AT A MEETING of the REGULATORY COMMITTEE of HAMPSHIRE COUNTY COUNCIL held at The Castle, Winchester on Wednesday 7 September 2005.

27. DECLARATIONS OF INTEREST
Members were mindful that, where they believed they had a personal or personal
prejudicial interest in any matter to be considered at the meeting, they should
normally at the time of the debate declare their interest and, having regard to the
circumstances described in paragraphs 9, 10, 11 and 12 of the County Council's
Code of Conduct, consider whether to leave the meeting whilst the matter was
discussed.
28. MINUTES
The Minutes of the meeting held on 20 July 2005 were confirmed by the Committee
and signed by the Chairman.
Arising thereon:
Minute 19 - Recycling Facility for Processing of Inert Construction and Demolition
Material at Rookery Farm Landfill Site, Botley Road, Swanwick
(Application No: P/04/1522MW)
Members noted that the determination of the application would be considered by the
Committee at its meeting on 19 October 2005.
Minute 24 - Importation of Pet Carcasses and Associated Material to be Disposed of
by Existing Farm Incinerators (as authorised by DEFRA) and Construction of Open
Sided Farm Building at Broxhead Farm, Lindford, Bordon
(Application No: F20983/011/CMA)
Members noted that no substantial new objections had been received and planning
consent had been issued.
29. CHAIRMAN'S COMMUNICATIONS
(a) The Chairman announced that the Annual Members Tour had been arranged for
16 September 2005 as agreed at a previous meeting. Members indicated that a more
convenient alternative date should be sought and the Chief Executive
agreed to canvass Members for suitable dates.
(b) Members noted that new Regulations for development control matters had come
into force and amongst a number of changes, planning permission for any
applications submitted since August would expire three years from the date of
consent instead of the period of five years hitherto imposed.
(c) The Chairman reported that Dalee Kaur was leaving Hampshire County
Council and taking up a new job with a firm of solicitors in London and this was
her last Committee . Members thanked her for all her hard work and wished her well
in her new job.
30. AMENDMENT TO THE TIMING OF PERMITTED USE OF THE
SYNTHETIC TURF PITCH (APPLICATION F22879/011 GRANTED
11 SEPTEMBER 2003) ON SATURDAYS AND TO RAISE THE FENCING
ON THE SOUTHERN BOUNDARY IN WELDED MESH TO MATCH
EXISTING, FROM THE CURRENT 2.7 METRE HEIGHT EITHER SIDE OF
THE GOAL TO A CONSISTENT 3.9 METRES ALONG THE ENTIRE
BOUNDARY AT AMERY HILL SCHOOL, AMERY HILL, ALTON
(APPLICATION NO : F22879/012/REG3)
Mr Ford made a deputation in respect of this item.
The Committee then considered the report of the Chief Planning Adviser (Item 5 in
the Minute Book) on the proposed amendment to the timing of permitted use of the
synthetic turf and raising of fencing at Amery Hill School, Amery Hill, Alton. The
Committee noted that an agreement between the School and local residents had
resulted in amendments to the time limit in the conditions for the artificial pitch
being used between 1 September and 30 April and the facility not being used
between 1 May and 31 August.
Members noted that landscaping was proposed and the suggestion of further planting
between the fencing of the pitch and that of nearby housing. The Chief Planning
Advisor undertook to include a further condition to cover additional landscaping and
an advice noted concerning the maintenance of the `shock pads' for the boards at the
bottom of the fence. Accordingly, it was
RESOLVED:
That planning permission in respect of amendment to detail relating to synthetic turf
pitch (Application No : F22879/011 granted 11 September 2003 ) to raise the fencing
of the southern boundary in welded mesh to match existing, from the current 2.7
metre height either side of the goal to a consistent 3.9 metres along the entire
boundary and to request an amendment to the timing of permitted use on Saturdays
at Amery Hill School, Amery Hill, Alton (F22879/012/REG3) be granted for the
reason specified in the report and subject to the conditions specified therein and a
further condition in such form as the Chief Planning Adviser shall determine
regarding the landscaping for the site and an advice note concerning maintenance of
the `shock pads'.
31. THE USE OF LAND FOR THE STORAGE OF SECONDARY
AGGREGATES, RECYCLED MATERIALS AND SKIPS FOR A
TEMPORARY PERIOD TO COINCIDE WITH ASSOCIATED RECYCLING
ACTIVITIES ON NEIGHBOURING LAND, PLUS THE ERECTION AND
USE OF REPLACEMENT VEHICLE WORKSHOPS AT
EVERSLEY HAULAGE PARK, FLEET ROAD, EVERSLEY
(APPLICATION NO : 05/01493/CMA)
Messrs Sandbrook and Todd made deputations in respect of this item.
The Committee then considered the report of the Chief Planning Adviser (Item 6 in
the Minute Book) on the proposed temporary use of the land for the storage of
secondary aggregates, recycled materials and skips at Eversley Haulage Park, Fleet
Road, Eversley.
Having carefully considered the evidence contained within the report, the Committee
agreed that the application should be approved subject to any new issues being raised
by the Parish Council being addressees and reported to the next meeting for
information.
RESOLVED:
(a) That planning permission in respect of the use of land for the storage of
secondary aggregates, recycled materials and skips for a temporary period to
coincide with associated recycling activities on neighbouring land, plus the
erection and use of replacement vehicle workshops at Eversley Haulage
Park, Fleet Road, Eversley (05/01493/CMA) be granted for the reason specified
in the report and subject to conditions specified therein and a further condition
in such form as the Chief Planning Adviser shall determine.
