of an advice note to the permission requiring the management of the school to monitor anti-social behaviour and take appropriate action and also provide appropriate toilet facilities in the vicinity of the new sports pitches.

273 NEW WASTEWATER TREATMENT WORKS AND DRAINAGE AREA TO REPLACE AN EXISTING SEPTIC TANK AND SOAKAWAYS AT PRAGNELLS COTTAGES, NORTH LANE, WEST TYTHERLEY (TVS 07592/3)

The Committee considered the report of the Chief Planning Adviser (Item 8 in the Minute Book) on a new wastewater treatment works at Pragnells Cottages, West Tytherley.

RESOLVED:

That planning permission in respect of a new wastewater treatment works and a drainage area to replace an existing septic tank and soakaways at Pragnells Cottages, North Lane, West Tytherley (TVS 07592/3) be granted permission for the reason specified in the report and subject to the conditions specified in the report.

274 TEMPORARY PERMISSION TO DRILL TWO ADDITIONAL, DIRECTIONAL EXPLORATORY/APPRAISAL WELLS INCLUDING THE TESTING, ALONG WITH THE CONTINUED TESTING OF AVINGTON B(2) EXPLORATORY WELL AT AVINGTON EXPLORATION SITE, MATTERLEY FARM, NEAR ITCHEN ABBAS, WINCHESTER (03/02907/HCM W17981/01)

The Committee considered the report of the Chief Planning Adviser (Item 9 in the Minute Book) on the Avington exploration site. Councillor Scott declared a prejudicial interest in the matter as he knows the owner of the site and left the room during the discussion. The Chief Planning Adviser reported that Winchester City Council had raised some highway matters and in response the Highways Adviser had confirmed that he had no problems with the proposal as there would be no new construction traffic and the original routeing agreement would still apply. He confirmed that the pile of chalk at the junction of the A31 and the access road to the site was still there and it was suggested that an extra condition should be imposed to require its removal.

RESOLVED:

That planning permission in respect of a temporary permission to drill two additional, directional exploratory/appraisal wells including the testing, along with the continued testing of Avington B(2) exploratory well at Avington exploration site, Matterley Farm, near Itchen Abbas, Winchester (03/02907/HCM) be granted for the reason specified in the report and subject to the conditions specified in the report subject to an additional condition requiring the removal of the pile of chalk at the junction of the A31 with the access road to the site.

275 VARIATION OF CONDITION 1 OF PLANNING PERMISSION 00056880M (EXTENSION OF THE TIME FOR COMMENCEMENT) AT HOLMSLEY GRAVEL PIT, HOLMSLEY, BRANSGORE (79851)

The Chief Planning Adviser reported that this application had been withdrawn by the applicant; he confirmed that the existing planning permission still had some time to run.

276 FIRST PERIODIC REVIEW OF MINERAL PLANNING PERMISSIONS - APPLICATION FOR DETERMINATION OF CONDITIONS AT WARREN FARM AND DOWN END QUARRIES, DOWN END ROAD, FAREHAM (P/03/0616/MW)

The Committee considered the report of the Chief Planning Adviser (Item 11 in the Minute Book) on Warren Farm and Down End quarries. The Chief Planning Adviser confirmed that the formal comments of Fareham Borough Council were still awaited but advised that the Borough Council Environmental Health Officer had made some important comments on the proposed conditions.

RESOLVED:

That planning permission in respect of the first periodic review of mineral planning permissions - application for determination of conditions at Warren Farm and Down End quarries, Down End Road, Fareham (P/03/0616/MW) be granted subject to the conditions specified in the report.

277 DEVELOPMENT CONTROL SCHEDULE

The Committee considered the report of the Chief Planning Adviser (Item 12 in the Minute Book) which provided an update on the progress of minerals and waste and County Council development applications, outstanding enforcement action, planning/enforcement appeals and notice of permissions about to expire.

RESOLVED:

That the report be noted.
