Part-time pension claims - update

1. Introduction

1.1 This report updates the Panel on progress in resolving pension claims from part-time workers in the Local Government Pension Scheme since the last report presented to its meeting on 28 May 2004. An earlier report considered by the Panel on 26 November 2003 is attached at Appendix 1, which sets out the background.

1.2 Attached at Appendices 2 and 3 are updated timetables for the resolution of claims via the UK employment tribunal and those made by letter.

2. Employment tribunal claims

2.1 There were around 150 claims via the UK employment tribunal at the start of the process. 54 claims are still active. The County Treasurer has asked the tribunal to strike out six of these claims, but as yet there has been no response. 25 claims are being held in abeyance, pending the outcome of a further test case. Two claims have been identified so far as succeeding in full, and `offers of settlement' letters will be sent out shortly.

2.2 Completion of work on the claims is now expected by 31 October 2005.

3. Claims by letter

3.1 The Panel should note that, of the 507 claims made by letter, 159 active claims remain. These claims are being held in abeyance, following advice from the Local Government Pensions Committee (LGPC).

3.2 Until the LGPC issues further guidance, it is unclear when work on these claims can be concluded.
