278 DECLARATIONS OF INTEREST

Members were mindful that, where they believed they had a personal or personal prejudicial interest in any matter to be considered at the meeting, they should normally at the time of the debate, declare their interest and, having regard to the circumstances described in paragraphs 9, 10, 11 and 12 of the County Council's Code of Conduct, consider whether to leave the meeting whilst the matter was discussed.

279 MINUTES

The Minutes of the meeting of the Committee held on 18 February 2004 were confirmed by the Committee and signed by the Chairman.

Matters arising:

    (i) Dalee Kaur

    Further to minute 269(i) the Committee was advised that Dalee Kaur, Solicitor to the Committee, was still signed off sick following the serious traffic accident.

    (ii) Sole Hill Farm, Sherfield English

    Further to minute 269(ii) the Chairman praised the manner in which the site visit to Sole Hill Farm had been conducted by all those present and the restraint shown by the villagers compared with the last site visit to the village.

280 CHAIRMAN'S COMMUNICATIONS

    (i) An apology was made to the Committee that three of the reports had been despatched a day later than the legal deadline.

    (ii) Members were urged to attend the training event on Tuesday 27 April 2004 with Trevor Roberts Associates running the event; if members could not attend the whole day it would still be useful for them to attend part of the session.

    (iii) Decisions on two recent appeals against the decision by the County Council to refuse permission - contrary to officer advice - had been received.

    The first concerned use and development of land for waste transfer at Pegham Industrial Estate, near Fareham and the appeal was dealt with by way of written representations. A highway consultant was employed to submit evidence concerning the traffic impact of the proposal and the views of local people were made known to the Inspector. Notwithstanding this, the appeal was upheld. (N.B. There is no awarding of costs for a written representation appeal).

    The second case concerned a recycling operation at Ambervale Farm, Sway, near Lymington in which planning and highway consultants were contracted, instead of County Officers, and Counsel instructed to present the evidence. A Public Local Inquiry held in Lymington Town Hall last autumn dealt with the appeal and local people had given evidence.

    The consultants and Counsel had made considerable efforts to present a strong case but nevertheless the appeal was upheld. Indeed, the Inspector felt that the County Council had acted unreasonably to a degree and awarded partial costs to the appellant. The costs along with the professional, legal and administrative fees will amount to about £100,000.

281 PROPOSAL TO DIVERT AND EXTINGUISH BRIDLEWAYS ON YATELEY COMMON, YATELEY

The Committee considered the report of the Director of Recreation and Heritage (Item 5 in the Minute Book) on the making of a Diversion Order and an Extinguishment Order to regularise the use of tracks and bridleways over Yateley Common, Yateley. The aim of the exercise was to match the rights of way crossing the Common and shown on the Definitive Map with the situation on the ground. During the debate the suggestion was made that the current speed limit along Cricket Hill Lane be re-assessed bearing in mind the horses crossing the Lane using the bridleways on the Common.

RESOLVED:

    (i) That an Order, or Orders, be made under Section 119 of the Highways Act 1980 as amended by the Wildlife and Countryside Act 1981 and submitted to the Secretary of State for the Environment, Food and Rural Affairs for confirmation or confirmed by the County Council, as appropriate, to divert bridleways 18, 19, 20, 21, 22, 25, 30, 31 and 32 on Yateley Common in the interests of the landowners, as shown on the plan attached to the report of the Director of Recreation and Heritage.

    (ii) That an Order be made under Section 118 of the Highways Act 1980 and submitted to the Secretary of State for the Environment for confirmation or confirmed by the County Council, as appropriate, to extinguish bridleway 24 on the grounds that it is no longer needed for public use.

    (iii) That the Director of Environment be requested consider the speed limits currently in force along Cricket Hill Lane together with the possible erection of signs warning of horses crossing the road.

282 PROPOSED CONSTRUCTION OF A WASTE TRANSFER AND RECYCLING STATION INCLUDING THE DEMOLITION OF EXISTING AGRICULTURAL BUILDINGS, CONSTRUCTION OF ANCILLARY OFFICES, TOILETS, WORKSHOP, DIESEL STORE, PARKING AND IMPROVEMENTS TO THE ACCESS ROAD AT LAND AT SOLE HILL FARM, SHERFIELD ENGLISH (TVS 00121/5)

283 DEPUTATIONS IN RESPECT OF THE TEMPORARY VARIATION OF THE HOURS OF WORKING FOR THE RECEIPT AND DISPOSAL OF LOCAL AUTHORITY WASTE AT SOUTHLEIGH LANDFILL SITE, HAVANT (F27242/009/CMA)

