416 DECLARATIONS OF INTEREST

Members were mindful that, where they believed they had a personal or personal prejudicial interest in any matter to be considered at the meeting, they should normally at the time of the debate declare their interest and, having regard to the circumstances described in paragraphs 9, 10, 11 and 12 of the County Council's Code of Conduct, consider whether to leave the meeting whilst the matter was discussed.

The Minutes of the meeting of the Committee held on 23 March, 2005 were confirmed by the Committee and signed by the Chairman.

418 CHAIRMAN'S COMMUNICATIONS

Last meeting of the current Council


The Chairman reminded Members that this was the last meeting of the current Council; he had enjoyed his stint as Chairman and offered his thanks to fellow Members and Officers.

419 CLAIM FOR THE ADDITION TO THE DEFINITIVE MAP OF A FOOTPATH BETWEEN DERBY ROAD AND DESBOROUGH ROAD, EASTLEIGH

The Committee considered the report of the Director of Recreation and Heritage (Item 5 in the Minute Book) on the proposed footpath in Eastleigh.

RESOLVED:

That the claim to add a new public right of way be accepted, as the status of footpath and an order be made to add to the definitive map a new footpath of the width of 1.8 metres running between Derby Road and Desborough Road, Eastleigh.

420 CLAIM FOR THE ADDITION TO THE DEFINITIVE MAP OF A BYWAY OPEN TO ALL TRAFFIC FROM THE JUNCTION OF BAGMORE LANE AND RED LANE, BRADLEY TO BRIDLEWAY 9, HERRIARD
The Committee considered the report of the Director of Recreation and Heritage (Item 6 in the Minute Book) on a Byway Open to all Traffic at Bradley.

RESOLVED:

    (i) The application to add to the Definitive Map a Byway Open to All Traffic from the junction of Bagmore Lane and Red Lane, Bradley to Bridleway 9 Herriard be refused.

    (ii) Should any of the Jervois material subsequently become available for public inspection, a new application would be considered.

421 DEDICATION OF BRIDLEWAY RIGHTS ALONG FOOTPATH 6b HEDGE END

The Committee considered the report of the Director of Recreation and Heritage (Item 7 in the Minute Book) on footpath 6b, Hedge End.

RESOLVED:

That the dedication of bridleway rights along footpath 6b Hedge End, be accepted with thanks.

422 DEDICATION OF A PUBLIC FOOTPATH ALONG WORKMANS LANE, WARSASH

The Committee considered the report of the Director of Recreation and Heritage (Item 8 in the Minute Book) on Workmans Lane, Warsash.

RESOLVED:

That the dedication of a footpath along Workmans Lane, Warsash be accepted with thanks.

423 CLAIM TO ADD TO THE DEFINITIVE MAP A BRIDLEWAY BETWEEN SICKLES HATCH AND BRIDLEWAY 62 IN THE PARISH OF BINSTED
Mr. Wheeler-Bennett (on behalf of the owners of the land) and Mrs Comber of the Three Counties Bridleways Group made deputations in respect of the claim. The Director of Recreation and Heritage subsequently advised that the matter has to be proved on the balance of probability.

RESOLVED:

That the claim to add a new public right of way be accepted at the status of public bridleway and that an order be made to add to the Definitive Map a public bridleway 2.74 metres wide, as shown between points A and B in the Parish of Binsted as shown on the map attached to the report.

424 STORAGE OF PLANT, MACHINERY AND MATERIALS ANCILLARY TO THE DEMOLITION AND WASTE RECYCLING BUSINESS AT LAND ADJACENT TO CALF LANE CHALK QUARRY, RYE COMMON, ODIHAM (05/00373/CMA)

The Chief Planning Adviser introduced the report on Rye Common and drew attention to the adverse impact of further traffic; Crondall Parish Council had raised objection on these grounds. Mr. Cubbage and Mr. Comley then made deputations on the matter. The Committee then considered the report of the Chief Planning Adviser (Item 10 in the Minute Book) on the matter.

RESOLVED:

That planning permission in respect of the storage of plant, machinery and materials ancillary to a demolition and waste recycling business at land adjacent to Calf Lane Chalk Quarry, Rye Common, Odiham (05/00373CMA) be refused for the reasons specified in the report.

425 EXTENSION OF EXISTING PRIMARY SCHOOL TO PROVIDE NEW HALL, KITCHEN FACILITIES, LINK BUILDING AND EXTENSION OF HARD PLAY AREA AT ST LAWRENCE CHURCH OF ENGLAND SCHOOL, AMERY HILL, ALTON (F20532/012/REG3)
The Chief Planning Adviser introduced the report on St Lawrence Church of England School, and felt that it amounted to a good compromise; the Committee could not redesign the application and would either have to accept it or refuse it. Mrs. Allen, Mr. Allan and Mrs. Haymes then made deputations on the matter. The Committee then considered the report of the Chief Planning Adviser (Item 11 in the Minute Book) on the school.

