Children (Performances) Regulations - Body of Persons Approval

1 Summary

1.1 The following decisions are sought:

1.2 That the Executive Lead Member for Children's Services approves:-

(a) the implementation of the attached policy for the granting of a Body of Persons Approval; and

(b) the use of the attached standard contract in each case where the County Council grants a Body of Persons Approval.

1.3 That the Executive Lead Member for Children's Services delegates authority to the Director of Children's Services:

(a) to grant Body of Persons Approvals on behalf of the County Council; and

(b) to make necessary minor amendments to the attached policy and to the attached standard contract.

2 Reason

2.1 This decision supports Aims 1 and 4 of the Corporate Strategy by "Maximising life opportunities" and "Building safe and strong communities".

2.2 This decision also supports all 5 Aims of The Children Act 2004 by seeking to help ensure that children are healthy, stay safe, enjoy and achieve through learning, make a positive contribution to society and increase the likelihood of economic well-being.

3 Other Options considered and rejected:

3.1 The other option is to not authorise any such group via a Body of Persons Approval system but this is contrary to the legislative expectations of the Local Authority in relation to the Children and Young Persons Act 1963.
