1. Recommendation

That it is noted that the Director of Environment, in consultation with the Chief Executive, will take enforcement action to secure the removal of those tyres that do not benefit from the terms of the planning permission (No. TVS.03913/2) for storage at the former Ashfield Sawmill, unless an acceptable strategy for tyre removal and a planning application for tyre processing are submitted, by 13 April 2007 and 23 May 2007 respectively.

2. Commentary

2.1 Since the last confidential report to the Regulatory Committee on 7 February 2007 there has been little progress in reducing the number of unauthorised tyres at the site and a planning application has not been forthcoming. Therefore the deadline of 31 March 2007 has not been met.

2.2 However, the landowner has recently appointed planning consultants to prepare a strategy (the `strategy') to remove the unauthorised tyres from the site and promote a planning application for tyre processing. A written undertaking (attached as an appendix) has been submitted confirming that the strategy will be submitted to the County Council by 13 April 2007, with the application to follow by 23 May 2007.

2.3 It is still considered that resolving the issues through a planning application is preferable to enforcement action. Therefore, it is recommended that enforcement action be deferred pending the submission of the strategy and a planning application. In the event that the two deadlines are not met, that the strategy is unacceptable, or the application is subsequently refused, then enforcement action will be taken to resolve the breaches of planning control.