RESOLVED:

That planning permission be granted for development by the County Council comprising an extension to the existing primary school to provide a new hall, kitchen facilities, a link building and an extension of the hard play area at St Lawrence Church of England School, Amery Hill, Alton (F20532/012/Reg3) for the reasons specified in the report and subject to the conditions specified therein.

426 COMMONS REGISTRATION ACT 1965 - APPLICATION TO REGISTER LAND AT WEST DEAN, SALISBURY, WILTSHIRE AS VILLAGE GREEN
The Chief Executive introduced the report (Item 16 in the Minute Book) on the village green application at West Dean. He confirmed that the application had been deferred in July 2003 pending the judgment in Oxfordshire County Council v (1) Oxford City Council (2) Catherine Mary Robinson 2005 the Trap Grounds case. Mr. Morgan then made a deputation on the matter and the Committee subsequently discussed it.

RESOLVED:

    (i) That the applicant's request for deferment of a decision be rejected.

    (ii) That the Section 13 application insofar as it relates to the Morgan land be rejected.

    (iii) That the Section 13 application in relation to the rest of the application be acceded to.

    (iv) That the reason for the part rejection be "because relevant user is not continuing for the purposes of Section 21(1A)(a) of the Commons Registration Act 1965."

427 NON-COMPLIANCE WITH CONDITION 1 OF PLANNING PERMISSION F20310/21 FOR CONTINUATION OF SAND EXTRACTION BEYOND
31 MARCH 2005 AT LAND NORTH OF RIFLE RANGE, BAIGENTS HILL, HEADLEY, NEAR BORDON (RABBITFIELD HILL) (F20310/023/CMA)

The Committee considered the report of the Chief Planning Adviser (Item 12 in the Minute Book) on Rabbitfield Hill, Bordon.

RESOLVED:

That planning permission in respect of non-compliance with condition 1 of planning permission F20310/21 for continuation of sand extraction beyond 31st March 2005 at land to the north of the Rifle Range, Baigents Hill, Hadley, Near Bordon (Rabbitfield Hill) (F20310/023/CMA) be granted for the reasons specified in the report and subject to the conditions specified therein.

428 ALTERATIONS AND EXTENSIONS TO EXISTING LIBRARY, REPLACEMENT OF PUBLIC TOILETS AT LIBRARY, JEWRY STREET, WINCHESTER (WINCHESTER CULTURE CENTRE) 05/00199/HCS W01662/10) :ALTERATIONS AND EXTENSIONS TO EXISTING LIBRARY, REPLACEMENT OF PUBLIC TOILETS, DEMOLITION OF DISUSED FLOWER SHOP KIOSK AT LIBRARY, JEWRY STREET, WINCHESTER (WINCHESTER CULTURAL CENTRE (05/00198/LIS W01662/09LB)

The Committee considered the report of the Chief Planning Adviser (Item 13 in the Minute Book) on Winchester Library.

RESOLVED:

    (i) That planning permission in respect of alterations and extensions to existing library and replacement of public toilets at the Library, Jewry Street, Winchester (Winchester Culture Centre) 05/00199/HCS W01662/10) be granted for the reasons specified in the report and subject to the conditions specified therein.

    (ii) That the Secretary of State be recommended to grant listed building consent in respect of alterations and extensions to the existing library, replacement of public toilets and demolition of disused flower shop kiosk at the Library, Jewry Street, Winchester (Winchester Cultural Centre (05/00198/LIS W01662/09LB) for the reasons specified in the report and subject to the conditions specified therein.

429 PROVISION OF TEMPORARY BUILDING WITH OFFICES AND TOILETS FOR A TEMPORARY PERIOD UNTIL 31 AUGUST 2006 AT LANGDOWN INFANT SCHOOL, LYTTON ROAD, HYTHE (83915)

The Committee considered the report of the Chief Planning Adviser (Item 14 in the Minute Book) on Langdown Infants School, Hythe.

RESOLVED:

    (i) That planning permission be granted for development by the County Council comprising a temporary building with offices and toilets for a temporary period at Langdown Infant School, Lytton Road, Hythe (83915) for the reasons specified in the report and subject to the conditions specified therein.

    (ii) That a letter be sent to the Executive Member for Policy and Resources requesting that any disposal be subject to provisions for the maintenance of the mature trees on the site.

430 DEVELOPMENT CONTROL SCHEDULE

The Committee noted the report of Chief Planning Adviser (Item 15 in the Minute Book) on progress on County Council and Minerals and Waste Development applications, planning enforcement appeals and notices of permissions about to expire.
