178. DECLARATIONS OF INTEREST

All Members who believe they have a personal or prejudicial interest in any matter

to be considered at the meeting must declare that interest and, having regard to the

circumstances described in paragraphs 9, 10, 11 and 12 of the County Council's

Code of Conduct, consider whether to leave the meeting whilst the matter is

discussed, save for exercising any right to speak in accordance with paragraph 12

of the Code. The declaration should be made at the time of the relevant debate.

179. MINUTES

The Minutes of the Meeting held on 28 November 2007 were confirmed by the

Committee and signed by the Chairman, subject to the following amendment.

Arising thereon:

Minute 171 - Restoration of a Lake in Former Gravel Workings, for recreational

use including a new causeway to divide the existing lake into two lakes, one for

fishing and one for canoeing at the River Valley Lake, East of Sandhurst Road,

Yateley (Application No. 07/02026/CMA) (County Council Ref. HR037).

That the last sentence in the fourth paragraph be amended to read:

Further that a Clause be added to the Section 106 Agreement to allow the use of

parking and facilities for lake users at the adjacent site. Further, that a new

condition be added that the maximum duration of works from the time the

operation commences be a maximum of 15 months.

180. CHAIRMAN'S COMMUNICATIONS

The Chairman reminded Members that a noise appreciation presentation would be

held immediately following the meeting.

The Head of Planning and Development advised that the application for a

proposed concrete recycling site, to recycle concrete waste into a secondary

aggregate at C. A. Stevens Transport, Old Stockbridge Road, Grateley, near

Andover (Application No. 07/02133/CMAN) (County Council Ref. TV237) had

been deferred at the meeting on 17 October 2007 for a noise report. The

application had since been withdrawn by the applicant.

181. SITE VISITS - LOCAL CODE OF CONDUCT FOR COUNCILLORS AND

OFFICERS DEALING WITH PLANNING MATTERS

The Committee considered a report of the Head of Planning and Development

(Item 10 in the Minute Book) on the Local Code of Conduct for Councillors and

Officers dealing with planning matters.

The Head of Planning and Development reported that a training session for

Members on site visits in November emphasised that these were not to be used as

a venue for discussion or lobbying and the proposals as outlined in the report were

followed by other authorities in Hampshire and throughout England.

In considering the proposal that site inspections undertaken by the Regulatory

Committee in respect of planning matters should be unaccompanied by

Stakeholders (applicant, landowner, objectors, district and parish councils except

for the presence of appropriate officers),some Members considered that Local

Members should continue to be invited to attend and some Members felt that

notwithstanding the concern about probity issues, Members of the public should be

allowed to attend site visits.

There was a proposal to defer the item to allow further examination of the issues

which was proposed, seconded and agreed.

RESOLVED:

That the item be deferred to allow time to further examine the issues and report

back to Committee in due course.

182. WASTE RECYCLING AND TRANSFER FACILITY AT UNIT 1A,

HOLLYBUSH INDUSTRIAL PARK, HOLLYBUSH LANE, ALDERSHOT

(APPLICATION NO. 07/00897) (COUNTY COUNCIL REF. RM031)

Mr Hull and Councillor Keith Dibble made deputations in respect of this item.

Councillor E. J. Neal also attended and spoke as one of the Local Members for the

adjoining Division objecting to the proposal on the grounds of the impact on

traffic and an inadequate highway contribution. He circulated a detailed map,

photographs, a letter from the Head of Planning at Rushmoor Borough Council

and representatives received from a taxi driver living in North Lane.

The Committee considered the report of the Head of Planning and Development

(Item 6 in the Minute Book) on an application for planning permission for a

Waste Recycling and Transfer Facility proposed at Unit 1A Hollybush Industrial

Park, Hollybush Lane, Aldershot.

In considering the application, Members noted issues of landscape, traffic using

North Lane and the amenity of the area. Members noted that Rushmoor Borough

Council's Development Control Committee at its meeting on 3 January 2008 had

objected to the application on the grounds that the proposals did not adequately

address the nature and routeing of vehicles travelling to and from the site

particularly North Lane nor the noise and ground contamination issues.

