403 DECLARATIONS OF INTEREST
Members were mindful that, where they believed they had a personal or personal prejudicial interest in any matter to be considered at the meeting, they should normally at the time of the debate declare their interest and, having regard to the circumstances described in paragraphs 9, 10, 11 and 12 of the County Council's Code of Conduct, consider whether to leave the meeting whilst the matter was discussed.

The Minutes of the meeting of the Committee held on 16 February, 2005 were confirmed by the Committee and signed by the Chairman.
405 CHAIRMAN'S COMMUNICATIONS
(i) Exploratory Oil Well, Hedge End
The Chairman reported that the application for an exploratory oil well at Hedge End which had given rise to a considerable number of objections, had been withdrawn by the applicant.
(ii) Ombudsman Case - Sports Hall Proposal - Eggars School, Holybourne, Alton
The Chairman reported on an Ombudsman case which had been brought about by a complaint from a neighbour to a proposed sports hall at Eggars School, Holybourne which had been granted permission in April 2004. The official decision of the Ombudsman was that there had been no, or insufficient, evidence of maladministration.
406 CLAIM FOR THE ADDITION TO THE DEFINITIVE MAP OF A FOOTPATH FROM RINGWOOD ROAD TO THE COUNTY BOUNDARY IN THE PARISH OF BRANSGORE
The Committee considered the report of the Director of Recreation and Heritage (Item 5 in the Minute Book) on a claim for the addition to the Definitive Map of a footpath from Ringwood Road to the County boundary, Bransgore.
RESOLVED:
That the application for a Map Modification Order in respect of the footpath from Ringwood Road to the County boundary, Bransgore be refused.
407 DEPUTATION IN RESPECT OF THE CLAIM FOR THE ADDITION TO THE DEFINITIVE MAP OF A BRIDLEWAY FROM FLEXFORD LANE, SWAY TO SILVER STREET, HORDLE
The Director of Recreation and Heritage introduced the report on the claim for the addition to the Definitive Map of a bridleway from Flexford Lane, Sway to Silver Street, Hordle. Miss Bruce then made a deputation in respect of the matter subsequent to which the Committee considered the report of the Director of Recreation and Heritage (Item 6 in the Minute Book). Having listened carefully to the information provided, there was a strong measure of support from some Members for an upgrading of the path based on the historical evidence submitted. The Committee was informed that if it was minded to agree, the upgrading would need to be to the status of a byway open to all traffic, rather than to bridleway status, by reason of the nature of the historical evidence provided.
On the requisition of more than one quarter of Members present, voting on the issue was recorded to show how each Member present and voting gave his/her vote; the recorded vote was as follows:-

