1 Summary
1.1 An application made by James Weeks of 8 Stockers Avenue, Winchester and 16 others was received on 19 January 2005 to register land known as "The Triangle" at the junction of Stockers Avenue and Westley Close, Winchester as town or village green. The landowner, Ronald Moody, objected to the application. A non-statutory public inquiry has been held at which Mr Vivian Chapman QC acted as Inspector. Mr Chapman has prepared a report which recommends the application be acceded to.
2 Introduction
2.1 The advertisement of the application resulted in letters of objection being received from Ronald Moody the owner of the majority of the land and also from solicitors acting for Linden Homes Southern Limited, who were initially concerned that they may also own a part of the application land, although subsequently it was established that the application was not intended to relate to any of their land.
2.2 Advice was taken from Vivian Chapman QC and he advised that the registration authority should hold a non-statutory public inquiry and the Inspector appointed should prepare a report and recommendation to the registration authority. The Regulatory Committee agreed to this course of action on 7 February 2007.
3 Public Inquiry
3.1 A public inquiry was held on various dates in November and December 2007 following which Mr Chapman prepared a report which is attached at appendix 1. Members will note the area the subject of the application is shown on a plan signed by Mr Weeks and dated 16 November 2006, attached at appendix 2.
4. Recommendation
That the application to register "The Triangle" at the junction of Stockers Avenue and Westley Close, Winchester as town or village green be acceded to and that the register of town and village green be amended accordingly.
