1. Summary
1.1 The following decision is sought:
That approval be given for the Chief Executive to conclude appropriate legal agreements with Croudace Limited in relation to:
(i) the implementation, at no cost to the County Council, of the approved highway works at an estimated cost of £150,000;
(ii) the dedication of land for car parking at Overton Station; and
(iii) the securing of financial contributions of £180,000 in the event of planning permission for 60 dwellings and £297,000 in the event of planning permission for 99 dwellings towards the Basingstoke Environmental Strategy for Transport (now North Hampshire Transport Strategy).
2. Reason
2.1 This decision supports Aim 2 of the Corporate Strategy, Stewardship of the environment, by improving travel choice and Aim 4, Building strong and safe communities, by maintaining a safe road network and reducing accident levels.
3. Other Options Considered and Rejected
3.1 The County Council could opt not to enter into a legal agreement. This option has been rejected as it would prevent the creation of an acceptable access and deprive the County Council of a financial contribution which assists in meeting the Corporate Strategy Aims. A higher or lower level of transport contribution could have been considered; however, the terms outlined in the report have been negotiated and agreed by all parties and are based upon an existing legal agreement for the planning application site.

7. Introduction
7.1 The site occupies some 3.99 hectares abutting the eastern boundary of Overton and north of London Road, Overton, the B3400.
7.2 Outline planning permission (BDB/45984) was granted in October 2000 for the erection of 60 dwellings. On 28 February 2000 the application was considered by the former Roads and Development Sub-Committee, which raised no objection to the proposal, subject to the applicant making a contribution of £180,000 to the Basingstoke Environmental Strategy for Transport (BEST) (now North Hampshire Transport Strategy - NHTS) and dedicating land to secure car parking at Overton Station. A legal agreement was concluded to secure the financial contribution and the dedication of land for car parking.
8. Transport Proposals
8.1 In August 2003 Basingstoke and Deane Borough Council received a planning application (BDB/56347) pursuant to the above outline planning permission, which it has resolved to approve. This planning application includes the details of the access to serve the site from London Road, the B3400.
8.2 Access to the site is proposed via a right turn lane from the B3400, with pedestrian and cyclist access also being provided from Station Road via Lambs Close to the west.
8.3 Should the applicant decide to implement the planning permission for 60 dwellings, a further legal agreement would be required to enable the construction of the proposed site access from the B3400.
8.4 Also in August 2003 Basingstoke and Deane Borough Council received a full planning application (BDB/56349) for 99 dwellings on the same site, which it has resolved to approve, including the same means of access to the B3400 and Station Road as detailed in planning application BDB/56347.
8.5 The developer has agreed to dedicate the land at Overton Station for car parking, as previously agreed, and to make a financial contribution to NHTS of £297,000. This financial contribution is pro-rata the contribution agreed for the planning application for 60 dwellings and will be spent in accordance with the requirements of NHTS, Planning Policy Guidance 3, Planning Policy Guidance 13 and County Council strategies to reduce dependency on the car and provide alternative means of travel. The contribution will be put towards surfacing of the car park and the provision of pedestrian and cycle access to the station and from Station Road to Kingsclere Road.
8.6 Should the applicant decide to implement the planning permission for 99 dwellings, a legal agreement would be required to enable the construction of the proposed access to the B3400, to dedicate the land for car parking and to make a financial contribution to NHTS of £297,000. A separate legal agreement is required for this planning application as the legal agreements associated with the planning permission for 60 dwellings are relevant only to that planning permission.
9. Financial Implications
9.1 In the event of the planning permission for 60 dwellings being implemented, the applicant has already agreed to make a financial contribution to NHTS of £180,000 - to secure infrastructure to encourage alternative modes of transport within Overton.
9.2 In the event of the planning permission for 99 dwellings being implemented, the applicant has agreed to make a financial contribution to NHTS of £297,000 - to secure infrastructure to encourage alternative modes of transport within Overton.
