355 DECLARATIONS OF INTEREST

Members were mindful that, where they believed they had a personal or personal prejudicial interest in any matter to be considered at the meeting, they should normally at the time of the debate declare their interest and, having regard to the circumstances described in paragraphs 9, 10, 11 and 12 of the County Council's Code of Conduct, consider whether to leave the meeting whilst the matter was discussed.

The Minutes of the meeting of the Committee held on 20 October, 2004 were confirmed by the Committee and signed by the Chairman.

357 CHAIRMAN'S COMMUNICATIONS

The Chairman reported that site visits would be held on Friday, 10 December and Monday 13 December.

358 PROPOSAL TO MAKE A DEFINITIVE MAP MODIFICATION ORDER TO RECORD A PUBLIC FOOTPATH KNOWN AS MANOR WALK IN THE BOROUGH OF RUSHMOOR

The Committee considered the report of the Director of Recreation and Heritage (Item 5 in the Minute Book) on the recording of Manor Walk, Aldershot as a public footpath.

RESOLVED:

That a Definitive Map Modification Order be made on the grounds set out in the Wildlife and Countryside Act 1981 Section 53(3)(c)(i) to record the route of Manor Walk, Aldershot as shown on the map attached to the report, having a width of 25 feet (7.6 metres).

359 CLAIM FOR THE ADDITION TO THE DEFINITIVE MAP OF A FOOTPATH BETWEEN GREAT MEAD AND GOSPORT LANE, LYNDHURST

The Committee considered the report of the Director of Recreation and Heritage (Item 6 in the Minute Book) on a footpath between Great Mead and Gosport Lane, Lyndhurst.

RESOLVED:

    (i) That the making of a Definitive Map Modification Order on the grounds set out in the Wildlife and Countryside Act 1981 Section 53(3)(c)(iii) be approved in principle to add to the definitive map as a byway open to all traffic with a width of between 21 and 41 metres the land shaded in red on the plan attached to the report as Appendix I.

    (ii) That the making of the Order be deferred until such time as officers deem appropriate, to allow the landowner to apply for an extinguishment of highway rights over part of the land and the extinguishment of vehicular rights over the remainder.

360 CLAIM FOR THE ADDITION TO THE DEFINITIVE MAP OF A FOOTPATH BETWEEN KINGSFIELD GARDENS AND FORGE CLOSE, BURSLEDON

The Committee considered the report of the Director of Recreation and Heritage (Item 7 in the Minute Book) on a footpath between Kingsfield Gardens and Forge Close, Bursledon.

RESOLVED:

That a Definitive Map Modification Order be made on the grounds set out in the Wildlife and Countryside Act 1981 Section 53(3)(c)(iii) to record the path running between Kingsfield Gardens and Forge Close, Bursledon as a footpath with a width of between 2.8 metres and 4.0 metres.

361 DEPUTATIONS IN RESPECT OF THE USE OF LAND FOR A PERMANENT FACILITY FOR THE RECYCLING OF CONSTRUCTION AND DEMOLITION WASTE AND ASSOCIATED DEVELOPMENT INCLUDING AGGREGATE AND COMPOST IMPORTATION FOR BLENDING PURPOSES, RETENTION OF CONCRETE BATCHING PLANT AND EXTENSION OF TIME FOR EXISTING SILT PONDS AT RIDGE QUARRY, RIDGE LANE, RIDGE, NEAR ROMSEY (TVS4326/14)

Councillor Caroline Nokes, Mrs Sutton, Mr. Arkell, Mr. Bowley of the Stephen Bowley Planning Consultancy, Mr. Coles of Raymond L Brown (Construction Ltd), Mrs Kell, Mr. Bailey of Wellow Parish Council, Mr. Parker, Mrs Sutton on behalf of Power Triangle Limited and Mr Jones made deputations in respect of the Ridge Quarry application.

The Committee then considered the report of the Chief Planning Adviser (Item 8 in the Minute Book) on the matter. Councillor Dowden declared a personal interest as he is a member of Test Valley Borough Council and of the deputees one is an existing Councillor and one used to be on the Borough Council. The Chief Planning Adviser stated that accident records show accidents along the A3090 which is used by vehicles visiting the site, but an accident mentioned by one of the deputees had not been separately identified. The Test Valley Borough Council Environmental Health Officer had received information which he had requested about noise and was satisfied provided that the 40 dB(A) noise limit at the boundary with Ranvilles' Park Cottages is not exceeded by 5 dB(A). The County Rights of Way Manager was not raising any concern about the proposal and further letters of objection had been received, although he felt that issues raised had already been addressed. He was proposing a slight adjustment to the landscape condition.

The Chief Planning Adviser felt that the deputees had raised two fundamental points, namely environmental impact and the policy principle of whether it is right to approve a permanent use for a site that has been a temporary one with a defined end date. As regards the former he felt that environmental impact issues could be satisfactorily addressed whilst in the case of the latter there is a major requirement to increase the recycling of construction waste so as to reduce the pressure on the resource base. He felt that on balance the merits of the site outweigh policy concerns. He stressed that there is a need to consider applications as they come forward as a core strategic minerals site document would not be adopted until late 2007.

