66. DECLARATIONS OF INTEREST


Members were mindful that, where they believed they had a personal or personal prejudicial interest in any matter to be considered at the meeting, they should normally at the time of the debate declare their interest and, having regard to the circumstances described in paragraphs 9, 10, 11 and 12 of the County Council's Code of Conduct, consider whether to leave the meeting whilst the matter was discussed.

67. MINUTES

    The Minutes of the meeting held on 10 January 2007 were confirmed by the Committee and signed by the Chairman, subject to the following amendments:

    Councillor Hockley was absent as he was attending his Mother's funeral.

Councillor Cooper's personal interest was not prejudicial in respect of Minute 54 Shredding of tyres for removal from site using existing buildings, repairs to hardstandings and concrete bases and to install a security fence at Afropa Recycling Centre, Ashfield Sawmill Site, Southampton Road, Romsey.

68. CHAIRMAN'S COMMUNICATIONS

    The Chairman reported that the Working Party established to discuss a pilot scheme for the cross examination of deputees would meet on 1 March at 10am.

    The Chairman advised that 1:1 training on Planning or Rights of Way matters for new Members could be arranged if needed. If there were sufficient numbers more formal training could be organised. He asked Members to let Officers know if there were any specific training needs.

69. TRAVEL PLANS

The Director of Environment gave a presentation on Travel Plans to which all Members of the County Council had been invited. He advised that the Smarter Choices Strategy formed a key element of the Local Transport Plan strategy in increasing accessibility, reducing congestion and improving the environment by reducing the need to travel, the distance travelled and the use of the private car. A range of measures had been introduced which included travel planning for schools, workplaces and residential areas to personalised journey planning and the implementation of car sharing schemes.

Members noted that a Travel Plan was a package of measures aimed at widening travel choices by all modes of transport and cutting unnecessary car use. The measures were aimed at the site occupier, staff, visitors, customers and the environment to widen choices. Formal travel plans focussed on statutory requirements and were development related, for example the Ashburton Court redevelopment travel plan. Voluntary travel plans were developed in response to a particular transport need, for example the Romsey Road employers in Winchester and Hampshire County Council's own staff travel plan.

Members further noted several case studies which had focussed on formal and voluntary travel plans developed in conjunction with Junior and Infant Schools in the area and a Hands Up School Survey in 2003 - 2005 on how pupils travelled to schools and how pupils would like to travel to school in Hampshire which had indicated that there had been a steady increase in pupils either walking or travelling by pedal cycle and a decrease in those pupils arriving by car.

Members requested a copy of the Draft Guide to Development Related Travel Plans and the Director of Environment agreed to provide Members with a hyperlink to the Travel Plan website so that they could access the latest draft and download a copy or contact the Smarter Choices and Travel Plan Manager for a hard copy.

    RESOLVED:

    That the Director of Environment be thanked for his informative presentation.

70. NEW 210 PLACE PRIMARY SCHOOL WITH A SPECIALIST VISUAL

IMPAIRMENT RESOURCE PROVISION UNIT, TO REPLACE EXISTING

SCOLA BUILDING AT KINGS COPSE PRIMARY SCHOOL,

KINGS COPSE ROAD, HEDGE END, SOUTHAMPTON

(APPLICATION NO. S/06/58445) (COUNTY COUNCIL REF. EAE037)

Mrs Esther Jones, Headteacher at Kings Copse Primary School made a deputation in

respect of this item. She was accompanied by Angela Dorrington, the Chair of

Governors at the school for support.

Councillor D. R. Blampied also attended the meeting and spoke as Local Member in

support of the proposed planning application and additional car parking spaces.

The Committee considered a report of the Chief Planning Adviser (Item 14 in the

                  Minute Book) on an application for planning permission for a new 210 place

                  primary school with a specialist Visual Impairment Resource Provision Unit to

                  replace the existing SCOLA building at Kings Copse Primary School,

                  Kings Copse Road, Hedge End, Southampton.

                  In considering the application, Members considered that details of where contractors

parked their vehicles and where materials are stored should be included in a

condition and the Chief Planning Adviser confirmed that he would include a

suitable condition. In addition he agreed to elevate the Advice Notes at (9) and (10)

to be redrafted as conditions.

Members supported the park and walk (Norman Rodaway Pavilion) scheme,

considered that additional sufficient car parking on site should be provided for

coaches and taxis to pick up and drop off at the school and supported the need for

off site parking for parents. The Chief Planning Adviser confirmed that an area of

additional parking provision could be provided within the scheme providing 4 more

spaces but stressed it was up to the School to manage how this space would be used.

Members considered that Condition 7 relating to landscaping should be amended

so that details are provided prior to development commencing rather than within

12 months of the development.

                  Members noted the provision of spaces per classroom as indicated in the Hampshire

Parking Strategy and Standards but supported the need for additional parking for

                  parents.

                  There was a proposal to defer consideration of the item to allow detailed plans

showing the elevations of the building, details of car parking issues and height of

the two parallel pitch roof blocks to be presented, which was proposed, seconded

and defeated after a vote.

                  RESOLVED:

                  That planning permission in respect of a new 210 place primary school, with a

specialist Visual Impairment Resource Provision Unit, to replace existing SCOLA

                  building at Kings Copse Primary School, Kings Copse Road, Hedge End,

Southampton (Application No. S/06/58445), be granted for the reason set out in the

report subject to the additional parking provision, the conditions specified in the

report and the additional conditions as amended and detailed above.

71. COMMONS REGISTRATION ACT 1965. COMMONS REGISTRATION

(NEW LAND) REGULATIONS 1969. APPLICATION TO REGISTER

THE TRIANGLE AT THE JUNCTION OF STOCKERS AVENUE AND

WESTLEY CLOSE, WINCHESTER AS TOWN OR VILLAGE GREEN

A copy of representations received from Mr Weeks were circulated to Members of

the Committee enclosing additional information that he wished to be made available

in relation to the Committee's consideration of the item.