Mr Ashton and Mrs Jerome made deputations in respect of the Southleigh application. Mrs Jerome handed a petition signed by 327 people opposing the application to the Chairman. The Committee then considered the report of the Chief Planning Adviser (Item 7 in the Minute Book) on the matter. Councillor Gillett declared a personal interest being Chairman of the Southleigh Forest Landfill Site Liaison Panel as did Councillor Mrs Byrom who is also a member of the Panel. The Chief Planning Adviser stressed the responsibility of the County Council to arrange the disposal of waste and deal with waste infrastructure. He would not generally recommend weekend working but in this particular case capacity was needed to receive local authority waste from South East Hampshire between closure of the Paulsgrove Landfill site and the opening of the Portsmouth Energy Recovery Incinerator. The Chief Planning Adviser pointed out that (iii) in the proposed condition (concerning working on seven Saturdays per year preceding or following recognised public holidays) was already covered by another planning consent and suggested that it be the subject of an advice note should permission be granted. Members felt that the condition should refer to the start up of operations at the Portsmouth Energy Recovery Incinerator. It was pointed out that an incorrect plan had been attached to the report.

RESOLVED:

That planning permission in respect of the temporary variation of the hours of working for the receipt and disposal of local authority waste at Southleigh Landfill site, Havant (F27242/009/CMA) be granted for the reason specified in the report and subject to the condition specified in the report subject to the following amendment:-

      Amendment of (i) and (ii) to read "until the Portsmouth Energy Recovery Incinerator is contractually operational ......"

284 DEPUTATIONS IN RESPECT OF THE IMPORTATION OF APPROXIMATELY 9,000 CUBIC METRES OF INERT MATERIAL TO RECONTOUR THE SITE SURFACE AND IMPROVE SURFACE WATER DRAINAGE AT SLEAFORD CLOSED LANDFILL SITE, NEAR KINGSLEY, BORDON (FORMER COLDHARBOUR LANDFILL SITE) (F26788/004/CMA)

Messrs. Neville and Davey made deputations on the Sleaford application. The Committee then considered the report of the Chief Planning Adviser (Item 8 in the Minute Book) on the matter. The Chief Planning Adviser reported that Headley Parish and Whitehill Town Councils had expressed concerns whilst East Hampshire District Council had as yet not commented. The hedge alongside bridleway 501 which runs along the northern boundary of the site would be trimmed back and this would provide a roadside verge which could be used by horse-riders.

RESOLVED:

That planning permission in respect of the importation of approximately 9,000 cubic metres of inert material to recontour the site surface and improve surface water drainage at Sleaford Closed Landfill Site, near Kingsley, Bordon (former Coldharbour landfill site) (F26788/004/CMA) be granted for the reason specified in the report and subject to the conditions specified in the report.

285 DEPUTATIONS IN RESPECT OF APPLICATION A: VARIATION OF CONDITIONS 1, 2 AND 4 OF PLANNING PERMISSION TVSM00010 TO EXTEND PERIOD OF EXTRACTION AND RECYCLING AND REMOVE THE RESTRICTION ON TYPE OF IMPORTED MATERIAL AT RIDGE FARM QUARRY, RIDGE LANE, ROMSEY (TVSM00010/1)
APPLICATION B: VARIATION OF CONDITION 1 OF PLANNING PERMISSION TVS04326/12 EXTENSION OF TIME FOR TIPPING AT RIDGE FARM MINERAL SITE, RIDGE LANE, ROMSEY (TVS04326/13)


Miss Swiss of Viridor Waste Management, Mr Cole of contractors Raymond Brown and Mrs Sutton made deputations in respect of the Ridge applications. The Committee then considered the report of the Chief Planning Adviser (Item 11 in the Minute Book) on the matter. Councillor Mrs Barron declared a prejudicial interest having commented on operations at the site during the last 20 years and left the room during discussion on the item. The Chief Planning Adviser felt that it was reasonable for the applicants to be permitted to extract the remaining mineral in area 3 but felt that operations and restoration at the site should cease by 30 June 2005; if the applicants wanted a longer period they would have to submit a fresh planning application.




RESOLVED:

    (i) That planning permission in respect of the variation of conditions 1, 2 and 4 of planning permission TVSM00010 at Ridge Quarry, Ridge Lane, Ridge near Romsey (TVSM00010/1) be granted for the reason specified in the report and subject to the conditions specified in the report.

    (ii) That planning permission in respect of the variation of condition 1 of planning permission TVS 04326/12 (extension of time period) at Ridge Farm mineral site, Ridge Lane, Romsey (TVS04326/13) be granted for the reason specified in the report and subject to the conditions specified in the report.

