13 DECLARATIONS OF INTEREST
Members were mindful that, where they believed they had a personal or personal prejudicial interest in any matter to be considered at the meeting, they should normally at the time of the debate declare their interest and, having regard to the circumstances described in paragraphs 9, 10, 11 and 12 of the County Council's Code of Conduct, consider whether to leave the meeting whilst the matter was discussed.

16 APPLICATION TO ADD TO THE DEFINITIVE MAP A BRIDLEWAY BETWEEN FRENCHES LODGE AND STOKE HILL FARM, IN THE PARISH OF ST MARY BOURNE
The Committee considered the report of the Director of Recreation and Heritage (Item 5 in the Minute Book) on the proposed addition to the Definitive Map of a bridleway between Frenches Lodge and Stoke Hill Farm in the Parish of St. Mary Bourne.
Having carefully considered the evidence contained in the report, the Committee decided that a public right of way subsisted over the claimed route, and furthermore accepted that the appropriate classification based on the evidence was a byway open to all traffic. Members requested, however, that in view of the possible deleterious impact of vehicles using the route, the Executive Member for Environment, North Hampshire and Spatial Strategy, be requested to consider the management implications of the designation. Accordingly, it was
RESOLVED:
(a) That an Order be made to add to the definitive map a byway open to all traffic and to upgrade part of Footpath No. 20 in St Mary Bourne and Footpath No. 5 in Smannell to byways open to all traffic, the whole being a route between Trenches Lodge and Stoke Road, St Mary Bourne (GRSU3825 5058 to 3964 5119).
(b) That the Executive Member for Environment, North Hampshire and Spatial Strategy be requested to consider the management implications of the decision contained in (a) above.
17 DEDICATION OF A PUBLIC FOOTPATH FROM VEARS LANE TO ST VIGOR WAY IN THE PARISH OF COLDEN COMMON
The Committee considered the report of the Director of Recreation and Heritage (Item 6 in the Minute Book) on the offer from Colden Common Parish Council, acting as land owner, of a dedicated footpath in the Parish of Colden Common.
RESOLVED:
That the offer from Colden Common Parish Council of a dedicated footpath which connects Vears Lane to St Vigor Way, Colden Common be accepted with thanks.
18 TEMPORARY DIVERSION OF FOOTPATH 3, MORTIMER WEST
END
The Committee considered the report of the Director of Recreation and Heritage (Item 7 in the Minute Book) on an application for the temporary diversion of Footpath 3, Mortimer West End.
Members noted that paragraph 4.2 of the report should refer to "Basingstoke and Deane Borough Council" rather than "Fareham Borough Council".
RESOLVED:
That approval be given to the making of an order diverting Footpath 3 Mortimer, West End for a period of six years.
19 RECYCLING FACILITY FOR PROCESSING OF INERT CONSTRUCTION AND DEMOLITION MATERIAL AT ROOKERY FARM LANDFILL SITE, BOTLEY ROAD, SWANWICK (APPLICATION NO. P/04/1522MW) (COUNTY COUNCIL REF: FA032)
Messrs Berry, Martin, Hall, Collins, Cole and Bowley made deputations in respect of this item.
The Committee then considered the report of the Chief Planning Adviser (Item 8 in the Minute Book) on a proposed recycling facility for the processing of inert construction material at Rookery Farm Landfill Site, Botley Road, Swanwick. Following a full discussion it was
RESOLVED:
That determination of the application be deferred to enable additional information to be submitted concerning noise levels and noise quality, dust and further landscaping opportunities.
20 RENEWABLE POWER GENERATION SCHEME AT FAIR OAK LANDFILL SITE, OFF MORTIMER LANE, EAST HORTON FARM, FAIR OAK (APPLICATION NO: S/05/53911) (COUNTY COUNCIL REF: EA083)
The Committee considered the report of the Chief Planning Adviser (Item 9 in the Minute Book) on a proposed renewable power generation scheme at Fair Oak Landfill Site. The Committee was satisfied that the proposed plant was in accordance with policy and would not give rise to adverse environmental conditions for local residents generally. However, there were concerns that the two nearest properties, Sandlewood and East Horton Cottage, which were shortly to be purchased by the applicants, could be subjected to unacceptable noise and it was considered appropriate, therefore, to grant permission subject to a further condition prohibiting development from proceeding until such time as the current owners had concluded the sale of the properties and vacated same.
RESOLVED:
That subject to the submission of additional details to confirm the conclusions of the noise and air quality reports, planning permission in respect of a renewal power generation scheme at Fair Oak Landfill site off Mortimer Lane, East Horton Farm, Fair Oak (Application No. S/05/53911) be granted for the reasons specified in the report and subject to the conditions specified therein, together with a further condition, in such form as the Chief Planning Adviser shall determine, prohibiting the development from proceeding until such time as the properties, Sandlewood and East Horton Cottage are and continue to remain vacant for the continuation of the development.
21 MODIFICATION TO PLANNING CONDITION TO ALLOW SITE TO OPERATE BETWEEN 15 JULY - 31 AUGUST AT HOLMSLEY LANDFILL SITE, BLACK LANE, HOLMSLEY, BRANSGORE (APPLICATION NO: 85070) (COUNTY COUNCIL REF: NF109)
The Committee considered the report of the Chief Planning Adviser (Item 10 in the Minute Book) on a proposed modification to the planning permission at Holmsley Landfill Site, Black Lane, Holmsley, Bransgore.
RESOLVED:
That planning permission in respect of modification to planning condition to allow the site to operate between 15 July - 31 August this year at Holmsley Landfill Site, Black Lane, Holmsley, Bransgore (85070) be granted for the reason specified in the report.
