1. Summary
1.1 The following decision is sought:
That the Executive Member for Recreation and Heritage refuses the second tranche payment to the Sculpture Trust and that the sum available is allocated to discharging the Council's obligations to the Trust staff under employment law, and an agreed sum is allocated as a legacy to the Trust in its new incarnation, subject to conditions.
2. Reasons
2.1 When the report recommending the cessation of Funding to the Trust had been published, the Head of Arts Tourism and Marketing met with the Director of the Sculpture Trust on 9 January to inform her of the proposed Decision. The decision was confirmed at the decision Day 19 January 2006. Payment of the grant would be made in two equal payments in April and August covering the period up to December 2006
2.2 An interim report relative to the way forward was to be presented to Hampshire County Council on or before 5 June, with complete information provided by 17 July. The Trust requested a postponement of a decision until Septemberby virtue of progress on negotiation with a third party. These negotiations are not concluded and the trust has no settled way forward and has not planned or presented any public activity in the period.