(b) That pursuant to (a) above, the Chairman be consulted on any substantial
objections received to the proposal within the remainder of the period for public
objections.
32. TO CONSTRUCT A RECYCLING FACILITY TO PROCESS
INCINERATOR BOTTOM ASH AND MANUFACTURE SECONDARY
AGGREGATES AT CRACKNORE HARD LANE, CRACKNORE
INDUSTRIAL PARK, MARCHWOOD (APPLICATION NO : 85177)
The Committee considered the report of the Chief Planning Adviser (Item 7 in the
Minute Book) on the proposed construction of a recycling facility at Cracknore Hard
Lane, Cracknore Industrial Park, Marchwood.
Members noted that there were technical issues about drainage which would be
addressed by the conditions and that the proposal would result in 10 additional lorry
movements per day above that currently taking place.
RESOLVED:
That planning permission in respect of the construction of a recycling facility to
process incinerator bottom ash and manufacture secondary aggregates at Cracknore
Hard Lane, Cracknore Industrial Park, Marchwood (85177) be granted for the reason
specified in the report.
33. APPLICATION FOR A MAP MODIFICATION ORDER TO RECORD A
FOOTPATH FROM FOOTPATH 127 TO FOOTAPTH 32 IN FAREHAM
BOROUGH
The Committee considered the report of the Director of Recreation and Heritage
(Item 8 in the Minute Book) on an application for a Map Modification Order to
record a footpath from Footpath 127 to Footpath 32 in Fareham Borough.
RESOLVED:
That the application be refused on the grounds set out in the report.
34. APPLICATION FOR A MAP MODIFICATION OREDER TO RECORD A
FOOTPATH BETWEEN PASSGE LANE CAR PARK AND FOOTPATH 3a
IN FAREHAM BOROUGH
The Committee considered the report of the Director of Recreation and Heritage
(Item 9 in the Minute Book) on an application for a Map Modification Order to
record a footpath between Passage Lane Car Park and Footpath 3a in Fareham
Borough.
RESOLVED:
That the application be refused on the grounds set out in the report.
35. APPLICATION FOR A MAP MODIFICATION OREDER TO RECORD
BRIDLEWAY RIGHTS OVER TWO ROUTES KNOWN AS HART HILL
AND HARDLEY LANE IN THE PARISH OF FAWLEY AND IN THE
PARISH OF HYTHE AND DIBDEN
The Committee considered the report of the Director of Recreation and Heritage
(Item 10 in the Minute Book) on an application for a Map Modification Order to
record bridleway rights over the two routes known as Hart Hill and Hardley Lane in
the Parish of Fawley and in the Parish of Hythe and Dibden.
RESOLVED:
(a) That a Map Modification Order be made to record Hart Hill, as a Byway Open
to All Traffic as shown between B-C-D-E-F on the map attached
to the report.
(b) That the application to record higher rights on Hardley Lane (West) as shown
between J-K-L on the map attached to the report be refused
(c) That a report on a Traffic Regulation Order for Hart Hill be submitted to the
Executive Member for Recreation and Heritage.
36. APPLICATION FOR A MAP MODIFICATION ORDER TO RECORD A
FOOTPATH BETWEEN BULLINGTON LANE AND ROBERTS ROAD IN
THE PARISH OF BARTON STACEY AS A PUBLIC RIGHT OF WAY
The Committee considered the report of the Director of Recreation and Heritage
(Item 11 in the Minute Book) on an application for a Map Modification Order to
record a footpath between Bullington Lane and Roberts Road in the Parish of Barton
Stacey as a public right of way.
RESOLVED:
(a) That an Order be made to record the route as a public footpath between A-B-C
as shown on the map attached to the report.
(b) That the application for the route B-D as shown on the map attached to the
report be refused.
37. PROPOSAL TO DELETE FOOTPATH 10 IN THE PARISH OF
BAUGHURST FROM THE DEFINITIVE MAP OF PUBLIC RIGHTS OF
WAY
The Committee considered the report of the Director of Recreation and Heritage
(Item 12 in the Minute Book) on a proposal to delete Footpath 10 in the Parish of
Baughust from the Definitive Map of public rights of way.
RESOLVED:
That approval be given for the making of a Map Modification Order, to delete the
right of way known as Baughurst Footpath 10, from the Definitive Map of public
rights of way under Section 31 (c) (iii) Wildlife and Countryside Act 1981.
38. APPLICATION TO AMEND THE DEFINITIVE MAP AND STATEMENT IN
RESPECT OF WICKHAM FOOTPATH 2
The Committee considered the report of the Director of Recreation and Heritage
(Item 13 in the Minute Book) on an application to amend the Definitive Map and
Statement in respect of Wickham Footpath 2.
RESOLVED:
That an Order be made under s.53 (3) (c) Wildlife and Countryside Act 1981
amending appropriately the Definitive Map of rights of way in accordance with the
details set out in the report.
39. COMMONS REGISTRATION ACT 1965 - APPLICATION TO REGISTER
LAND AT THE RECREATION GROUND, CHAWTON, ALTON
The Committee considered the report of the Chief Executive (Item 14 in the Minute
Book) on an application to register land known as The Recreation Ground, Chawton,
Alton as a village green.
RESOLVED:
That, subject to the removal of part of the land to which Scottish and Southern
Energy plc object, the Land known as the Recreation Ground, Chawton, Alton in
Hampshire be registered as village green.
