11. APOLOGIES FOR ABSENCE

An apology for absence was received from Councillor Cartwright as he was

attending a South East Regional Management Board meeting for Fire Authorities as

Chairman of the Hampshire Fire Authority.

12. DECLARATIONS OF INTEREST

Members were mindful that, where they believed they had a personal or personal

prejudicial interest in any matter to be considered at the meeting, they should

normally at the time of the debate declare their interest and, having regard to the

circumstances described in paragraphs 9, 10, 11 and 12 of the County Council's

Code of Conduct, consider whether to leave the meeting whilst the matter was

discussed.

13. MINUTES

The Minutes of the meeting held on 6 September 2006 were confirmed by the

Committee and signed by the Chairman

Arising thereon:

Minute 157 - Importation of Chalk for Storage, Reuse and Restoration at

Renown Quarry, Well Lane, Lower Froyle (Application No. F22196/007/CMA)

(County Council Ref: EA027)

Members noted that the restoration and removal of buildings at Renown Quarry

could not commence until the site was fully excavated and/or permission expired in

2042.

14. CHAIRMAN'S COMMUNICATIONS

The Chairman reminded Members that a special meeting of the Committee would be

held on Wednesday 8 November 2006 to consider the Ashburton Court application.

The Chairman reminded Members that the next site visit would take place on

Monday 13 November 2006.

The Chairman announced that arrangements were underway for an Annual Members

Tour to visit various sites in the County. Members would receive confirmation once

a suitable date in December had been identified. Any requests to visit specific sites

should be directed to the Chief Planning Adviser.

15. WINNING AND WORKING OF SAND WITH RESTORATION AT LOW

LEVEL TO NATURE CONSERVATION USES TO INCLUDE A

SOUTHERN EXTENSION TO THE EXISTING EXTRACTION AREA, THE

RETENTION OF THE PROCESSING PLANT AND THE IMPORTATION

OF SMALL QUANTITIES OF MINERAL AT LAND AT FRITHEND

QUARRY, BORDON (APPLICATION NO. F30633/012/CMA)

(COUNTY COUNCIL REF: EH121)

Messrs B. G. Davey, F. Cooper, R. Skehens (Managing Director of Grundon Waste

Management), B. Davey Jnr on behalf of Dr R.Trout who was unable to attend due

to illness and Mrs M. Comber made deputations in respect of this item.

Councillors Carew and Kemp-Gee also attended the meeting and spoke in opposition

to the proposals on the grounds (inter alia) of alternative restoration.

The Committee considered the report of the Chief Planning Adviser (Item 6 in the

Minute Book) on an application for planning permission for the winning and

working of sand with restoration at low level to nature conservation uses to include a

southern extension to the existing extraction area, the retention of the processing

plant and the importation of small quantities on mineral land at Frith End Quarry,

Bordon.

In considering the application, the Committee considered that the main issues

identified at the meeting on 19 July; landscaping, lorry traffic, nature conservation,

working below the water table and revised restoration had not been addressed.

Further, more detail on the Great Crested Newts, Sand Martins and the reason why

inert waste had to be imported rather than using clay from the site needed further

investigation.

Members were disappointed to note that a meeting between Grundon Waste

Management and the objectors had not taken place.

Members agreed to defer further consideration of the application to the next meeting

of the Committee on 29 November to allow the Officers time to provide further

information on how nature conservation interests, including that of the Great Crested

Newts, Sand Martins and Red Data Book species, would be addressed.

RESOLVED:

That the planning application in respect of the winning and working of sand with

restoration at low level to nature conservation uses to include a southern extension to

the existing extraction area, the retention of the processing plant and the importation

of small quantities of mineral at Land at Frith End Quarry, Bordon

(Application No. F30633/012/CMA) be deferred and that a report covering the

concerns expressed by the Committee be submitted to the next meeting of the

Committee on 29 November 2006.

