1. COUNTY COUNCIL ELECTIONS
The Chief Executive as County Returning Officer gave his return of the persons
elected members of the County Council at the elections held on 5 May 2005. A copy of the list is attached as Appendix 1 to these minutes.
2. ELECTION OF CHAIRMAN
The Chief Executive called for nominations. Councillor T. K. Thornber CBE, seconded by Councillor M. J. Woodhall, proposed that Councillor J. K. West be elected Chairman of the Council for the ensuing year.
RESOLVED:
That Councillor J. K. West be and is hereby elected Chairman of the County Council to hold office until the annual meeting of the Council in 2006.
Councillor West thereupon made the declaration of acceptance of office and took the Chair.

3. DECLARATIONS OF INTEREST
Members were mindful that, where they believed they had a personal or
personal prejudicial interest in any matter to be considered at the meeting, they
should normally at the time of the debate, declare their interest and having regard to
the circumstances described in paragraphs 9, 10, 11 and 12 of the County Council's
Code of Conduct, consider whether to leave the meeting whilst the matter was
discussed.
4. MINUTES
The Minutes of the meeting of the County Council held on 31 March 2005 were confirmed and signed by the Chairman, subject to the addition of Councillor Mrs C. A. Leversha to the list of members supporting the motion relating to the Draft South East Plan - minute 389.
5. APPOINTMENT OF VICE-CHAIRMAN
Councillor T. K. Thornber, C.B.E, seconded by Councillor M. J. Woodhall,
proposed that Councillor Mrs. P. A. West be appointed Vice-Chairman of the
Council for the ensuing year. Councillor A. P. Collett, seconded by Councillor B. D. Dash, proposed that Councillor R. H. Price be appointed Vice-Chairman of the Council for the ensuing year.
Upon the propositions being put to the vote, Councillor Mrs. P. A. West was appointed.
ORDERED:
That Councillor Mrs. P. A. West be, and is hereby appointed Vice-Chairman of the Council to hold office until the annual meeting of the Council in 2006.
Councillor Mrs. West thereupon made the declaration of acceptance of office.
6. CHAIRMAN'S COMMUNICATIONS
The Chairman welcomed all members to the Council meeting, both those newly elected and those returning. He referred with sadness to the death of former Councillor Sir Lynton White, formerly Chairman of the County Council from 1977 to 1985. Several members paid tribute to the contribution he had made as Chairman and the Council stood for a few moments in silent tribute. The Chairman then reported arrangements for the memorial service for the late Councillor D. G. Allen which was being held in Winchester Cathedral on Friday 20 May 2005. The Chairman hoped to raise the profile of road safety during his term of office.
7. ELECTION OF LEADER
Councillor D. A. Kirk, seconded by Councillor J. K. Glen, proposed that Councillor T. K. Thornber, C.B.E. be appointed Leader of the Council pursuant to Part I, Chapter 7 of the Constitution.
ORDERED:
That Councillor T. K. Thornber, C.B.E. be appointed Leader of the County Council.
8. LEADER'S REPORT
The Leader gave an outline of arrangements for the review of the County Council's scrutiny structure together with the roles of Area Committees and Advisory Panels. The intention was that all the forthcoming Policy Review Committee meetings would receive a briefing on the key issues, discuss them and comment on the ideas which had come forward; this process would probably be followed by a full Council seminar at which any changes to Overview and Scrutiny arrangements and their relationship with decision making structures could be agreed, and the necessary amendments to the Constitution made.
The Leader also referred to the valuable work being undertaken by the County Council's team of staff in Sri Lanka following the Tsunami disaster in the area. It was apparent that the team had made a very positive impact.
The Leader then gave a brief overview of the direction the County Council would take over the forthcoming four years.
9. APPOINTMENT OF COMMITTEES
The Council considered the report of the Chief Executive (Item 9 in the Minute Book) on the determination of proportionality for the purpose of allocating seats on standing committees and panels; on the appointment of members to the Standards Committee; on the appointment of co-opted members to serve on the Children's Services Policy Review Committee; and on other changes required to adjust the membership of committees.
ORDERED:
1. That approval be given to the revised proportionality table (Appendix 2 to these Minutes)
2. That in accordance with that proportionality table, appointments be made to committees, panels and other bodies where the appointments made by the Council are subject to proportionality rules; details of the consolidated list of memberships are set out in Appendix 3 to these minutes.
3. That the following appointments be made to the Standards Committee:
Councillor J. V. Bryant (Chairman); Councillor R. Kimber (Vice-Chairman); Councillor Mrs. E. M. Byrom; Councillor A. D. Ludlow; Councillor A. W. Rice TD; and a representative of the Labour group to be nominated.
4. That co-opted members be appointed to the Children's Services Policy Review Committee as follows and that the Chief Executive be authorised to accept changes in representation as they arise:
- one representative of the Church of England (voting)
- one representative of the Roman Catholic Church (voting)
- one representative of the Free Churches
- five full-time teachers
- five persons experienced in education or knowledgeable about
education in Hampshire
- one Governors' Forum representative
- three Parent Governor representatives (voting)
5. That the County Council representation on the Health Review Joint Committee be increased to five County Councillors.
6. That Councillor R. J. Baulk be appointed the County Council's e-champion.
10. APPOINTMENT OF COMMITTEE CHAIRMEN AND VICE-CHAIRMEN
The Council considered the report of the Chief Executive inviting nominations
(Item 10 in the Minute Book).

