    1. Summary

    1.1 This report covers the following issues:

          (i) Traffic Regulation Order Programme; and



          (ii) Decriminalised Parking Enforcement.



    2. Traffic Regulation Order Programme

    2.1 The appendix shows the current status of the County Council funded Traffic Regulation Order (TRO) programme and other TROs arising in support of safety schemes, development proposals and temporary works.


    2.2 On-going staff shortages within the Traffic Management Section combined with a number of TROs required in support of safety schemes, development proposals and temporary works have delayed the programmed schemes. Incomplete schemes will be carried forward to next year's programme.


    3. Decriminalised Parking Enforcement

    3.1The Borough Council's Transport and Planning Sub-Board has given its support, in principle, to the introduction of decriminalised parking enforcement (DPE) in Gosport, to be operated on an agency basis. However a preliminary financial appraisal of DPE, undertaken by independent consultants, predicts an income from penalty charge notices well below operational costs. Discussions are in progress between the Borough and the County Council to establish how a scheme might be made self-financing to render it financially viable for the Borough. If successful, capital funding will need to be allocated in the second Local Transport Plan 2006 -2011 to meet the initial establishment costs.

    The introduction of DPE in other areas of the county has settled down well with the County Council and relevant Borough Councils being members of the National Parking Adjudication Service (NPAS) Joint Committee. This is the national body, based in Manchester, established under the relevant legislation to provide an independent adjudication service for drivers or vehicle owners wishing to appeal against a penalty charge notice. The county representative, Councillor Phrynette Dickens, is the Assistant Chairman of the NPAS Joint Committee.

    3.3 Regulations are expected to be made during the next few months which will enable authorities already operating DPE to introduce camera enforcement of bus lanes under the Transport Act 2000. These will be superseded in due course by regulations under the Traffic Management Act when the provisions for civil enforcement outside London come into effect, although this is not expected to be until at least 2007. They will include not only parking and bus lane enforcement, but also some other moving traffic offences such as banned turns, no entry and yellow box markings.

    4. Impact Assessments

    4.1 This report provides a position statement only, therefore an impact assessment in terms of the Race Relations (Amendment) Act has not been undertaken.
