1.0

Summary

1.1

The Executive Member for Policy & Resources approved on 5 April 2007 the annual review of construction related procurement for 2006/7 and a series of new initiatives to be implemented during 2007/8 and beyond.

1.2

The purpose of this report is to summarise the actions taken during 2007/8, analyse the outcomes, seek approval to further procurement initiatives and set out a number of procurement developments and arrangements for 2008/9 and beyond.

1.3

The completion of projects through Framework arrangements ensures that the schemes are delivered in a cost-effective way, involves closer working and collaboration with the construction industry which ensures continuous improvement in the County Council's services and enhances the quality of place in Hampshire.

The proposals to tender the following consultant framework arrangements during 2008/9 be approved:

_ Acoustics - anticipated value up to £100,000 per annum

_ Archaeology - anticipated value up to £150,000 per annum

_ Building Control - anticipated value up to £250,000 per annum

The proposal to extend the current temporary buildings contract with Elliott Group until 31 October 2009, with an estimated annual value of £800,000, be approved.

The proposal to tender a framework arrangement for external decorations work, with an anticipated value of £4 million per annum be approved.

2.0

Introduction

2.1

During the last 12 months the main focus of activity has been the integration of the County Council's procurement policy with that of the South East Centre of Excellence (SECE) through the use of the new framework arrangements established by Hampshire County Council on behalf of SECE, for the delivery of the County Council's mainstream work.

2.2

In addition, a number of specialist frameworks and term contract arrangements are being developed following the success of pilot arrangements trialled over recent years.

2.3

This work is the culmination of a number of pilot arrangements to extend collaborative procurement arrangements across the full range of building construction work procured on behalf of the County Council, in order to deliver improved performance, value for money and efficiency savings.

2.4

This report sets out the department's procurement model and strategy for building construction work, which has been updated to reflect the implementation of the new arrangements. A number of these arrangements are currently being developed or tendered and these will be the main focus of procurement activity during the coming year, in particular:

_ Development and procurement of new specialist frameworks including hard landscaping, external decorations and roofing.

_ Procurement of reactive building maintenance contracts.

_ Procurement of a combined building and engineering maintenance contract for the Castle Complex headquarters buildings.

_ Procurement of consultancy framework arrangements.

In addition the department continues to lead the Construction Procurement and Asset Management Partnership for the South East Centre of Excellence. A wide ranging business case has been submitted, the implementation of which will be subject to the outcome of the funding application for the Comprehensive Spending Review 2007 CSR07 period. However, it is anticipated that the focus during 2007/8 will be the development of a SECE consultancy arrangement to compliment the Tier 1 framework and development of further sub-regional Tier 2 and Tier 3 framework arrangements for clusters of authorities and the ongoing management and development of the existing framework arrangements.

3.0

Analysis and Review

3.1

During 2007/8 a total of £114 million of construction work has been committed through the department. This includes the £30 million Ashburton Court redevelopment contract which was finalised early in the financial year.

3.2

Work has been delivered through a range of procurement routes, including the County Council's Framework for Major Schemes and Programmes of Work, preferred small to medium size contractors, specialist firms and traditional competitive tender.

3.3

In 2007/8 approximately 65% of the overall value of project work was procured through collaborative procurement arrangements with the remainder procured through conventional tendering. The level of commitment through collaborative procurement arrangements is within the ceiling set for best value procurement approved by Cabinet in September 2004 of 70% as a proportion of the overall value.

3.4

A summary of all best value procurement approved in 2007/8 is shown in Appendices 1 and 2:

· Appendix 1 details all of the work committed through the County Council's Framework for Major Schemes for 2007/8 and 2008/9

· Appendix 2 details work procured through other best value procurement arrangements including preferred contractors and specialist framework arrangements.

3.5

In value terms, approximately of £55 million worth of major project work will have been committed by best value forms of procurement during 2007/8 through:

    _ Major Framework - 6 projects worth £44.2 million

    _ Preferred contractors - 44 projects worth £9.5 million

    _ Preferred contractors -14 packages of multiple projects worth £2.1 million

4.0

HCC Procurement Model and Strategy

4.1

The department's procurement strategy has been to develop long term collaborative arrangements with both contractors and consultants. This ensures that the County Council has sufficient capacity in the medium term for the delivery of the Capital Programme and enables the engagement of contractors during the pre-construction period in key design and construction decisions, project planning, joint risk management and supply chain development. As previously reported to the Panel, this approach has been proven to deliver increased certainty of project costs and improvements in performance across a range of other performance indicators including health and safety, time and quality.

