DRAFT BRIEF OUTLINE

November 2004

1. Project Brief

    1.1. Mid Hampshire Primary Care Trust currently contracts with two service providers (MACA and Stonham) to provide three residential care homes for twenty one residents in total. These are historically health-funded block contracts that were set up in 1996/7 by the former health authority as part of the Park Prewett Reprovision programme.

    1.2. During the past year, there have been changes to residential allowance and Supporting People funding that have reduced the income of the three projects. Stonham, one of the service providers, has given notice that they can no longer provide the service at Compton Road Care Home due to deficit funding.

    1.3. The residents in the three care homes have been recently reassessed in order to determine future housing needs and arrangements for future commissioning of services. Reports on individual residents' needs, the three homes and a locality summary have now been completed.

    1.4. Mid Hampshire Primary Care Trust (MHPCT) and Hampshire County Council Social Services (HCC) have agreed to work towards an agreement under section 31 of the Health Act 1999 to commission jointly residential services for current residents of the three care homes, and to provide a new service model for mental health residential care to individuals with mental health needs. Such an agreement would ensure that current MHPCT investment in this provision is ringfenced and that additional investment is made by HCC to increase the current budget for the three projects and to enable the remodelling of services to meet future needs.

    1.5. A multi-agency project comprising Project Steering Group and Project Development Group will be set up to manage the two strands:

      1.5.1. The development of a section 31 (Health Act 1999)Commissioning Agreement and

      1.5.2. The remodelling of residential care provision to reflect the recovery model to meet future needs.

3. Goal

    3.1. To jointly commission modern health and social care mental health resources that meets the needs of current residents of Kirtling House, Compton Road and Scotter Road residential care homes and future service users.

    3.2. It is recognised that existing patterns of services are outdated and do not reflect the standards of service now required.

    3.3. The needs of the existing service users will be paramount in the Reprovision.

4. Objectives

    4.1 To develop an agreement under section 31 of Health Act 1999 between Mid Hampshire Primary Care Trust and Hampshire County Council to reprovide for the service users set out in 3.1. This will include the following finances:

      4.1.1 Current monies in the Section 28A agreement between Mid Hampshire Primary Care Trust and the current Service Providers, MACA and Stonham Housing (Old Long Stay Residents' monies to be repaid to Secretary of State on their death)

      4.1.2 All additional monies negotiated between Mid Hampshire Primary Care Trust and the Service Providers for section 117 payments and increases in establishment charges.

      4.1.3 SHMG monies for Compton Road for 2004/5 only to be secured by HCC

      4.1.4 HCC care management monies towards residential care allowance shortfall

      4.1.5 Project management costs, if not able to be managed within existing resources.

    4.2 Liability for the repayment of charges made to residents subject to section 117 of MHA 1983 will remain the responsibility of Mid Hampshire Primary Care Trust

    4.3 The three properties will remain part of the project as long as the current residents and their successors reside there

    4.4 The agreement excludes capital receipts from sale of any of the three properties

    4.5 In response to the notice given by Stonham that they can no longer provide a service at Compton Road home, to develop and implement a short-term action plan:

      4.5.1 To negotiate with Stonham to keep the house open until at least end of March 2005

      4.5.2 To consult with the residents and their relatives, involving advocacy services as needed, as to their future residential needs

      4.5.3 To involve staff of Compton Road in the consultation process

    4.6 To develop and implement a longer-term plan to remodel residential services within the locality in keeping with national modernising guidance1, locality needs, recovery approach and available finances.

    4.7 To work with the two service providers, MACA and Stonham, and Hampshire Partnership NHS Trust to develop a new service model in Winchester area.

    4.8 To work with Stonham to review Scotter Road building to ensure it is fit for purpose for future needs of current residents.

    4.9 Impact Assessment: for the Race Relations Amendment Act

      4.9.1 The impact of jointly commissioned service provision has been assessed under the Race Relations Amendment Act:

      4.9.1.1 This would provide a wider range of choices to both health and social care service users and those with fluctuating needs;

      4.9.1.2 It would offer a more flexible approach to meet individual need;

      4.9.1.3 Services would be developed to meet local need to provide fair and equal access.

6. Scope

    6.1. The project includes all service planning issues relating to residential services provision currently provided at Compton Road, Kirtling House and Scotter Road residential care homes.

    6.2. The project excludes all other residential provision in the locality, except by agreement of the Commissioners.

    6.3. The project excludes repayment of charges previously made to residents and former residents of the three homes entitled to section 117 aftercare. This matter is the responsibility of Mid Hampshire Primary Care Trust.

7. Constraints

      The section 31 Agreement must be in place by March 2005 in order to resolve financial issues for 2004/5.

8. Dependencies

    8.1. The project is dependent on available finance and the full co-operation of the residents involved, their care co-ordinators, residential home staff, relatives and others involved in their care and of the service providers.

    8.2. Factors outside the control of the project may include:
