114 DECLARATIONS OF INTEREST
Members were mindful that, where they believed they had a personal or personal prejudicial interest in any matter to be considered at the meeting, they should normally at the time of the debate declare their interest and, having regard to the circumstances described in paragraphs 9, 10, 11 and 12 of the County Council's Code of Conduct, consider whether to leave the meeting whilst the matter was discussed. There was a declaration of interest made under Minute 119.
115 MINUTES
The Minutes of the meeting held on 13 February, 2006 were confirmed by the Committee as a correct record and signed by the Chairman, subject to the following amendments:
Minute No. 104 - amended to reflect that Councillor Mrs A. Buckley will Chair the Site Liaison Panel
Minute No. 106 - resolution amended to reflect the condition imposed about contractors vehicles not to use Chilcomb Crescent.
116 CHAIRMAN'S COMMUNICATIONS
The Chairman reported that following the decision by the Committee on 19 October 2005 (Minute No. 45 refers) to refuse permission for Rookery Farm, the operator had appealed. An enforcement notice had been served that required cessation of the operation, which the operator had also appealed against. No date for the inquiry had been announced and Members were advised that they would be kept informed.
The Chairman also reported that Alun Trott, Highway Development Control Manager would be retiring after many years of service and was in attendance at the meeting. The Committee thanked Alun for his dedicated service over the years to the County Council and wished him well in his retirement.
117 EXTENSION TO FARM HOUSE INCLUDING DEMOLITION OF SINGLE STOREY LEAN TO AT HAZELEY FARM, HAZELEY HEATH, HARTLEY WINTNEY (APPLICATION NO. 05/02647/CMA) (COUNTY COUNCIL REFERENCE NO. HRG001)
The Committee received a deputation from Mr J. Arnold in respect of this item.
The Committee considered the report of the Chief Planning Adviser (Item 6 in the Minute Book) on an application to demolish an existing lean-to and erect a two-storey extension on the southern aspect of Hazeley Farmhouse. It was noted that the extension would provide a shower room and WC at ground floor level, with a lift to a new bedroom at first floor level with an en-suite toilet. The tenant of the property had a child with special needs and the purpose of the lift would be to provide wheelchair access to the first floor.
In considering this item, it was brought to the attention of the Committee that the current tenant with the special needs child would be moving out shortly and therefore the necessary modifications to the extension would not be necessary. The Committee also noted the comments made by the deputation concerning the impact of the extension on the setting of the neighbouring listed building.
RESOLVED:
That planning permission for an extension to the farm house at Hazeley Farm, Hazeley Heath, Hartley Wintney (application no. 05/02647) be refused because of the adverse impact on the setting of the neighbouring listed building.
118 VARIATION OF CONDITION 9 OF PLANNING PERMISSION APP/Q1770/A/03/1118751 TO ALLOW 44 HGV MOVEMENTS ON WEEKDAYS AND 23 ON SATURDAYS AT AMBERVALE FARM, PITMORE LANE, SWAY (APPLICATION NO. 87141) (COUNTY COUNCIL REFERENCE NF075)

The Committee considered the report of the Chief Planning Adviser (Item 8 in the Minute Book) on the application for variation of Condition (9) of APP/Q1770/A03/1118751 (75507 NF075) to allow 44 Heavy Goods Vehicles (HGV) movements per day (Monday to Friday) and 22 on Saturday at Ambervale Farm, Pitmore Lane, Sway.
RESOLVED:
That planning permission for variation of condition (9) of APP/Q1770/A/03/1118751 (75507NF075) to allow 44 HGV movements per day (Monday to Friday) and 23 on Saturdays at Amber Vale Farm, Pitmore Lane, Sway be refused for the reasons specified in the report.
119 RECYCLING FACILITY AT BUNNY LANE LANDFILL, BUNNY LANE, TIMSBURY, ROMSEY (APPLICATION NO. TVS01051/9) (COUNTY COUNCIL REF. TV066)
Mr J. Salmon (Land and Minerals Management Ltd) and Mr P.J. Liddell (Liddell Estates Ltd) made deputations in respect of this item. The Committee also received representations from the local Ward Member, Councillor M.J. Woodall.
The Committee considered the report of the Chief Planning Adviser (Item 9 in the Minute Book) on the application for a recycling facility at Bunny Lane, Timsbury near Romsey. It was noted that the facility would initially be ancillary to the infilling of the Hunts Farm quarry opposite Bunny Lane landfill, which had consent until 30 June 2009. However, if operational consent was granted by the Environment Agency for tipping to recommence at the adjacent Bunny Lane Landfill the intention would be to retain the recycling facility until the completion of the Bunny Lane Landfill, which had planning permission for waste tipping until 10 September 2011.
In considering the application, the Committee considered that the 07.30 hours start time of on-site machinery on Saturdays was too early. Accordingly it was put forward that on-site machinery should not start before 08.00 hours on Saturdays
Councillor M. Cooper declared a non-prejudicial interest in this item as Member of the Test Valley Borough Council Executive, which had previously objected to the proposal.
RESOLVED:
That, subject to a financial contribution for the improvement and maintenance of the western part of Bunny Lane and an additional condition that on-site machinery cannot start before 08.00 hours on Saturdays, planning permission in respect of operation of a recycling facility at Bunny Lane landfill site (TVS01051/9) be granted for the reasons specified in the report and subject to conditions specified therein.
120 APPLICATION FOR MAP MODIFICATION ORDERS TO UPGRADE TWYFORD ROAD USED AS A PUBLIC PATH 16 AND CHILCOMB BRIDLEWAY 3 TO BYWAYS OPEN TO ALL TRAFFIC
Mrs L. Dyer, Secretary of Hockley Golf Club and Mr Stobbart on behalf of Twyford Parish Council made deputations in respect RUPP 16 of this item. The Committee also received representations from the local Ward Member, Councillor Mrs Jackie Porter.
The Committee considered the report of the Director of Recreation and Heritage (Item 13 in the Minute Book) on an applications to amend the definitive map by upgrading the routes shown as Twyford Road Used as a Public Path (RUPP) 16 and Chilcomb Bridleway 3 to Byway open to All Traffic (BOAT).
In considering RUPP 16, the Committee requested that urgent consideration be given to the making of the Traffic Regulation Order prohibiting use by public motorised vehicles.
RESOLVED:
(a) That, an Order be made to upgrade Twyford RUPP 16 to Byway Open to All Traffic, and it be recorded in the definitive statement with a maximum width of 6.0 metres (between point A and point B on Appendix 1 to the report) and 7.3 metres (between point B and point C on Appendix 1 to the report).
(b) That an Order be made to upgrade Chilcomb Bridleway 3 to Byway Open to All Traffic, and it be recorded with a maximum width of 3.0 metres.
121 APPLICATION TO IMPORT, STORE AND SELL PRIMARY AND RECYCLED AGGREGATES AND RECYCLED SOILS AT HOLBURY WASTE TRANSFER STATION, PARK LANE, HOLBURY (APPLICATION NO. 86948) (COUNTY COUNCIL REF: NF218)
The Committee considered the report of the Chief Planning Adviser (Item 7 in the Minute Book) on an application in respect of recycled aggregates and soils at Holbury Waste Transfer Station.
RESOLVED:
That planning permission in respect of application to import store and sell primary and recycled aggregates and recycled soils at Holbury Waste Transfer Station, Park Lane, Holbury (86948) be refused for the reasons specified in the report.
122 APPLICATION FOR A DEFINITE MAP MODIFICATION ORDER FOR THE ADDITION TO THE DEFINITIVE MAP A FOOTPATH BETWEEN RINGWOOD ROAD AND PLAYING FIELDS IN THE PARISH OF BRANSGORE
The Committee considered the report of the Director of Recreation and Heritage (Item 10 in the Minute Book) on an application for a definitive map modification order for the addition to the definitive map of a footpath between Ringwood Road and playing fields in the parish of Bransgore.
RESOLVED:
That the application to add a footpath between the playing fields and Ringwood Road, in the parish of Bransgore, be refused for the reasons as specified in the report.
123 APPLICATION FOR A MAP MODIFICATION ORDER FOR THE ADDITION TO THE DEFINITIVE MAP OF A FOOTPATH BETWEEN VECTIS ROAD AND MARINE DRIVE WEST AT BARTON-ON-SEA IN NEW MILTON TOWN
The Committee considered the report of the Director of Recreation and Heritage (Item 11 in the Minute Book) on an application for a map modification order for the addition to the definitive map of a footpath between Vectis Road and Marine Drive West at Barton-on-Sea in New Milton Town.
RESOLVED:
(a) That a Map Modification Order be made to record the route A-B-C-D, as shown on the attached map to the report, as a public footpath.
(b) That the width of the path be recorded as a minimum of 1.0 metre between points A-B-C, and a minimum of 1.5 metres between points C-D as shown on the attached map to the report.
124 APPLICATION FOR A PUBLIC PATH DIVERSION ORDER FOR FOOTPATH NO. 3 IN THE PARISH OF STOCKBRIDGE
The Committee considered the report of the Director of Recreation and Heritage (Item 12 in the Minute Book) on an application for a Public Path Diversion Order for Footpath No.3 in the parish of Stockbridge.
RESOLVED:
That an Order be made for the diversion of part of Footpath No. 3 in the parish of Stockbridge in the interest of the public. The diverted section of the footpath will commence at point A (GR436482 134274) on the parish boundary and will proceed south and east along a clearly defined lane, with a minimum width of 2 metres and hedged with mature trees, to reach point C (GR436590134218) as shown on the plan.
