1. Summary
1.1 Planning permission is sought to relocate the Waste Transfer Station (WTS) at Solent Industrial Estate, Caird Avenue, New Milton. Neighbouring residents have raised concerns over possible local amenity impacts including water pollution, noise, fumes, dust and increased lorry movements.
1.2 It is considered that the concerns over risk of water pollution can be addressed by appropriate conditions. The traffic is expected to reduce as a result of this proposal and the amenity issues will not be altered as the relocation site is well within an active industrial area. Therefore it is recommended to grant planning permission, subject to conditions.
2. Site
2.1 The proposed site, as shown on the attached plan, comprises a 0.02 hectare plot within the existing Solent Industrial Estate. The site is approximately 120 metres to the southeast of the existing Waste Transfer Station. The industrial estate is screened by woodland which in part are designated as a Site of Importance for Nature Conservation (SINC). The site will use the existing access to the estate. There is an active aggregate processing plant to the south. The nearest houses are approximately 170 metres to the north.
2.2 The proposed WTS was in use prior to the existing larger facility becoming operational in 1994. However, the decrease in the types of waste being received makes the proposed site more economically viable and would allow space to be better rationalised within the industrial estate as a whole.
2.3 The proposed facility has an impermeable concrete surface with all water being directed into a drainage system. It is screened by a two metre high bund and the adjoining woodland.
3. Proposal
3.1 The new site for the WTS is within Solent Industrial Estate, but outside the boundary of the existing WTS (planning permission No. 00054698M). The existing WTS will be removed when the proposed facility is operational. Only one WTS will be in operation at any time.
3.2 The applicant wishes to relocate as a result of downsizing from processing a variety of wastes, to dealing with inert materials from construction and demolition wastes. There will be no processing, just reception of the waste and storage until they are transferred for recycling or landfill. These materials are typically damp with low potential for odour and litter. The proposal is expected to reduce the annual capacity to less than 25,000 tonnes per year and in turn reduce vehicle movements.
4. Development Plan
4.1 Hampshire County Structure Plan Review 1996 - 2011 (Adopted March 2000) MW1 seeks to ensure supply of waste facilities, in particular recycled aggregates and MW2 takes in account possible adverse impacts of any waste developments.
4.2 Hampshire, Portsmouth and Southampton Minerals and Waste Local Plan (Adopted December 1998) Policy 46 concerns proposals for waste recycling, in particular (iii) (a), as location is sited on existing industrial land use.
5. Consultations
5.1 New Forest District Council raises no objection.
5.2 Environmental Health Officer (New Forest District Council) raises no objection subject to the issue of noise being addressed.
5.3 Environment Agency raises no objection subject to a condition to prevent pollution of controlled waters.
5.4 Highway Adviser raises no objection.
5.5 Civil Aviation Bournemouth raises no objection.
5.6 New Milton Town Council raises no objection subject to approval from Environmental Health Authority.
5.7 The local Member, Councillor Banks has been informed.
5.8 The Neighbouring Member, Councillor Rice has been informed.
6. Representations
6.1 Six letters of objection have been received from local residents citing concerns over dust, noise, fumes and traffic.
7. Chief Planning Adviser's Comments
7.1 The proposed location for this development is within an existing industrial estate, therefore it is in accordance with policy subject to the acceptability of noise, dust and traffic impact on local residents.
7.2 Not withstanding the concerns that have been raised it is considered that there are no unacceptable impacts arising from this proposal. The water pollution risks can be addressed by appropriate planning conditions and current controls. Traffic is expected to reduce owing to the smaller capacity and limitations on the types of waste handled. Noise and dust can be dealt with by similar conditions to those covering the existing premises which appear to have successfully mitigated potential nuisance from these sources. All other relevant conditions from the previous permission (No. 00054698M) will be attached to safeguard the environment and protect the amenities of neighbouring residents. Therefore it is recommended to grant planning permission, subject to conditions.
Recommendation
That planning permission in respect of Relocation of the Waste Transfer Station within the Solent Industrial Estate at Solent Industrial Estate, Caird Avenue, New Milton (85850) be granted for the following reason, subject to the following conditions:
Reason for Approval
It is considered that the proposal would be in accordance with the Development Plan (summary attached) and would not materially harm the character of the area or the amenity of local residents and would be acceptable in terms of highway safety and convenience.
Conditions
Commencement
(1) The development hereby permitted shall be begun before the expiration of three years from the date of this permission.
Reason: To comply with Section 91(as amended) of the Town and Country Planning Act 1990.
Protection of the Water Environment
(2) Soakaways shall only be used in areas on site where they would not present a risk to groundwater. The location of any soakaways must be approved in writing by the Waste Planning Authority.
Reason: To prevent pollution of controlled waters.
Hours of Working
(3) Unless otherwise agreed in writing by the Waste Planning Authority no operation authorised or required by this permission shall be carried out and plant shall not be operated except between the following hours: 0730-1800 Monday to Friday and 0730-1300 Saturday. There shall be no working on Sundays or recognised public holidays.
Reason: In the interests of local amenity.
Noise & Dust
(4) The development hereby permitted shall comply with the Noise Mitigation Scheme (received on 20/10/2005) as approved by the Waste Planning Authority. The Scheme shall be implemented as approved for the duration of the permission

