Hampshire Minerals and Waste Development Scheme

1. Summary

1.1 The County Council is required under the relevant Planning Regulations to formally resolve the date on which the recently approved Hampshire Minerals and Waste Development Scheme (attached as an appendix) should come into effect. It is recommended that the Council resolve that the Scheme should come into effect on the date of its meeting on 21 July 2005.

1.2 It is also recommended that the Council authorises the Director of Environment, in consultation with the Executive Member for Environment: North Hampshire and Spatial Strategy, to modify the Scheme as required in the future.

2. Hampshire Minerals and Waste Development Scheme

2.1 The County Council is preparing the Hampshire Minerals and Waste Development Framework with the City Councils of Southampton and Portsmouth. The Framework comprises a number of Minerals and Waste Development Documents which will set out a spatial strategy and site specific proposals for the development of the area's mineral resources and infrastructure for waste resources management up to 2020.

2.2 However, before work on the Framework can be substantially progressed each of the Councils is required by The Town and Country Planning (Local Development) (England) Regulations 2004 to bring into effect a Minerals and Waste Development Scheme that outlines a preparation programme for the relevant Development Documents.

2.3 On 25 November 2004 the County Council approved the Hampshire Minerals and Waste Development Scheme. The City Councils subsequently approved their own Development Schemes which included the Development Documents that will be jointly prepared with the County Council.

2.4 The Hampshire Scheme was subsequently submitted to the Government Office for the South East (GOSE), which has since advised the Council in a letter dated 11 March 2005 that the First Secretary of State did not intend to issue a Direction to prevent the Scheme coming into effect.

2.5 The County Council is now required under the Regulations to `resolve that the scheme shall have effect' and specify the date on which this should happen. It is recommended therefore that the County Council resolves to bring the scheme into effect at the Council meeting on 21 July 2005.

3. Subsequent Modifications to the Development Scheme

3.1 Development Schemes have to be reviewed and modified as a result of changing circumstances - unanticipated delays in Development Document preparation, changes to policy or simply minor adjustments to programming. Such modifications are procedural and technical matters and it is considered that these can most effectively be dealt with by delegation to the Director of Environment to authorise in consultation with the Executive Member for Environment: North Hampshire and Spatial Strategy. The determination of policy as contained in the Development Documents would remain for the Council to decide on. It is recommended future changes to the Hampshire Minerals and Waste Development Scheme are dealt with accordingly.

Recommendations

1. That the County Council be recommended to resolve that the Hampshire Minerals and Waste Development Scheme approved on 25 November 2004 come into effect on 21 July 2005.

2. That the Director of Environment be authorised, in consultation with the Executive Member for Environment: North Hampshire and Spatial Strategy, to amend the Scheme in future as circumstances require.