11. HAMPSHIRE FIRE AND RESCUE AUTHORITY
It was noted that the County Council was entitled to 19 seats on the Authority, which were allocated proportionately according to the size of each political group on the County Council. Nominations had been received on that basis, and it was therefore

12. JOINT COMMITTEE TO MAKE APPOINTMENTS TO THE HAMPSHIRE
POLICE AUTHORITY
It was noted that a Joint Committee had responsibility for making appointments of members to serve on the Hampshire Police Authority. That Joint Committee had been constituted in accordance with the provisions of the Police Act 1996 and made appointments to the Police Authority proportionately according to the size of the political groups across its constituent councils - Hampshire County Council, The Isle of Wight Council, Portsmouth City Council and Southampton City Council.
ORDERED:
That the following members of the Council be appointed to serve on the Joint
Committee responsible for making appointments to the Hampshire Police Authority: Councillor A. P. Collett; Councillor P. A. Heath; Councillor Mrs M. D. Snaith; Councillor T. K. Thornber C.B.E.
13. QUESTIONS UNDER STANDING ORDER 20(b)
It was reported that no questions had been received on this occasion.
With the leave of the Council, Part I of the report of the Cabinet/Leader was taken in advance of the item on appointments to outside bodies, as decisions taken on the former would have an impact on the latter.
14. CABINET/LEADER - PART I
Part I of the report of the Cabinet/Leader was presented by Councillor T. K. Thornber C.B.E., Leader of the Council.
15. AMENDMENTS TO THE CONSTITUTION: RIVER HAMBLE HARBOUR
BOARD AND SOUTH DOWNS JOINT COMMITTEE
The Council considered and approved the report setting out changes to the Constitution relating to the River Hamble Harbour Board and the South Downs Joint Committee.
ORDERED:
1. That amendments be made to the Constitution, as detailed in Appendix A of the report, in regard to the establishment of the River Hamble Harbour Board.
2. That the Terms of Reference for the River Hamble Harbour Board, the River Hamble Harbour Management Committee and the Planning and Scrutiny Protocol, as detailed in Appendices B, C and D of the report be approved.
3. That Part I: chapter 11, paragraph 11.2 (Statutory Joint Committees) of the
Constitution be amended by the addition of the following:

16. APPOINTMENTS TO OUTSIDE BODIES
The Council considered appointments to organisations of regional, national or international significance and considered nominations put forward by the Leader and, in some cases, as moved by Councillor A. P. Collett and seconded by Councillor B. D. Dash.
Councillor T. K. Thornber C.B.E. declared a personal interest as Chairman of the County Councils Network.

17. SIR HAROLD HILLIER GARDENS AND ARBORETUM
With regard to the Sir Harold Hillier Gardens and Arboretum Management Committee it was noted that the County Council appointed three Members including the Chairman.
ORDERED:
1. That the current Chairman of the Sir Harold Hillier Gardens and Arboretum Management Committee be not re-appointed.
2. That the Leader of the Council be authorised to appoint a new Chairman of the Committee
3. That subject to such changes as from time to time the Council may wish to make, the following members be appointed to serve on the Sir Harold Hillier Gardens and Arboretum Management Committee:

18. PERFORMANCE PLAN
The Council considered the report of the Chief Executive (Item 16 in the Minute Book) seeking approval of the outline Performance Plan 2005/06 and agreement to arrangements to agree the final text for publication by 30 June 2005. With the leave of the Council, the words at the end of the first Appendix 2 "highlights include", together with the entirety of the second Appendix 2, were deleted as redundant.
ORDERED:
That the Council approve the framework for the Performance Plan for 2005/06, subject to the Leader and Chief Executive agreeing the final text of the summary of performance against corporate aims and priorities.
19. HAMPSHIRE POLICE AUTHORITY
There were on this occasion no matters arising which required the submission of reports from the Authority to the Council. However members wished to place on record their appreciation of the way in which former Councillor S. A. Hayes had carried out his duties as Chairman of the Authority.
20. HAMPSHIRE FIRE AND RESCUE AUTHORITY
There were on this occasion no matters arising which required the submission of reports from the Authority to the Council.