The Head of Planning and Development advised that although North Lane, with its

direct access to the A331 carries a relatively high number of vehicles, 5% of which

are lorries, this is within that which might be expected for a road with this

function. Surveys recently carried out indicated that the speed of traffic is well

below the 30mph limit. A height restriction is in force on the bridge at the northern

end which prevents larger vehicles using this route and traffic signals control the

traffic flow at the southern end. All recorded injury accidents were slight and

involved turning movements in and out of side roads, again a characteristic of this

type of road which serves as a local distributor.

Members agreed that there was a need for the facility and on a designated

industrial estate but expressed concern about a number of issues including the

sheeting of lorries and the number of movements and proposed that conditions be

imposed to control these issues.

RESOLVED:

That, subject to the applicant making a financial contribution towards improving

the local road network in the vicinity of the site, planning permission for a waste

recycling and transfer facility at Unit 1A Hollybush Industrial Park, Hollybush

Lane, Aldershot (Application No. 07/00897/HCC) be granted subject to conditions

set out in Appendix 1 of the report, additional conditions relating to the sheeting

of lorries and their movements being restricted to 180 per day (90 in and 90 out),

amendment to Condition 23 to include, after `bin storage and parking area' and

land to the south of the Conifer screen.

183. PROPOSED SYNTHETIC TURF SPORTS PITCH WITH A 3.6 METRE

HIGH WELDMESH FENCING, FLOODLIGHTING AND ASSOCIATED

LANDSCAPING AT ROBERT MAY'S SCHOOL, WEST STREET,

ODIHAM (APPLICATION NO. 07/02747) (COUNTY COUNCIL REF.

HRE006)

Mrs Susan Rafter, Headteacher at Robert May's School, Mr Neil Reay, Deputy

Headteacher at Robert May's School and Mr Colin Lord, Senior Landscape

Architect and Design Consultant, Property, Business and Regulatory Services at

Hampshire County Council made deputations in respect of this item.

The Committee considered the report of the Head of Planning and Development

(Item 7 in the Minute book) on an application for planning permission for a

proposed Synthetic Turf Pitch (STP) with a 3.6 metre high weldmesh fencing,

floodlighting and associated landscaping at Robert May's School.

The Head of Planning and Development reported that there was an educational

need for this type of facility and that details of the proposed planting and

mounding would be submitted prior to the development.

Standing Order 21 was suspended to allow questions of clarification of facts to be

asked of the deputees.

In considering the application, Members considered issues associated with the

landscape, local gap, light pollution and noise pollution. Members agreed that

there was a need for the STP and noted that the applicant had responded to

concerns by reducing the size and the number of the lighting columns from

15 metres to 12 metres and 8 to 6 respectively.

RESOLVED:

That planning permission in respect of a Synthetic Turf Sports Pitch with a

3.6 metre high weldmesh fencing, floodlighting and associated landscaping at

Robert May's School, West Street, Odiham (Application No. 0/02747/HCCREG3)

be granted for the reason set out in the report, subject to conditions set out in

Appendix 1 of the report and an amendment to Condition 6 that details of the

proposed planting and mounding shall be submitted for approval.

184. TO EXTEND THE EXISTING BUILDING BY 17 SQUARE METRES TO

PROVIDE A CHILDREN'S TOILET AND SMALL KITCHEN, ADD NEW

DOUBLE DOORS TO NORTH ELEVATION, EXTENSION TO BE BRICK

TO MATCH EXISTING WITH PITCHED SLATE ROOF TO MATCH

EXISTING AT ELING INFANT SCHOOL, SCHOOL ROAD, ELING

(APPLICATION NO. 07/91089) (COUNTY COUNCIL REF. NFE055)

The Committee considered a report of the Head of Planning and Development

(Item 8 in the Minute Book) on an application for planning permission to extend

the existing the existing building by 17 square metres to provide a children's toilet

and small kitchen, add new double doors to north elevation and an extension to be

brick to match existing with pitched slate roof at Eling Infant School, School Road

Eling.

The Head of Planning and Development reported that written representations

objecting to the proposed development had been received from Ms A Hatch who

had been unable to attend the meeting to make a deputation due to difficulties

getting to Winchester. He read out the salient points of her letter.