286 DEPUTATIONS IN RESPECT OF A NEW ICT CLASSROOM BLOCK AND SPORTS HALL AND 6 NEW PARKING SPACES AT EGGARS SCHOOL, LONDON ROAD, HOLYBOURNE, ALTON (F21280/006/CMA)

Mr and Mrs Jackson made deputations in respect of the Eggars School proposals. The Committee then considered the report of the Chief Planning Adviser (Item 14 in the Minute Book) on the matter. Councillor Sir James Scott declared a prejudicial interest being the Chairman of the Eggars Site Foundation and left the room during the discussion on the item. Councillor Davidovitz declared a prejudicial interest being Chairman of the Hampshire and Isle of Wight Area Sports Board and left the room during the discussion on the item. The Chief Planning Adviser reported that all parties were in favour of the principle of the development and he understood that the design had taken on board concerns about possible flooding at the site. Should permission be granted he would wish to modify the noise condition in the light of comments received from the East Hampshire District Council Environmental Health Officer and he would also wish to seek confirmation from the school of their preferred opening hours in the light of comments made during the discussion. Councillor Ludlow, the local Member, felt that the facility was located in the wrong place and requested that alternative plans for its location be drawn up.

RESOLVED:

That planning permission be granted for development by the County Council comprising a new ICT classroom block and sports hall and six new parking spaces at Eggars School, London Road, Holybourne, Alton (F21280/006/CMA) for the reason specified in the report and subject to the conditions specified in the report subject to the following amendments:-

    (i) Amendment of condition 11, if necessary, the Chief Planning Adviser having been authorised to finalise the hours of use in consultation with the school and the Chairman of the Committee.

    (ii) Amendment of condition 12 to read "Noise from plant or machinery associated with the new sports hall/fitness centre shall not exceed 32dBLAeq 15 minutes at the boundary of any nearby residential property". Occupational noise from the new sports hall/fitness centre shall not exceed a level of 40dBLA eq 15 minutes at the boundary of any nearby residential property."

287 DEPUTATION IN RESPECT OF AN EXTENSION COMPRISING A NEW CLASSROOM, STAFF ROOM EXTENSION AND LINK CORRIDOR AT LIPHOOK INFANT SCHOOL, AVENUE CLOSE, LIPHOOK (F24373/004)

Mr Ivens, the Chairman of the Buildings and Environment Committee of the School and Mr Hope made deputations in respect of the Liphook School proposals.

The Committee then considered the report of the Chief Planning Adviser (Item 17 in the Minute Book) on the matter.

The Chief Planning Adviser drew attention to a correction to the second sentence of paragraph 5.3 of the report as follows: "The following measures must be explored before planning permission is granted ......" and the fact that 29 letters had also been received by East Hampshire District Council about the proposal. He felt that condition 5 covering the School Travel Plan should be a note to be added to the permission rather than a condition.

RESOLVED:

That planning permission be granted for development by the County Council comprising an extension comprising a new classroom, staff room extension and link corridor at Liphook Infant School, Avenue Close, Liphook (F24373/004) for the reason specified in the report and subject to the conditions specified in the report subject to the following amendment:-

Deletion of condition 5 with that condition being added to the permission as a note and being amended to read "The School Travel Plan shall be revised to consider more fundamental changes to accommodate traffic to the school in the access routes to the school in consultation with local residents, East Hampshire District Council and Bramshott and Liphook Parish Council for adoption and implemented to a programme to be agreed with the Local Planning Authority".

288 DEPUTATION IN RESPECT OF THE CONSTRUCTION OF A FLOODLIT SYNTHETIC TURF PITCH (STP) AT TESTWOOD SCHOOL, TESTWOOD LANE, TOTTON (80443)

Mr Butt made a deputation in respect of the Testwood School proposals. The Committee then considered the report of the Chief Planning Adviser (Item 15 in the Minute Book) on the matter. Councillor Davidovitz declared a prejudicial interest being Chairman of the Hampshire and Isle of Wight Area Sports Board and left the room during the discussion on the item. The Chief Planning Adviser read out a statement from Councillor Bright, the local Member, in which he raised objection and drew particular attention to the development lying within the strategic gap. He further advised that the management of the facility and behaviour of users would be a matter for the school and suggested that notes be added to the permission, if granted, covering traffic management and the preparation of a School Travel Plan. The architect for the scheme had indicated that the pitch could be moved a further six metres to the north with the additional spoil generated being used to form additional mounding at the southern end of the facility.

RESOLVED:

That planning permission be granted for development by the County Council comprising a floodlit synthetic pitch (STP) at Testwood School, Testwood Lane, Totton (80443) for the reason specified in the report and subject to the conditions specified in the report subject to the following amendments:-

    (i) Submission of revised plans showing relocation of the pitch 6 metres to the north and bunding.

    (ii) Addition of a note to the permission concerning traffic management.

    (iii) The addition of the following note: "The School Travel Plan shall be revised to consider more fundamental changes to accommodate traffic to the school in the access routes to the school in consultation with local residents, Totton Town Council and New Forest District Council for adoption and implemented to a programme to be agreed with the local planning authority."

