1. Summary
1.1 This report provides an update on progress towards modernising the governance of the River Hamble.
2. Corporate Strategy
2.1 This report supports Aim 2 of the Corporate Strategy (Stewardship of the Environment) and Aim 4 (Building Strong and Safe Communities) by providing for a wider group of stakeholder interests to be represented in the management of the River Hamble Harbour environment.
3. Current Status
3.1 Following a public consultation exercise between September and November 2004 and consideration of the outcome by the River Hamble Harbour Management Committee on 17 December 2004, the County Council met on 23 February 2005 and resolved as follows:
(i) That approval be given to the principle of the establishment of a River Hamble Harbour Board to discharge the County Council's responsibilities as Harbour Authority. It is proposed that the Harbour Board should consist of seven members (Chairman, two County Councillors, the Marine Director and three members appointed for their recreational sailing, marine industry and environmental management skills).
(ii) That approval be given to the preparation of amendments to the County Council's Constitution to be considered by the County Council.
(iii) That authorisation be given to the preparation of a Scheme of Delegation and protocols defining the working arrangements between the County Council, the Harbour Board and the River Hamble Harbour Management Committee, this to include provisions for the River Hamble Harbour Management Committee as a sub-committee of the Board, with a strong scrutiny involvement.
(iv) That approval be given to the creation of an Appointments Panel for the Harbour Board comprising the Chairman of the Harbour Board, a representative of the Royal Yachting Association, the British Marine Federation, the Integrated Agency (English Nature) and a Member of the County Council (in addition to the Chairman of the Board), and that support be given to the Panel by the County Council's Human Resources Department.
(v) That the River Hamble Harbour Advisory Committee be disbanded, leaving it to the Harbour Board to decide how it is to interact with river users.
(vi) That the informal consultation role played by the River Hamble Executive Member's Group be discontinued.
4. Way Ahead
4.1 The following steps are now required in order to implement this decision:
(i) Draft and agree Terms of Reference for Harbour Board and Management Committee (by 16 May 2005).
(ii) Draft and agree a Scheme of Delegation and protocols defining the working arrangements between the County Council, the Harbour Board and the River Hamble Harbour Management Committee (by 16 May 2005).
(iii) County Council to select and appoint the Chairman of the Harbour Board (also to be Chairman of the Harbour Board Appointments Panel) (on 16 May 2005).
(iv) Select and appoint the Members of the Harbour Board Appointments Panel (by 16 May 2005).
(v) Advertise (in April 2005), select and appoint the Members of the Harbour Board (by end of May 2005). Draft Person Specifications are attached for comment and endorsement.
(vi) County Council to select and appoint the Chairman of the Management Committee (on 16 May 2005).
(vii) Hold inaugural meetings of Management Committee and Harbour Board (by 17 June 2005).
(viii) Harbour Board to debate and agree future arrangements for engaging with Associations, Parish Councils, the Crown Estate, river users and other key stakeholders (at inaugural meeting).
Recommendations
1. That the attached Person Specification for the Members of the Harbour Board be supported.
2. That the remainder of this report be noted.

RIVER HAMBLE HARBOUR BOARD
PERSON SPECIFICATION - COUNTY COUNCIL MEMBERS
Role:
To be a full voting Member of the River Hamble Harbour Board.
General Requirements:
The duties of a Board Member are considered to be on a par with those of a director of a company.
A Board Member must act completely independently and for the benefit of all stakeholders in the River, including River users and the local community.
The aim of the Harbour Board (and thus of its Members) is to take such steps as it considers necessary or expedient for the improvement, maintenance and management of the Harbour, with a recognition of the Harbour's role in the region.
A Board Member is expected to act with independent judgement, to use their skills and experience for the benefit of the Board, to be committed to working in the best interests of the Harbour, to devote the necessary time to carry out the functions of a Board Member and to undertake such training as specified by the Board from time to time.
A Board Member must be familiar with the Harbour and the surrounding area.
Specific Requirements:
County Council Board Members should have relevant expertise and experience in two or more of the following fields:
Management of harbours
Recreational boating
Finance
Administration
The commercial marine industry
Environmental issues
The local community and community development
Planning
Tourism and leisure