(5) The development hereby permitted shall comply with the Dust & Fume Mitigation Scheme (received on 09/11/2005) as approved by the Waste Planning Authority. The Scheme shall be implemented as approved for the duration of the permission
Reason: In the interests of local amenity.
Storage
(6) There shall be no storage of waste outside the holding bay, as shown on plan number 320/WTS 2, and the height of waste shall not exceed four metres.
Reason: In the interests of local amenity.
Facility Useage
(7) The development hereby permitted shall not be put into operation whilst the waste transfer station operating under Permission No. 00054698M remains in use.
Reason: In the interests of local amenity.

Policy MW1
Planning authorities will, through policies and proposals in local plans and day-to-day development control:
(i) seek to ensure an adequate supply of minerals and provision of waste management facilities to meet needs having regard to the need to: maintain the environmental quality and diversity of Hampshire, including the protection of living conditions; safeguard important socio-economic interests; prevent pollution; and protect features of particular environmental or historical importance including those listed in Policy MW3, Sites of Importance for Nature Conservation and historic parks and gardens;
(ii) seek environmental enhancement and public benefits through minerals and waste development;
(iii) conserve and prevent unnecessary sterilisation of mineral resources and encourage efficient use of materials;
(iv) encourage the use of secondary and recycled aggregate materials; and
(v) seek the management of waste in accordance with the following hierarchy:
1. reduction of waste;
2. reuse of waste;
3. recovery of waste (recycling, composting, energy from waste); and
4. waste disposal;
having regard to the proximity principle and the principle of best practical environmental option.
Policy MW2
Permission will be granted for minerals and waste development provided the mineral/waste planning authority is satisfied that:
(i) any adverse environmental or other impacts that the development would be likely to cause are outweighed by a clearly established need for the development; and
(ii) the proposals, where applicable, include a satisfactory scheme of working and landscaping including details of lorry routeing and, in all cases, include satisfactory measures to ensure that the development would not have any unacceptable environmental, traffic or other impact; and
(iii) the proposals, where applicable, provide for the satisfactory and prompt restoration and aftercare of the site to a high standard and to a landform compatible with the local landscape and suitable for an agreed beneficial after-use.

Policy 46
The Waste Planning Authorities will normally permit the use of land and the erection of plant and buildings for the recycling, transfer, storage and other treatment or handling of waste (excluding waste processing facilities covered by Policy 45) provided that:
(i) the proposed site is located near to the likely source(s) of waste and/or the market(s) for the recycled or recovered materials; and
(ii) the proposed site is located close to and has adequate access to the Hampshire Lorry Route Network (as shown on the proposals map), so that the development would not be likely to cause unacceptable traffic impact (including the environmental impact of traffic) on the local highway network; and
(iii) the proposed site is located:
(a) within an existing industrial site or on land which is permitted or allocated for industrial development; or
(b) within an area of land in the countryside that has already been disturbed by permanent development (a brownfield site); or
(c) at a waste disposal landfill or landraising site provided that the proposed development is connected with the waste disposal operation and is for a temporary period commensurate with the operational life of the waste disposal facility; and
(iv) the proposed site is located and the proposal includes adequate measures to ensure that no unacceptable impact would be likely to be caused to the occupants or users of houses, other residential buildings, schools, hospitals and other environmentally sensitive buildings and land uses by reason of noise, dust, fumes, smell or other cause; and
(v) the proposed site is located so as to avoid unacceptable impact on landscape, nature conservation and archaeological interests; and
(vi) the proposed site is located and the proposal includes adequate measures to ensure that there would be no significant risk of pollution or danger to public health or safety; and
(vii) the proposed site is located and, if necessary, the proposal includes landscaping measures to ensure that the development would not cause unacceptable visual intrusion
