1 Summary
1.1 The Committee considered a report at its meeting on 5 January 2005 (copy attached as appendix 1) and resolved that a Special Extinguishment Order should be made in respect of a footpath that runs through the School grounds. It is recommended that that decision should be rescinded.
2 Introduction
2.1 After the meeting on 5 January further consultation took place with the Borough Council, the School and the Police and on 10 February 2006 the Borough Council wrote to the County Council stating they did not consider that the proposed closure of the footpath "is an appropriate or effective solution and objects to it..."
2.2 On 8 March 2006 the Local County Council Member wrote a letter reinstating his objection to the closure and also stating his wife the Borough Councillor also objected.
2.3 At a meeting on 17 March 2006 the Local Member presented a petition with 400 signatures objecting to the closure.
2.4 On 19 July 2006 a survey over 12 hours was carried out which logged 251 pedestrian movements, confirming the high level of use of the path.
2.5 Given the level of local opposition to the proposed path closure, the School accepted that the closure of the path through the Special Extinguishment Order was not likely to be successful.
3 Recommendation
3.1 County Council Officers consider that in the circumstances it would not be expedient to proceed with the Special Extinguishment Order and therefore are recommending that the decision of the Committee of 5 January 2005 be rescinded.