                  The Committee considered a report of the Chief Executive (Item 7 in the Minute

                  Book) on an application to register land known as "The Triangle" as town or village

green.

                  RESOLVED:

                  That in connection with the application to register "The Triangle" at the junction of

Stockers Avenue and Westley Close, Winchester as town or village green, a non-

statutory public inquiry be held, an inspector being appointed in respect of the same,

the inspector to prepare a written report for the registration authority, with a

recommendation to accede to or reject the application.

72. COMMONS REGISTRATION ACT 1965. COMMONS REGISTRATION

(NEW LAND) REGULATIONS 1969. APPLICATION TO REGISTER LAND

AT LYMINGTON BOTTOM, FOUR MARKS AS TOWN OR VILLAGE

GREEN

The Committee considered a report of the Chief Executive (Item 8 in the Minute

Book) on an application to register land at Lymington Bottom.

                  RESOLVED:

                  That the application to register land at Lymington Bottom, Four Marks be rejected

as not duly made under the Commons Registration (New Land) Regulations 1969

for the reasons set out in Counsel's opinions dated 29 August 2006 and

10 December 2006.

73 APPLICATION FOR A DEFINITIVE MAP MODIFICATION ORDER TO

RECORD HOUGHTON FOOTPATH 6 AND KINGS SOMBORNE

FOOTPATH 11 AS BRIDLEWAYS

the Committee enclosing additional information that she wished to be made

available in advance of the meeting in relation to the Committee's consideration on

the item.

The Committee considered a report of the Director of Recreation and Heritage

(Item 9 in the Minute Book) on an application for a Definitive Map Modification

Order to record Houghton Footpath 6 and Kings Somborne Footpath 11 as

Bridleways.

RESOLVED:

That the application be refused.

74. APPLICATION FOR A DEFINITIVE MAP MODIFICATION ORDER TO

RECORD BROUGHTON FOOTPATH 13 AND HOUGHTON FOOTPATH 1

AS BRIDLEWAYS

The Committee considered a report of the Director of Recreation and Heritage

RESOLVED:

That the application be refused.

75. APPLICATION FOR A MAP MODIFICATION ORDER TO RECORD A

FOOTPATH BETWEEN ASHFORD CLOSE AND THE DISUSED

RAILWAY, FORDINGBRIDGE

The Committee considered a report of the Director of Recreation and Heritage

(Item 11 in the Minute Book) on an application to record a Footpath between

Ashford Close and the Disused Railway, Fordingbridge.

RESOLVED:

That the application for a Map Modification Order be refused.

76. APPLICATION FOR A MAP MODIFICATION ORDER FOR THE

ADDITION OF A BRIDLEWAY FROM SKEW ROAD, FAREHAM TO THE

COUNTY BOUNDARY

The Committee considered a report of the Director of Recreation and Heritage

(Item 12 in the Minute Book) on an application for a Definitive Map Modification

Order for the addition of a bridleway from Skew Road, Fareham to the County

Boundary.

RESOLVED:

That the application for a Definitive Map Modification Order to record a bridleway

from Skew Road, Fareham to the County Boundary be refused.

77. CLARIFICATION OF CONDITION (11) TO APPLICATION NO.

06/02464/HCS W00965/12 AT OTTERBOURNE WASTE TRANSFER

STATION, POLES LANE, OTTERBOURNE

The Committee considered a report of the Chief Planning Adviser (Item 13 in the

Minute Book) seeking clarification of Condition (11) to application No.

06/02464/HCS W00965/12 at Otterbourne Waste Transfer Station, Poles Lane,

Otterbourne.

RESOLVED:

That the resolution of the Regulatory Committee on 18 October 2006 Condition (11)

be confirmed as follows:

(11) The maximum average daily number of lorry movements to and from the site

shall be restricted to 280 per day (140 in and 140 out), except during the two week

periods following both Christmas and Easter. The maximum average daily number

of lorry movements shall be calculated as an average over any two week working

period (ie no more than 11 working days). A daily record of lorries entering and

leaving the site shall be kept at the site and made available to the Waste Planning

Authority within 7 days of a written request.

Reason: To limit the volumes of traffic in the interests of the amenity of residents on

and near the approaches to the site.

78. EXCLUSION OF THE PRESS AND PUBLIC

RECOMMENDATION

That in relation to the following item the public be excluded from the meeting, as it

is likely, in view of the nature of the business to be transacted or the nature of the

proceedings, that if Members of the public were present during the item there would

be disclosure to them of exempt information within Paragraphs 3 and 6 of Part 1 of

Schedule 12A to the Local Government Act 1972 and further that in all

circumstances of the case, the public interest in maintaining the exemption

outweighs the public interest in disclosing the information, for the reasons set out in

the report.

PART II - CONFIDENTIAL/EXEMPT ITEM

79. ASHFIELD TYRE DEPOT, ASHFIELD SAWMILL, ROMSEY

The Committee agreed that Councillor R. J. Perry as Local Member should be

permitted to attend and participate in the confidential debate and that

Councillor Mrs E. M. Byrom could remain in the meeting but not participate in the

debate.

Councillor M. G. Cooper declared a personal but non prejudicial interest as living in

the locality.

The Committee considered the exempt report of the Chief Planning Adviser (Item 16

in the Minute Book) on the expediency of taking enforcement action.

RESOLVED:

That a decision on enforcement action at the Ashfield Tyre Depot be deferred to

enable a further detailed report to be received. In the meantime the Regulatory

Committee to receive an update at its meeting on 14 March 2007.