4.2

Appendix 3 sets out the department's current procurement model for building construction and maintenance work, the key elements of which are described below. This procurement model will continue to be developed to ensure that it best meets the needs of the County Council and continues to deliver value for money. In particular, consideration is currently being given to the appropriate procurement models for delivery of facilities management services and the government's Building Schools for the Future and Primary Capital Programme funding streams. Proposals for further development of the procurement model will be reported to future Panel meetings.

5.0

SECE Framework Arrangements

5.1

The following framework arrangements have been established by Hampshire County Council in its role as lead authority for the Construction Procurement and Asset Management Partnership for SECE.

5.2

SECE Tier 1 Framework

5.2.1

The SECE Tier 1 framework comprises 10 national contractors and is intended to deliver major projects with a construction value in excess of £1 million. It replaces the County Council's own Framework for Major Schemes, which expired in August 2007.

5.2.2

The framework is currently being used to procure the Andover Primary Schools, Education Centre and Children's Centre programme of projects, as identified in Appendix 4. Further schemes to be procured through the Tier 1 framework will be reported to the Panel when they are confirmed.

5.3

SECE Tier 2 Framework

5.3.1

The SECE Tier 2 Framework, finalised in autumn 2007, comprises 7 medium sized contractors and is intended for projects with a construction value between £500,000 and £2.5 million. Projects currently identified for procurement through the Tier 2 framework are shown in Appendix 5. Further schemes to be procured through the Tier 2 framework will be reported to the Panel when they are confirmed.

5.4

SECE Tier 3 Framework

5.4.1

The tender process for the Tier 3 framework has now been concluded and the following contractors selected for appointment to the framework:

5.4.2

The Tier 3 framework is intended for projects with a construction value up to approximately £500,000. It is anticipated that the greatest benefits will be obtained where a number of similar projects can be aggregated into a programme of work providing efficiencies through economy of scale, procurement time, consistency of approach, and common specifications and supply chain arrangements. Typically projects will include refurbishments of toilets, specialist teaching spaces, SCOLA re-cladding projects and small extensions and internal alterations.

5.4.3

Projects and programmes of work to be procured through the Tier 3 framework are currently being identified. Those with a construction value over £100,000 will be reported to future Panel meetings.

6.0

Specialist Framework Arrangements

6.1

Hard Landscaping

6.1.1

Details of the hard landscaping framework were reported to the Panel in March 2007. Tenders for this framework are due to be returned in April with a view to appointing contractors to the framework arrangement during the summer 2008. It is anticipated that between 3 and 5 contractors will be appointed to the framework.

6.2

Temporary Buildings

6.2.1

The extension of the temporary buildings term contract with Elliott Group until 31 October 2008 and appointment of a second contractor, Martin Reynolds Construction (MRC) has been previously report to the Panel.

6.2.2

Elliott Group has continued to perform well as measured through the key performance indicators for the contract. The original contract with Elliott Group was for an initial 2 year term, commencing on 1 November 2005, with the option to extend for up to a further 3 years. To date the contract has been extended for a 2 year period up to 31 October 2008. It is now proposed to extend the contract for a further 1 year until 31 October 2009, at an estimated value of £800,000 per annum. This extension will bring the timescales for expiry of both temporary buildings contracts closer together, allowing a new framework arrangement to be established through a single tender process.

6.3

External Repair and Redecoration

6.3.1

Since 2002 the department has aggregated external repair and redecoration projects into packages of work and procured the majority of these through a number of preferred contractors. This arrangement has delivered efficiencies in the internal contract management arrangements and has also provided improved contractor performance and cost benefits.

6.3.2

It is anticipated that approximately £2.7 million of external repair and decoration work will be procured during 2008/9. This programme will be divided into approximately 10 packages of work, with each package procured through competitive tender to a short list of 3 contractors. The initial packages of work will be tendered on a best value basis, with subsequent packages tendered on a traditional lowest price basis.

6.3.3

To ensure that we continue to gain the benefits from a collaborative working arrangement with contractors, it is proposed to establish a framework arrangement for external redecoration work for operation from 2009. It is anticipated that up to12 contractors will be appointed to the framework, with an annual value of approximately £4 million. Further details of this framework will be reported to the Panel as it is developed.

6.4

Roofing

6.4.1

Proposals to develop a framework for roofing work were reported to the Panel in March 2007. The reactive repair element of this work has been incorporated into the reactive building maintenance contracts currently being procured. It is now proposed to proceed with the procurement of a framework for larger roofing repairs and re-roofing work with an anticipated value of £2 million per annum. Further details of this framework will be reported to the Panel as it is developed.