22 THE RETENTION AND DEVELOPMENT OF AN EXISTING WASTE RECYCLING MANAGEMENT AND COMPOSTING FACILITY AT RECYCLING FACILITY AT MANOR FARM, PENNINGTON (APPLICATION NO: 84776) (COUNTY COUNCIL REF: NF402)
The Committee considered the report of the Chief Planning Adviser (Item 11 in the Minute Book) on proposals for the retention and development of an existing waste recycling management and composting facility at Manor Farm, Pennington. Additional plans providing updated information on detailed issues were displayed at the meeting.
RESOLVED:
That, subject to the completion of the `departure' procedures, planning permission in respect of the retention and development of an existing waste recycling management and composting facility and recycling facility at Manor Farm, Pennington (84776) be granted for the reason specified in the report and subject to the conditions specified therein.
23 VARIATION OF CONDITION (5) OF PLANNING PERMISSION 01/00789/CMA TO ALLOW LORRIES TO ENTER AND LEAVE THE SITE ON SUNDAYS AND PUBLIC HOLIDAYS AT RUSHMOOR WASTE TRANSFER STATION, EELMOOR ROAD, FARNBOROUGH (APPLICATION NO: 05/00336/HCC) (COUNTY COUNCIL REF: RM002)
The Committee considered the report of the Chief Planning Adviser (Item 12 in the Minute Book) on a proposed variation of a condition attached to the planning permission at Rushmoor Waste Transfer Station, Eelmoor Road, Farnborough. The Committee accepted that there was a significant need for the waste transfer station to open on the days specified to maintain the waste management service, and noted that it had been used on Sundays and Bank Holidays for several years without complaint. However, it was felt prudent to request the Executive Member for Environment, North Hampshire and Spatial Strategy to review the capacity of the site. Accordingly, it was
RESOLVED:
(a) That planning permission in respect of variation of condition (5) of planning permission 0100789/CMA to allow lorries to enter and leave the site on Sundays and public holidays at Rushmoor Waste Transfer Station, Eelmoor Road, Farnborough (05/00336/HCC) be granted for the reason specified in the report and subject to the conditions specified therein.
(b) That the Executive Members for Environment, be requested to review the capacity of the recycling sites in North East Hampshire and the traffic management issues concerning the Rushmoor Waste Transfer Station and Household Waste Recycling Site.
24 IMPORTATION OF PET CARCASSES AND ASSOCIATED MATERIAL TO BE DISPOSED OF BY EXISTING FARM INCINERATORS (AS AUTHORISED BY DEFRA) AND CONSTRUCTION OF OPEN SIDED FARM BUILDING AT BROXHEAD FARM, LINDFORD, BORDON
(APPLICATION NO: F20983/011/CMA) (HCC REF EH150)
The Committee considered the report of the Chief Planning Adviser (Item 13 in the Minute Book) on a proposal for pet carcasses and associated material to be disposed of by existing farm incinerators, and associated works, Broxhead Farm, Lindford, Bordon. It was noted that two days remained of the period for public objections to the proposals.
The Committee accepted that the principle of the proposal to use existing farm incinerators for the incineration of pet carcasses was supported by policy in that it promoted the sustainable diversification of farm operations and buildings and promoted the reduction of waste going to landfill. However, there was some concern that the application did not contain sufficient detail of the storage facilities to be provided (including refrigeration) for carcasses at the site, and the Chief Planning Adviser undertook to include a further condition to cover this point, and in addition, liaise further with the Environment Agency. It was also considered prudent to add a further condition placing restrictions on the tonnage of vehicles using the site.
RESOLVED:
(a) That planning permission in respect of the importation of pet carcasses and associated material to be disposed of by existing farm incinerators (as authorised by DEFRA) and construction of an open sided farm building at Broxhead Farm, Lindford, Bordon (HCC/2005/0162) be granted for the reason specified in the report and subject to the conditions specified therein and further conditions in such form as the Chief Planning Adviser shall determine regarding the storage facilities for carcasses on the site and the tonnage of vehicles using the site.
(b) That pursuant to (a) above, the Chairman be consulted on any substantial objections received to the proposal within the remainder of the period for public objections.
25 CHANGE OF USE FROM A SCRAPYARD TO A WASTE TRANSFER STATION AT PEGHAM INDUSTRIAL ESTATE, FONTLEY ROAD, FUNTLEY (APPLICATION NO: 05/00504/HCS W03395/10)
Mr. P. Taylor made a deputation in respect of the application.
The Committee then considered the report of the Chief Planning Adviser (Item 14 in the Minute Book) on proposals for the change of use from a scrapyard to a waste transfer station at Pegham Industrial Estate, Fontley Road, Funtley. The Committee was satisfied that, although larger, the building now proposed was no higher than that permitted and would not be visually more intrusive and therefore, planning permission should be granted. However, it was considered appropriate to place a further condition upon the consent requiring the applicant to install an acoustic fence along both the northern and western boundaries of the application site.
RESOLVED:
That planning permission in respect of the change of use from a scrapyard to a waste transfer station at Pegham Industrial Estate, Fontley Road, Funtley (05/00504/HCS) be granted for the reason specified in the report and subject to a financial contribution to highway works and the conditions specified therein, together with further conditions in such form as the Chief Planning Adviser shall determine, requiring the applicant to install an acoustic fence along both the northern and western boundaries of the application site.
26 COMMONS REGISTRATION ACT 1965 - APPLICATION TO REGISTER LAND AT THE RECREATION GROUND, CHAWTON, ALTON