RESOLVED:

That planning permission in respect of the use of land for a permanent facility for the recycling of construction and demolition waste and associated development, including aggregate and compost importation for blending purposes, retention of the concrete batching plant and an extension of time for existing silt ponds at Ridge Quarry, Ridge Lane, Ridge, Near Romsey (TVS4326/14) be refused as need for the facility has not been demonstrated and because the development would be contrary to Policy 46(iii) of the Hampshire, Portsmouth and Southampton Minerals and Waste Local Plan in that the proposed development would not be sited on the type of land identified by the Policy.

362 DEPUTATIONS IN RESPECT OF THE CHANGE OF USE FROM A SCRAP YARD TO A WASTE TRANSFER STATION AT PEGHAM INDUSTRIAL ESTATE, FONTLEY ROAD, FUNTLEY (04/02519/HCM WO3395/09)

Mrs. Clarke of the British Horse Society, Councillor Mrs. Mallett of Wickham Parish Council and Mr. Jackson of the Bryan Jezeph Consultancy made deputations in respect of the Pegham Industrial Estate proposal.

The Committee then considered the report of the Chief Planning Adviser (Item 9 in the Minute Book) on the matter. Councillor Price declared a personal interest as he had been present at and had voted at the Planning Committee meeting of Fareham Borough Council when the matter was considered, although this did not prejudice his right to vote at this meeting. Councillor Mrs. Harrison declared a personal interest on the same grounds whilst Councillor Bryant declared a personal interest as he is a member of Fareham Borough Council, although he does not sit on the Planning Committee. The Chief Planning Adviser reported that the Fareham Society had expressed concerns about traffic whilst the Environment Agency had raised no objection. Local Member Councillor Felicity Hindson had recognised the problems arising from the history of the site and advocated the securing of a contribution towards highway safety improvements.

The Chief Planning Adviser further stated that the upholding of the appeal in respect of the refusal of planning permission for Units D and E on the estate should be taken into account, whilst Winchester City Council had not helped matters by granting permission for a skip hire business at the site. The number of lorry movements per day could be monitored and a highway contribution could be sought towards the provision of a footway along Fontley Road, between Springles Lane and Segensworth Road. He agreed to look into the issues concerning horses raised during the deputations.

RESOLVED:

    (i) That, subject to the receipt of a financial contribution towards road safety/footway improvements, planning permission in respect of the change of use from a scrap yard to a waste transfer station at Pegham Industrial Estate, Fontley Road, Funtley (04/02519/HCM) be granted for the reason specified in the report and subject to the conditions specified therein.

    (ii) That the Executive Member for Environment be advised that the legacy of Pegham Coppice creates a continuing concern about the road safety issues on Fontley Road and Segensworth Road and that there is a need to consider improvements beyond current commitments.

    (iii) That the Chief Planning Adviser write to Winchester City Council on behalf of the Committee expressing his disappointment at the lack of consultation with the County Council on the application for a change of use from a scrap yard to a skip hire business which was approved by the City Council.

363 DEPUTATIONS IN RESPECT OF STORAGE OF INERT WASTE IN SKIPS AT MILL FARM, EAST WELLOW, ROMSEY (TVS 04164/10)

Mr. Perry, Mr. Gibbon, Mr. Bailey of Wellow Parish Council and Mr. Cory-Wright made deputations in respect of the Mill Farm application.

The Committee then considered the report of the Chief Planning Adviser (Item 12 in the Minute Book) on the matter. The Chief Planning Adviser confirmed that the application site, albeit in the countryside, is within the curtilage of the industrial estate at Mill Farm on which planning permission for B8 uses had been granted. He felt that it was a reasonable application entailing a maximum of 6 loaded skips being stored on site at any one time with the number of lorry movements being restricted to 12 (6 in : 6 out) per day. Any application for an extension past the proposed expiry date of 30 November 2006 would have to be dealt with on its merits.

RESOLVED:

That planning permission in respect of the storage of inert waste in skips at Mill Farm, East Wellow, Romsey (TVS 04164/10) be granted for the reasons specified in the report and subject to the conditions specified therein subject to an additional condition restricting the hours of working on the site to 0730 - 1730 Monday to Friday, 0730 - 1300 on Saturday and no working on recognised public holidays or Sunday.