7.0

Term Contracts

7.1

Engineering Maintenance Term Contracts

7.1.1

As the Panel is aware the re-tendered engineering maintenance term contracts commenced in August 2007 for a 5 year period, with the option to extend for a further 5 years, subject to the performance of the contractors and the requirements of the County Council.

7.2

Reactive Building Maintenance Contracts

7.2.1

The evaluation of pre-qualification submissions for the proposed reactive maintenance contracts has now been concluded and tender documents are being prepared. It is anticipated that 12 contractors will be invited to tender for the four contracts with a view to these contracts being in place by autumn 2008.

7.3

Castle Complex Maintenance Contract

7.3.1

A Prior Information Notice has now been published in the Official Journal of the European Union confirming the County Council's intention to tender a combined building and engineering maintenance contract for the Castle Complex headquarters buildings, as reported to the Panel in January 2008. Progress and outcomes from the tender will be reported to the Panel later in the year.

8.0

Competitive Tendering

8.1

Competitive tendering will continue to be used to procure a range of building construction and maintenance work. This may comprise best value tenders for larger or more complex projects and lowest price tendering where the schemes are smaller and less complex. Competitively tendered schemes allow us to benchmark costs and performance against the framework arrangements and also ensure that we continue to provide business opportunities to a wide range of suitable contractors.

9.0

Electronic Tendering

9.1

During 2007/8 Property Services has procured a number of projects through the In-Tend electronic tendering system. This has included a successful mini-competition under the SECE Tier 2 framework. During 2008/9 it is proposed to extend the use of electronic tendering to more of the department's projects, including mini-competitions to select contractors under the various framework arrangements. This is in line with the Corporate Procurement Strategy and is anticipated to provide efficiencies in the management of the tender process.

10.0

Professional Services

10.1

The Panel has previously been advised of proposals to renew the department's existing consultant framework arrangements and to establish a number of new arrangements.

10.2

Pre-qualification submissions have been received for the structural inspections, structural and civil engineering design, quantity surveying and landscape architecture and ecology frameworks. Pre-qualification submissions for the mechanical and electrical engineering frameworks are due to be returned by the end of March and contract notices will shortly be published for town planning and urban design and transport planning arrangements.

10.3

The Executive Member for Policy and Resources approved the proposals to establish framework arrangements for building surveying and land survey work on the 28 January 2008 and these are currently being developed. It is now proposed to establish two further consultant framework arrangements, for the provision of acoustics and archaeological services, both of which are areas where legislative requirements are increasing . In addition, the current arrangement with Butler and Young for provision of building control services will expire in 2009. It is therefore proposed to re-tender this arrangement later this year.

11.0

Performance Management

11.1

All of the work procured through the department is evaluated through formal performance management arrangements. For the collaborative framework and term contract arrangements, this includes two way performance reviews between the contractor or consultant and the department's project team. Clients and end users are also invited to provide feedback on the performance of the project team and contractor.

11.2

Ongoing analysis and review of the performance data allows the department to manage any performance issues at an early stage and also to compare the performance achieved through the different procurement routes. With the establishment of the new SECE framework arrangements, it will also be possible to benchmark the performance of the County Council's projects against those of other local authorities participating in these frameworks.

11.3

A detailed analysis of contractor and project performance will be submitted to the Panel in July 2008, once all the data for projects completed during the financial year 2007/8 has been collated and analysed.

12.0

South East Centre of Excellence

12.1

Hampshire County Council has continued to lead the Construction Procurement and Asset Management Partnership of the South East Centre of Excellence. During the last 12 months the focus has been on the management of the Tier 1 framework arrangement and the establishment of sub-regional Tier 2 and Tier 3 frameworks for Hampshire and Sussex.

12.2

A business case has been submitted in support of an application for funding for this workstream during the CSR07 period. The activities identified include the development of a SECE consultancy framework to compliment the Tier 1 Framework for major schemes. Development of sub-regional framework arrangements for further clusters of authorities, and the ongoing management and development of the Tier 1 framework and the Hampshire and Sussex Tier 2 and Tier 3 frameworks.

12.3

In addition, Hampshire County Council has been asked by SECE to lead the development of highways and transportation workstream with a view to delivering efficiency savings and quality improvements through the development of shared contracts and frameworks, specialist frameworks, procurement processes and sharing of best practice.