16. VARIATION TO THE PERMITTED WASTE MANAGEMENT ACTIVITIES

(USE OF THE YARD AND FORMER PAPER STORE/MATERIAL

RECOVERY FACILITY FOR WASTE STORAGE AND TRANSFER

PURPOSES AND THE SITING OF STORAGE CONTAINERS/CABINS) AT

OTTERBOURNE WASTE TRANSFER STATION, POLES LANE,

OTTERBOURNE (APPLICATION NO. 06/02464/HCS W00965/12)

Mr J. Collis (Project Director of Veolia) made a deputation in respect of this item.

Councillor Mrs Bailey also attended the meeting and spoke on behalf of the local

objectors and the parish council about lorry movements and circulated to Members

of the Committee a list of traffic information received from the applicant detailing

lorry movements for November 2005 and January, March and May 2006.

The Committee considered the report of the Chief Planning Adviser (Item 7 in the

Minute Book) on an application for planning permission for the variation to the

permitted waste management activities at Otterbourne Waste Transfer Station.

In considering the application, Members noted that discussions had been held with

the applicant about the number of traffic movements and that 280 per day had been

agreed. The Committee considered that Condition (11) should be amended to reflect

the lorry movements to and from the site during the week following Easter and the

week following the Christmas period.

RESOLVED:

That variation to the permitted waste management activities (use of the yard and

former paper store/material recovery facility for waste storage and transfer purposes

and the siting of storage containers/cabins) at Otterbourne Waste Transfer Station,

Poles Lane, Otterbourne (Application No. 06/02464/HCS W 00965/12) be permitted

for the reasons set out in the report and subject to the conditions specified therein, a

legal agreement restricting lorry numbers and the amendment to Condition (11) as

detailed above.

17. ROOKWOOD CENTRE, PENSHURST WAY, EASTLEIGH -

RETROSPECTIVE CHANGE OF USE FROM PRIMARY SCHOOL TO

OFFICE USE FOR CHILDRENS' SERVICES

(APPLICATION NO. S/06/57787) (COUNTY COUNCIL REF. EAG002)

The Committee considered the report of the Chief Planning Adviser (Item 8 in the

Minute Book) on a planning application for the retrospective change of use from a

former Infant School to Office use by the Childrens' Services Department at

Rookwood Centre, Penshurst Way, Eastleigh.

In considering the application, Members considered that the Rookwood Centre

should be encouraged to implement a travel plan and that Condition (1) be

amended so that 28 parking spaces are provided.

RESOLVED:

That planning permission in respect of retrospective change of use from Infant

School to Office use for Childrens' Services at Rookwood Centre, Penshurst Way,

Eastleigh, SO50 4RJ (Application No. S/06/57789) be granted for the reason

set out in the report and subject to the conditions specified therein and an

amendment to Condition (1) as detailed above.

18. PROPOSED DEEP SAND EXTRACTION IN TANDEM WITH EXISTING

(AND PROPOSED) GRAVEL EXTRACTION WITH RESTORATION TO

PARKLAND LANDSCAPE AT NEA FARM QUARRY, BLASHFORD AND

BLUE HAZE QUARRIES, SOMERLEY (APPLICATION NO. 06/88238)

(COUNTY COUNCIL REF. NF254)

Mr A. Cadell made a deputation in respect of this item.

Councillor Mrs K. Heron also attended the meeting and spoke in opposition to the

proposal on the grounds of the traffic lights operating at peak times.

The Committee considered the report of the Chief Planning Adviser (Item 9 in the

Minute Book) on an application for planning permission for deep sand extraction in

tandem with existing (and proposed) gravel extraction with restoration to an

agricultural parkland landscape at Nea Farm Quarry, Blashford and Blue Haze

Quarries, Somerley.

In considering the application, Members considered that the possibility of widening

the ride after the cessation of the operation should be explored.

RESOLVED:

That planning permission be granted for deep sand extraction in tandem with

existing (and proposed) gravel extraction with restoration to an agricultural parkland

landscape at Nea Farm Quarry, Blashford and Blue Haze Quarries, Somerley, for the

reason set out in the report and subject to the conditions specified therein and

amendment to Condition (45) in such form as the Chief Planning Adviser shall

determine.

19. YOKESFORD HILL INDUSTRIAL ESTATE - WASTE RECYCLING SKIP

STORAGE AND STORAGE OF PORTALOOS ON LAND TO THE NORTH

EAST OF YOKESFORD HILL INDUSTRIAL ESTATE (APPLICATION

NOS. 06/02323/CMAS AND 06/02326/CMA) (COUNTY COUNCIL REF

TV188)

Messrs A. Partridge (agent for Ace Liftway) and P. Liddle (Ace Liftway) made

deputations in respect of this item.

The Committee considered the report of the Chief Planning Adviser (Item 10 in the

Minute Book) on two retrospective applications for temporary uses of land and

buildings for a period of two years from the date of any permission that may be

granted within and to the north of the existing Yokesford Hill Industrial Estate.

In considering the application, Members considered that the conditions relating to

traffic movement were confusing and the Chief Planning Adviser confirmed that he

would seek clarification and amend the Conditions accordingly.

RESOLVED:

(i) That retrospective planning permission for the temporary storage of inert screen

materials, concrete, crushed rubble, grit, timber and clean concrete, crushing of

concrete (28 days) and sorting of lightweight materials and processing and

storage of wood, portaloos and skips, at land to the north east of the existing

waste transfer and recycling centre, Yokesford Hill Industial Estate

(06/02323/CMAS) be granted for the reason set out in the report and subject to

the conditions specified therein.

(ii) That retrospective planning permission for temporary overnights storage of skips

and vehicles, temporary storage of astro-turf and storage of portaloos in

Building 2 at the Waste Centre, Yokesford Hill Industrial Estate, Yokesford Hill,

Romsey (06/022326/CMAS) be granted for the reason set out in the report and

subject to the conditions specified therein.

(iii) That the vehicle movement conditions to be amended in such form as the Chief

Planning Adviser shall determine.

20. APPLICATION FOR A DEFINITIVE MAP MODIFICATION ORDER TO

RECORD A RESTRICTED BYWAY IN THE PARISH OF MARTIN

The Committee considered the report of the Director of Recreation and Heritage

(Item 11 in the Minute Book) on an application for a Definitive Map Modification

Order to record a restricted Byway in the Parish of Martin.

RESOLVED:

That a Definitive Map Modification Order be made to add a restricted byway, of a

width of 4.5 metres, from Martin Bridleway 18 to Bishopstone Bridleway 29, as

shown between points A and B on the map attached to the report.

21. APPLICATION FOR A PUBLIC PATH EXTINGUISHMENT ORDER FOR

FOOTPATH NO 16 IN THE PARISH OF PAMBER

The Committee considered the report of the Director of Recreation and Heritage

(Item 12 in the Minute Book) on an application for a Public Path Extinguishment

Order for Footpath No. 16 in the Parish of Pamber.

RESOLVED:

That an Order be made under Section 118 of the Highways Act 1980 for the

Extinguishment of Footpath No.16 in the Parish of Pamber, on the grounds that it is

no longer needed for public use.

22. EXCLUSION OF THE PRESS AND PUBLIC

That in relation to Minute 23, the public be excluded from the meeting during the

following, as it is likely, in view of the business to be transacted or the nature of

the proceedings that if Members of the public were present during that item there

would be disclosure to them of exempt information within Paragraphs 3 and 6 of

Part 1 of Schedule 12A to the Local Government Act 1972 and further that in all

circumstances of the case, the public interest in maintaining the exemption

outweighs the public interest in disclosing the information, for the reasons set out in

the report.

23. ASHFIELD TYRE DEPOT, ASHFIELD SAWMILL, SOUTHAMPTON

ROAD, ROMSEY

Councillor M. G. Cooper declared a personal interest as living in the locality.

The Committee considered the exempt report of the Chief Planning Adviser

(Item 14 in the Minute Book) on the progress of determining a planning application.

RESOLVED

(i) That enforcement action be taken at Ashfield Tyre Deport in the event that no

progress is made to resolving the matter before the end of March 2007.

(ii) That further progress reports be received at future meetings.
