Summary

1.1

The following decision is sought:

That authority be given to the Director of Property, Business and Regulatory Services (Head of Estates Practice) to settle valid claims made under Part I Land Compensation Act 1973 where the scheme resulting in the claim is in the approved Capital Programme, has been specifically authorised by the appropriate Executive Member or has been constructed in accordance with an Agreement made under either Section 38 or Section 278 Highways Act 1980.

Reason

2.1

This decision will enable the Director of Property, Business and Regulatory Services to consider all claims made under the Land Compensation Act 1973 and enable them to be settled without reference back to the Executive member on an individual basis.

2.2

The decision supports the following Aim of the Corporate Strategy.

Aim 5 - improving services by enabling all claims submitted to the County Council under Part I Land Compensation Act 1973 to be handled expeditiously.