In considering the application, Members considered issues of visual impact and

parking and noted that the proposal would not generate additional parking.

RESOLVED:

That planning permission to extend the existing building by 17 square metres to

provide a children's toilet and small kitchen, add new double doors to north

elevation, extension to be brick built to match existing pitched slate roof at Eling

Infant School, School Road, Eling, Totton (Application No. 07/91089) be granted

for the reason set out in the report, subject to conditions set out in Appendix 1 of

the report.

185. PROPOSED EXTENSION TO EXISTING BUILDING AND OUTSIDE

STORAGE BAY AT 1 PEGHAM COPPICE, FONTLEY ROAD, FUNTLEY

(APPLICATION NO. 07/02914) (COUNTY COUNCIL REF: WR199)

Mr Mark Jackson of Bryan Jezeph Consultancy Limited made a deputation in

respect of this item.

The Committee considered a report of the Head of Planning and Development

(Item 12 in the Minute Book) on an application for a proposed extension to the

existing building and outside storage bay at 1 Pegham Coppice, Fontley Road,

Funtley.

The Head of Planning and Development reported that if planning permission was

granted a further condition would be added for the construction of a fence. He also

reported that Councillor Allgood, one of the Local Members had given his

apologies as he was unable to attend the meeting, but wanted reassurance that a

fence would be constructed to provide privacy for the residents living in the

adjacent bungalow.

In considering the application, Members considered issues of visual impact in the

Meon Strategic Gap and noted that objections had been received from Winchester

City Council and Wickham Parish Council about further development on the

Industrial estate and the impact on nature conservation on the Site of Importance

for Nature Conservation (SINC).

Members also felt that the lorries should be sheeted.

RESOLVED:

That planning permission in respect of the extension to the existing building and

outside storage bay at 1 Pegham Coppice, Fontley Road, Funtley (Application No.

07/02914/HCS) be granted subject to conditions set out in Appendix 1 of the

report and to further conditions relating to the sheeting of lorries and the

requirement for the construction of a three metre acoustic fence for the adjacent

bungalow prior to the commencement of construction.

186. NEW INFORMATION REQUIREMENTS FOR VALIDATION OF

PLANNING APPLICATIONS

The Committee considered a report of the Head of Planning and Development

(Item 10 in the Minute Book) on new information requirements for validation of

planning applications.

RESOLVED:

That a consultation be undertaken with stakeholders on a draft proposed `Local

List' for each planning application type and the results of the consultation be

reported back to the Regulatory Committee on 12 March 2008.

187. PROPOSAL TO EXTINGUISH PARTS OF RUSHMOOR FOOTPATHS 16,

33A AND 34B AND ALL OF RUSHMOOR FOOTPATH 34A AND TO

MAKE A MAP MODIFICATION ORDER TO RECORD ALTERNATIVE

FOOTPATHS IN FARNBOROUGH AS PUBLIC RIGHTS OF WAY

The Committee considered a report of the Director of Recreation and Heritage

(Item 11 in the Minute Book) on a proposal to extinguish parts of Rushmoor

Footpaths 16, 33a and 34b and all of Rushmoor Footpath 34a and to make a Map

Modification Order to record alternative Footpaths in Farnborough as public rights

of way.

RESOLVED:

(i) That an Order be made to extinguish part of Footpaths 16 between points

A - B, as shown on the map attached to the report.

(ii) That a Map Modification Order be made to record route B-C as a public

footpath, as shown on the map attached to the report

(iii) That an Order be made to extinguish part of Footpath 33a between points

D-E, as shown on the map attached to the report.

(iv) That a Map Modification Order be made to record routes D-F-G and F-H as a

public footpath, as shown on the map attached to the report.

(v) That an Order be made to extinguish all of Footpath 34a between points J-K,

as shown on the map attached to the report.

(vi) That a Map Modification Order be made to record routes L-M-N and M-O, as

shown on the map attached to the report.

(vii) That an Order be made to extinguish part of Footpath 34b between points

P-Q, as shown on the map attached to the report.
