1. Summary
The following decision is sought:
That authority is given to extend eleven contracts for mental health services in order to implement the proposed tender schedule for 2010 to 2011 set out in Appendix 1. This authority is subject to receipt of written agreement from Hampshire Primary Care Trust for those contracts which are jointly funded.
2. Reason
2.1 This report is submitted to seek authority to extend eleven contracts for mental health services. This is required to implement the tender schedule for 2010 to 2011 in accordance with the Executive Member decision in May 2007. The Tendering Strategy for block contracts for mental health services was approved by the Executive Member for Adult Social Care, 16 May 2007. That approval required that extensions to contracts until 2010 and 2011 as part of the strategy should be subject to separate approval.

3.1 This report supports the corporate strategy priorities of "Hampshire safer and more secure for all" by protecting vulnerable people, "Maximising wellbeing" by ensuring access to the services people need and support should things go wrong and "Enhancing quality of life" by planning proactively for the future.
4. Other Options considered and rejected
4.1 Do Nothing - This was considered and rejected as it would not be possible to complete the implementation of the four year tendering strategy for Mental Health Services as agreed by the Executive Member on 16 May 2007.

1.1 This report is submitted to seek authority to extend eleven contracts for mental health services. 2. Recommendation
The following decision is sought:
a) That authority is given to extend eleven contracts for mental health services in order to implement the proposed tender schedule for 2010 to 2011 set out in Appendix 1. This authority is subject to receipt of written agreement from Hampshire Primary Care Trust for those contracts which are jointly funded.
3. Background
3.1 "Tendering Strategy for block contracts for mental health services", a report to the Executive Member for Adult Social Care was considered on 16 May 2007. This set out a tendering strategy to improve the management of block contracts for mental health services.
3.2 The following decisions were made:
a) That authority is given to implement the proposed tendering strategy for mental health services.
b) That authority is given to extend nine contracts for mental health services in accordance with the proposed tender schedule for 2007 to 2010.
d) That a further report is submitted to seek authority to extend contracts in accordance with the proposed tender schedule for 2010 to 2011.
3.3 This report is submitted to seek authority to extend eleven contracts in order to implement the proposed tender schedule for 2010 to 2011 in accordance with the decision set out above in 3.2 (d).
4. Review and Tendering Plan
4.1 Block contracts for mental health community support services have been grouped together to enable them to be reviewed and tendered on a county-wide basis over a four year period.
4.2. Services will be reviewed to ensure they meet priorities and objectives set out in the Hampshire County Council Adult Services (HCCAS) Mental Health Service Plan and the joint mental health strategy1. Services will be jointly reviewed by Hampshire County Council and Hampshire Primary Care Trust and the service reviews will be completed prior to tendering for replacement services.
4.3 Services being tendered will be those where Hampshire County Council acts as the lead commissioner, but these may be jointly commissioned with Hampshire Primary Care Trust and or other commissioning bodies. The proposed tendering schedule for years three and four of the four year plan is as follows.

4.4 Appendix 1 sets out the periods of extensions to existing contracts needed to implement the proposed tendering programme for 2010 - 2011. Extensions to eleven contracts are required to implement the tender plan.
5. Consultation
5.1. Consultation through local implementation teams was undertaken prior to the submission of the report of 16 May 2007. Since then, a focus group and workshops with providers have been held to discuss the new tendering arrangements. A presentation of the new contracting processes, including tendering arrangements, was made to a Hampshire Mental Health Service Users Engagement Event in February 2008.
5.2 A tender plan for 2010 and 2011, which is published on the Council's dedicated web site, will inform service providers as to the timetable for the tendering of mental health services.
5.3 Consultation regarding the value of individual services is an integral part of the service review process. The service reviews are scheduled at least six months before the start of the related tendering process and will include specific consultation with service users and other stakeholders. Service users are involved in the individual tendering processes.
6. Impact and Implications
6.1 Legal
This report seeks authority to extend an existing tendering schedule for mental health services to 2011. Legal advice has been sought and it has been confirmed that the report complies with the Council's Standing Orders and relevant procurement requirements.
6.2 Financial
In order to review and tender services as a group, a number of existing contracts will be extended so that all contracts in that group will end on the same date. All of the services to be tendered between 2010 and 2011 are funded by Hampshire County Council Adult Services and / or Hampshire Primary Care Trust. The total annual value of these contracts is approximately £2,000,000, of which approximately 60 per cent is funded by Hampshire County Council Adult Services. In order to implement the tender plan, extensions to eleven contracts are required. The total value of these extensions is approximately £2,000,000. Written agreement from Hampshire Primary Care will also be required in order to extend those contracts which are jointly funded
6.3 Impact Assessment
An Initial Race and Equality Screening Assessment has been completed. This has identified areas which must be taken into consideration as part of the service reviews, but does not identify any issues in relation to the recommendations set out in this report. All service specifications of existing contracts are being reviewed to ensure that they do not discriminate on basis of age and will be amended where necessary.
7. Conclusion
7.1 This report sets out a proposed tendering plan for mental health support services for 2010 and 2011. This will enable services to be reviewed on a Hampshire-wide basis to deliver equitable improved services to meet the needs of the future.