289 REMOVAL OF CONDITION RESTRICTING INCINERATION TO MEAT AND BONE MEAL (MBM) (CONDITION 1 OF PLANNING PERMISSION 70529) AT SHANKS WTE PLANT, CHARLESTON ROAD, HARDLEY, HYTHE (80542)

The Committee considered the report of the Chief Planning Adviser (Item 9 in the Minute Book) on the Shanks WTE Plant proposal. The Chief Planning Adviser reported that Hythe and Dibden Parish Council had raised no objection; one letter had been received concerning potential noise emanating from the plant and this had been referred to the applicants. In response they had advised that a noise assessment had been carried out in July 2003 which indicated that operations at the site met the noise requirements specified in the existing permission. The Chief Planning Adviser drew attention to two corrections needed to the report namely planning permission having been granted in February 2001 rather than 2004 as stated in paragraph 1.1 and in paragraph 2.1 the nearest houses being 500 metres from the site.

RESOLVED:

That planning permission in respect of the removal of the condition restricting incineration to meat and bone meal (MBM) (condition 1 of planning permission 70529) at Shanks WTE Plant, Charleston Road, Hardley, Hythe (80542) be granted for the reason specified in the report and with an advice note stating that all other conditions of planning permission 70529 continue to apply.

290 THE DRAINING AND RAISING OF AN EXISTING FIELD TO FORM A GENTLY UNDULATING SWARD FOR FORMAL GRAZING AND PRIVATE GARDEN AT RUSHCROFT, MOUNT PLEASANT LANE, SWAY (80714)

The Committee considered the report of the Chief Planning Adviser (Item 10 in the Minute Book) on the Rushcroft proposal. The Chief Planning Adviser reported that New Forest District Council had raised objection on the grounds of the loss of existing natural undulating character of the field.

RESOLVED:

That planning permission in respect of the drainage and raising of an existing field to form a gently undulating sward for formal grazing and private garden at Rushcroft, Mount Pleasant Lane, Sway (80714) be granted permission for the reason specified in the report and subject to the conditions specified in the report.

291 COMMUNITY RECYCLING TRAINING CENTRE AT HM PRISON, ROMSEY ROAD, WINCHESTER (NOTICE OF PROPOSED DEVELOPMENT UNDER DOE CIRCULAR 18/84 (CROWN LAND)) (03/03580/GVN WGD/21/27)

The Committee considered the report of the Chief Planning Adviser (Item 12 in the Minute Book) on the Winchester Prison proposal. The Chief Planning Adviser reported that concerns about noise had been raised by local residents and Winchester City Council had objected on noise grounds; the City Council Environmental Health Officer did not have the relevant noise information as yet but felt that noise issues could be addressed.

RESOLVED:

That, subject to the Winchester City Council Environmental Health Officer being satisfied with the relevant noise report the County Council raises no objection in principle to the notice of development on Crown Land in respect of a community recycling training centre at HM Prison, Romsey Road, Winchester (03/03580/GVM) subject to the conditions specified in the report.

292 ENVIRONMENT ACT 1995: FIRST PERIODIC REVIEW OF STOCKBRIDGE OILFIELD (LARKWHISTLE FARM, HILL FARM, FOLLY FARM, CHILBOLTON DOWN, WALLERS ASH AND MICHELDEVER RAIL TERMINAL) AT LARKWHISTLE FARM WELLSITE (03/02825/HCM W10378/03) (TVN.M.00005)

The Committee considered the report of the Chief Planning Adviser (Item 13 in the Minute Book) on the determination of conditions for the Stockbridge Oilfield.

RESOLVED:

That the scheme of conditions proposed under the Environment Act 1995: First Periodic Review of Stockbridge Oilfield (Larkwhistle Farm, Hill Farm, Folly Farm, Chilbolton Down, Wallers Ash and Micheldever Rail Terminal) (03/02825/HCM) and specified in the report be approved.

293 PROPOSED SINGLE STOREY HALL AND TWO EXTERNAL CANOPIES AT WHITEWATER CHURCH OF ENGLAND PRIMARY SCHOOL, ROTHERWICK, HOOK (03/01818/HCC/RG3)

The Committee considered the report of the Chief Planning Adviser (Item 16 in the Minute Book) on Whitewater Church of England Primary School.

RESOLVED:

That planning permission be granted for development by the County Council comprising a single storey hall and two external canopies at Whitewater Church of England Primary School, Rotherwick, Hook (03/01818/HCC/RG3) for the reason specified in the report and subject to the conditions specified in the report.

294 DEVELOPMENT CONTROL SCHEDULE

The Committee considered the report of the Chief Planning Adviser (Item 18 in the Minute Book) which provided an update on the progress of minerals and waste and County Council development applications, outstanding enforcement action, planning/enforcement appeals and notice of permissions about to expire.