364 DEPUTATIONS IN RESPECT OF NEW NURSING CARE ACCOMMODATION WITH ASSOCIATED EXTERNAL WORKS AT TATCHBURY MOUNT, OFF LOPERWOOD, CALMORE (82653)
Mr. Ball, Mr. Parker, Councillor Puttock and Councillor Tipp made deputations in respect of the Tatchbury Mount application. The Committee then considered the report of the Chief Planning Adviser (Item 13 in the Minute Book) on the matter. Councillor Bright declared a personal interest being resident in the area and local member. The Chief Planning Adviser reported the receipt of a letter from Councillor Giddings of Netley Marsh Parish Council in which he set out the concerns of the Parish Council concerning the application. The main issue raised by the Parish Council was the additional traffic that would be generated and which would use local lanes which had seen a phenomenal increase in vehicles over the last seven years which had coincided with the redevelopment of the Tatchbury Mount site. He confirmed that the facility would be situated on a brownfield site as specified in the local plan and that the local plan had been prepared at a time when the New Forest had a planning status equivalent to that of a national park. The proposal would in fact generate less traffic than current uses and a general investigation regarding the need for works to mitigate the impact of traffic on lanes within the area was to be undertaken.

RESOLVED:

That planning permission be granted for development by the County Council comprising new nursing care accommodation with associated external works at Tatchbury Mount, off Loperwood, Calmore (82653) for the reason specified in the report and subject to the conditions specified therein.

365 RECYCLING FACILITY FOR THE PROCESSING OF INERT CONSTRUCTION AND DEMOLITION MATERIAL AT ROOKERY FARM LANDFILL SITE, BOTLEY ROAD, SWANWICK (P/04/1522/MW)

366 VARIATION OF CONDITIONS 1 AND 4 OF PLANNING PERMISSION 78713 (EXTENSION OF TIME AND ADDITIONAL LORRY MOVEMENTS) AT THORNS FARM, EAST END, LYMINGTON (82759)

The Committee considered the report of the Chief Planning Adviser (Item 11 in the Minute Book) on Thorns Farm, Lymington.

RESOLVED:

That planning permission in respect of the variation of conditions 1 and 4 of Planning Permission 78713 (extension of time and additional lorry movements) at Thorns Farm, East End, Lymington (82759) be granted for the reasons specified in the report and subject to the conditions therein.

367 SAND AND GRAVEL EXTRACTION FROM LAND EAST OF MORTIMER QUARRY WITH LOWER LEVEL RESTORATION TO COMMERCIAL AND FORESTRY AND HEATHLAND AT MORTIMER QUARRY, WELSHMAN'S ROAD, MORTIMER WEST END (BDB/58692)

The Committee considered the report of the Chief Planning Adviser (Item 13 in the Minute Book) on Mortimer Quarry. The Chief Planning Adviser reported that a revised restoration plan had been submitted which takes into account ecological matters.

RESOLVED:

That, subject to a legal agreement concerning highway contribution and lorry routeing, planning permission in respect of sand and gravel extraction from land to the east of Mortimer Quarry with lower restoration to commercial and forestry and heathland at Mortimer Quarry, Welshman's Road, Mortimer, West End (BDB58692) be granted for the reasons specified in the report and subject to conditions specified therein.

368 CONSTRUCTION OF A REPLACEMENT JOHN HUNT OF EVEREST SCHOOL AND YOUTH PROVISION BUILDING, ASSOCIATED PLAYING FIELDS, FLOODLIT MUGA AND STP, EXTERNAL AREAS INCLUDING LANDSCAPED COURTYARDS, CAR PARKING, A PUBLIC LANDSCAPED SCHOOL SQUARE AND A RIDGELINE STRUCTURAL PLANTING SCHEME, TOGETHER WITH ACCESS AND SERVICING ARRANGEMENTS (INCLUDING SUDS FEATURES) AT WELLFIELD FARM, SHERBORNE ROAD, POPLEY, BASINGSTOKE AND PART OF GREATFIELD FARM, ALDERMASTON ROAD, BASINGSTOKE (BDB/59368)

The Committee considered the report of the Chief Planning Adviser (Item 15 in the Minute Book) on a replacement John Hunt of Everest School at Basingstoke. The Chief Planning Adviser reported that Basingstoke and Deane Borough Council had not objected to the application, but had raised traffic management issues and the materials used on the roof of the building. He felt that the material proposed was suitable and that traffic management issues would be taken account of when the nearby major development proposals were being drawn up.

RESOLVED:

    (i) That planning permission be granted for development by the County Council comprising the construction of a replacement John Hunt of Everest School & Youth Provision Building, associated playing fields, floodlit MUGA and STP, external areas including landscaped courtyards, car parking, a public landscaped school square and a ridgeline structural planting scheme, together with access and servicing arrangements (including SUDS features) at Wellfield Farm, Sherborne Road, Popley, Basingstoke and part of Greatfield Farm, Aldermaston Road, Basingstoke (BDB/59368) for the reason specified in the report and subject to the conditions specified therein.

    (ii) That the Executive Member for Environment be made aware of the likely traffic issues on the roads around the school (particularly speed limits).

369 DEVELOPMENT CONTROL SCHEDULE

    The Committee considered the report of the Chief Planning Adviser (Item 16 in the Minute Book) which provided an update on progress of minerals and waste and County Council development applications, outstanding enforcement action, planning/enforcement appeals and notice of permissions about to expire.