RESOLVED:
That, because the evidence of use during the period 1759 to the current date is sufficient, an Order be made under Section 53(2)(b) of the Wildlife and Countryside Act 1981 and submitted to the Secretary of State for the Environment, Food and Rural Affairs for confirmation, or confirmed by the County Council as appropriate, to upgrade Footpath 9 Sway and Footpath 743 Hordle to byways open to all traffic as shown on the plan attached to the report of the Director of Recreation and Heritage.
408 DEPUTATIONS IN RESPECT OF THE EXTENSION TO EXISTING PRIMARY SCHOOL TO PROVIDE NEW HALL, KITCHEN FACILITIES, LINK BUILDING AND EXTENSION TO HARD PLAY AREA AT ST LAWRENCE CHURCH OF ENGLAND SCHOOL, AMERY HILL, ALTON (APPLICATION NO: F20532/012/REG3) (COUNTY COUNCIL REFERENCE EHE042)
The Chief Planning Adviser introduced the report on a proposed extension to St Lawrence Church of England School, Amery Hill, Alton. Mr. Allan, Mrs. Allan, Mrs Haymes and Mr. Utton then made deputations on the matter. The Committee then considered the report of the Chief Planning Adviser (Item 7 in the Minute Book). That consideration of the application be deferred pending a site visit to be held on Monday, 11 April 2005 at 10.30 a.m.
409 DEPUTATIONS IN RESPECT OF AN APPLICATION FOR THE DEMOLITION OF AN EXISTING BUILDING AND ERECTION OF NEW BUILDING, UPGRADE EXISTING HARDSTANDING AND INSTALLATION OF DRAINAGE SYSTEM AT THE SCRAP YARD, BISHOPS LANE, SHIRRELL HEATH (APPLICATION NO: 04/03023/HCSW13753/01) (COUNTY COUNCIL REFERENCE WR202)
The Chief Planning Adviser introduced the report on the proposed demolition of an existing building and erection of new building, and associated work at The Scrap Yard, Bishops Lane, Shirrell Heath. Mr. Batchelor, Mr. Sharp, Mrs Parker and Mr. Lomax then made deputations on the matter subsequent to which the Committee considered the report of the Chief Planning Adviser (Item 8 in the Minute Book).
RESOLVED:
That planning permission in respect of the demolition of existing building and erection of new building, upgrading existing hardstanding and installation of drainage system at The Scrap Yard, Bishops Lane, Shirrell Heath (04/03023/HCS) be refused for the reasons specified in the report.
410 CONSTRUCTION OF A GAS UTILISATION PLANT, COMPRISING GAS FLARE, GAS ENGINES, ANCILLARY EQUIPMENT, SWITCH ROOM AND STORE/CONTROL ROOM AT SQUABB WOOD LANDFILL SITE, NEAR ROMSEY (TVS05746/6)
The Committee considered the report of the Chief Planning Adviser (Item 9 in the Minute Book) on a proposal to construct and implement a gas utilisation plant, and associated works, at Squabb Wood Landfill Site, Near Romsey.
RESOLVED:
That planning permission for the construction of a gas utilisation plant comprising gas flare, gas engines, ancillary equipment and an access parking area at Squabb Wood Landfill Site, near Romsey (Application number TVS05746/6) be granted for the reason specified in the report and subject to the conditions specified therein.
411 DEPUTATIONS IN RESPECT OF THE USE OF LAND FOR THE RECYCLING OF INERT MATERIAL TO PRODUCE SOILS AND SECONDARY AGGREGATES, INCLUDING THE USE OF SCREENING AND CRUSHING EQUIPMENT, AND SITING OF A PORTAKABIN OFFICE/MESS ROOM AT LAND AT GOLD FARM, GOVERNMENT ROAD, ALDERSHOT (APPLICATION NO: 04/00433/HCC) (COUNTY COUNCIL REFERENCE RMO30)
The Chief Planning Adviser introduced the report on proposals for construction of waste recycling on land at Gold Farm, Government Road, Aldershot. Mr. Catterall, Mrs Armes and Mr Armes then made deputations in respect of the matter, subsequent to which the Committee considered the report of the Chief Planning Adviser (Item 10 in the Minute Book)
RESOLVED:
(i) That planning permission in respect of the use of land for the recycling of inert material to produce soils and secondary aggregates, including the use of screening and crushing equipment, and siting of a portakabin office/mess room at land at Gold Farm, Government Road, Aldershot (Application No: 04/00433/HCC) (County Council Reference RMO30) be refused for the reason specified in the report.
(ii) That the officers be requested to expedite enforcement action in respect of the unauthorised use of the site.
412 VARIATION OF CONDITIONS 9 AND 13 ATTACHED TO PLANNING PERMISSION 17314/3 AND CONDITIONS 2, 3 AND 8 ATTACHED TO PLANNING PERMISSION 17314/7 TO ENABLE THE DEPOSIT OF NON INERT WASTES IN THAT PART OF FAIR OAK QUARRY NEAREST TO THE PROPERTY KNOWN AS SANDELWOOD (AND FOR CONSEQUENTIAL AMENDMENTS TO THE APPROVED PHASING) AND TO REGULARISE THE SITE OPENING TIMES AT FAIR OAK QUARRY, MORTIMERS LANE, FAIR OAK, EASTLEIGH (APPLICATION NO: S/05/53266) (COUNTY COUNCIL REFERENCE (EAO83)
The Chief Planning Adviser introduced the report on the proposed variation of conditions at Fair Oak Quarry, Mortimers Lane, Fair Oak, Eastleigh. Mrs Newton and Mr. Phillips then made deputations on the matter subsequent to which the Committee considered the report of the Chief Planning Adviser (Item 11 in the Minute Book).
RESOLVED:
That planning permission in respect of the variation of conditions 9 & 13 attached to planning permission 17314/3 and conditions 2, 3 and 8 attached to planning permission 17314/7 to enable the deposit of non inert waste in that part of Fair Oak Quarry nearest to the property known as Sandelwood (and for consequential amendments to the approved phasing) and to regularise the site opening times at Fair Oak Quarry, Mortimers Lane, Fair Oak , Eastleigh (S/05/53266) be granted for the reason specified in the report and subject to the conditions specified therein.
413 RELOCATION AND REPLACEMENT OF EXISTING GAS FLARE WITH HIGHER CAPACITY FLARE AT FAIR OAK LANDFILL, MORTIMERS LANE, FAIR OAK, EASTLEIGH (APPLICATION NO: S/04/52867) (COUNTY COUNCIL REFERENCE (EAO83)
The Chief Planning Adviser introduced the report on the proposed relocation of existing gas flare, Fair Oak Landfill, Mortimers Lane, Fair Oak. Mrs. Newton and Mr. Phillips then made deputations in the matter subsequent to which the Committee considered the report of the Chief Planning Adviser (Item 12 in the Minute Book).
RESOLVED:
That planning permission in respect of the relocation and replacement of existing gas flare with higher capacity flare at Fair Oak Landfill, Mortimers Lane, Fair Oak, Eastleigh (S/04/52867) be granted for the reason specified in the report and subject to the conditions specified therein.

The Committee noted the report of the Chief Planning Adviser and accompanying seventh Annual Report on the Hampshire, Portsmouth and Southampton Minerals and Waste Local Plan (Item 13 in the Minute Book)
415 DEVELOPMENT CONTROL SCHEDULE
The Committee noted the report of the Chief Planning Adviser (Item 14 in the Minute Book) on progress on County Council and minerals and waste development applications, planning enforcement appeals and notice of permissions about to expire.
